RESOLUTION PC2012-03
A RESOLUTION OF THE PARKING COMMISSION OF THE CITY OF BOZEMAN,
MONTANA,THAT DEFINES WHERE THE ROLLING RULE IS APPLICABLE.
WHEREAS,pursuant to city Resolution 3803,the Bozeman Parking Commission has
jurisdiction over three parking districts: the downtown B-3 Zoning District,the Montana State
University Residential Parking District, and the Bozeman High School Residential Parking
District; and
WHEREAS, Sect. 7-14-4622(7), MCA, authorizes the Bozeman Parking Commission,
having been vested the authority by the Bozeman City Commission,to"regulate on-street
parking when it remains in use, in coordination with off-street parking, subject to traffic
regulations imposed by the state;" and
WHEREAS, Sect. 7-14-4628, MCA, authorizes the Bozeman Parking Commission to issue
regulations for on-street parking related to the determination of parking locations,variable
parking durations, variable parking rate schedules, and enforcement policies and procedures; and
NOW,THEREFORE,BE IT RESOLVED that Bozeman Parking Commission shall
recommend that the BMC shall be amended as follows:
1. Section 36.04.250 — to allow the Parking Commissionn by resolution to erect si ns or
markings upon any city par ing facility o prohibit the standing or parking of vehicles
or to restrict such standing or parking
2. Section 36.04.260 — to apply the "rolling rule" to city parking facilities and to make
holders of permits issued by City of Bozeman exempt from the maximum duration for
parking,provided such permit is properly displayed if!required;
3. Section 36.04.380(D) - the fine for parking longer than 48 hours on a street alley,
highway or city parking facility — other than the Bridper Park Garage — shall be a fine
of no less than $30.00 or more than$300.00.
