Wordal, Staff Attorney Kyla Murray, Staff Attorney Ryan McCarty, Staff Attorney Anna Saverud, Staff Attorney This letter shall serve as a license to operate a youth air shooting range at 2320 West Main Street in Bozeman. As you know, 24.07.150, BMC, prohibits the discharge of airguns within the City of Bozeman. However, 24.07.180, BMC, authorizes the City to issue a license for a shooting gallery. I consider a license issued under 24.07.180, BMC, to provide authorization for the discharge of airguns at your facility. You must satisfy the requirements placed upon the operation of the range by the City of Bozeman Department of Planning and Community Development pursuant to its letter of November 9, 2012, and the Safety Plan approved by Chief of Police Ron Price on November 1, 2012. Both are attached to this license. In addition, the range must comply with all applicable building codes. The license to operate the range is issued for this location only. Should you move locations or add additional space a modification is required. As part of that proposal they have submitted a written safety plan and floor plan. The Bozeman Police Department has conducted a review of the documents pursuant to the requirements of 76 -9 -105 MCA. As proposed, the plan provides for safe operations that do not present °a clear and provable safety hazard to the adjacent population." Madison, Ste. 300 Belgrade, MT 59714 RE: Wine Gallery Commons Shooting Sports Re-use Application (#R- 12020), to allow a community center use at 2320 West Main Street. Dear Ms. Jamison: The Bozeman Department of Planning & Community Development is pleased to award conditional approval of your Reuse application to allow a community center use at 2320 West Main Street. Please be aware that approval is subject to the following conditions of approval and code provisions: Conditions of Approval I. The Safety Plan approved by the Bozeman Police Department shall be implemented and enforced at all times during use of the air rifle range. 2. Prior to occupancy, a building permit for the change of use shall be approved. 3. Prior to occupancy, emergency exit directional signage shall be posted throughout the interior. 4. Prior to occupancy, emergency fire sprinkler systems shall be in working order and proof of such shall be submitted to the Building Inspection Division (20 E. Olive St., Ste. 208) and shall be maintained. Code Provisions • Per Section 18.38.050.F, "Accessory Buildings, Uses and Equipment," all mechanical equipment shall be screened. Rooftop equipment should be incorporated into the roof form and ground mounted equipment shall be screened with walls, fencing or plant materials. • Per Section 38.23.150 F "Lighting Specifications for All Lighting, in all light fixtures, the light source and associated lenses shall not protrude below the edge of the light fixture, and shall not be visible from adjacent sheets or properties. For lighting horizontal areas such as roadways, sidewalks, entrances and parking areas, fixtures shall meet IESNA "full-cutoff" criteria (no light output emitted above 90 degrees at any lateral angle around the fixture). • Per Section 18.42.170, the size of the trash receptacle shall be appropriately sized for the use and approved by the City Sanitation Department. Accommodations for recyclables must also be considered. All receptacles shall be located inside of an approved trash enclosure. A copy of the final site plan, indicating the location of the trash enclosure, dimensions of the receptacle and enclosure and details of the materials used, shall be sent to and approved by the City Sanitation Division (phone: 586 -3258) prior to final approval. • Per Chapter 18.46, "Parking," adequate parking spaces, both regular and ADA accessible shall be provided on the site as described in said Chapter requirements. • Per Chapter 18.52, all signage shall require a sign permit subject to review and approval by the Department of Planning & Community Development. • Per Section 18.34.050, any exterior modifications will require a Certificate of Appropriateness application approved by the Department of Planning and Community Development. • Per Section 18.64.100.F, id approval shall become null and void.
