I WHEREAS, the COmmission of the City of Bozeman, pursuant to the provisions of Chapter 9.36 of the Bozeman MUnicipal COde and of Chapter 7-12-4176/4177, MOntana COdes Annotated, 1978, provide for the construction of sidwalks and curbs in the City of Bozeman during the year 1978. WHEREAS, proceedings were had for the construction and installation and/or repair of Mis- cellaneous Sidewalks and Cllrbs in the Ci ty of Bozeman for the year 1978, and WiEREAS, miscellaneous Sidewalks and ilirbs were constructed and installed and/or repaired bordering on various properties in the City of Bozeman, pursuant to Chapter 9.36 of the Bozeman MUnicipal COde and the provisions of Chapter 7-12-4176/4177 M.C.A., 1978, which are hereby referred to and made a part of this Resolution, and WHEREAS, the miscellaneous Sidewalks and ilirbs have been constructed and completed and/or repaired in accordance with the teras and conditions of said proceedings, and the City Engineer has duly certified to the COmmission a Schedule showing the sidewalks and curbs which have been constructed and installed and/or repaired, and the properties which are subject to assessment thereunder and the total cost of said construction and installation and/or repairing is the sum of One-Hundred-Three Thousand Eight-Hundred TWenty-Five and 46/100 (103,825.46) Dollars. ruN, THEREFORE, pursuant to the provisions of O:tapter 9.36 of the Bozeman ~icipal COde and Chapter 7-12-4176/4177, M.C.A., 1978, as aforesaid. BE IT REEDLVED AND IT IS HEREBY ctIDERED BY THE a::MAISSIOO OF THE CITY OF IDZEMAN M)NrANA: Sect ion l. That to defray the cost of constructing and installing and/or repairing Mis- cellaneous Sidewalks and ilirbs as set forth in Schedule "A", there is hereby levied and assessed a tax armunting to the sum of One-Hundred-Three Thousand Eight-Hundred TWenty-Five and 46/100 I (103,825.46) Dollars. Section 2. That a particular description of each lot and parcel of land with the name of the owner and the sum assessed against him or it for such construction and installation and/or repair and the armunt of each payment to be made and the day when the same shall become de- linquent is set forth in the assessment list; that the several sUITE set opposite the name of the owner and the description of the lots and parcels of land be, and the same are hereby respectively levied and assessed upon said lots and parcels of land to defray the cost and expense of con- structing and installing and/or repairing said Sidewalks and ilirbs; that the several sums so assessed be collected from the respective owners of said lots and parcels of land described in said assessment list as required by law; that the payment of said sums shall be made in five (5) installments; that the payment of said installments shall be made on or before the 30th day of November of each year until payment of all installments together with the interest thereon, shall be made; that said sUITE shall be paid and the collection thereof shall be made in the manner and in accordance with the law governing the collection of Special Improvement Taxes; that failure to pay such assessments when the sum shall became due and payable shall make such persons and said lots and parcels of land liable to the penalties provided by law relative to delinquent taxes. Sect ion 3. That the regular session of the Cbmmission of the City of Bozeman to be held in the Cbmmission Chamber in the City Hall Building of said City on the 12th day of December, 1979 at 1:15 o'clock p.m. be, and the same is hereby designated as the time and place at Which ob- jections to the final adoption of this resolution will be heard by said Gbrnmission. I Section 4. I NOTICE IS HEREBY GIVEN. that during a regular session of the Cbrrnrlssion of the City of Bozeman held on Wednesday. the 5th day of December. 1979. COmmission Resolution 2149 levies and assesses a special assessment of taxes upon certain lots and parcels of land in front. or on the side of which sidewalks and curbs have been constructed and/or repaired pursuant to the pro- visions of Chapter 9.36 of the Bozeman MUnicipal COde and of Chapter 7-12-4176/4177. M.C.A.. 1978. to defray the cost and expense of constructing and installing and/or repairing said Side- walks and Cltrbs. That said COmmission Resolution is now on file in the office of the Clerk of the COmmission. subject to inspection for a period of five (5) days by any persons interested. That Wednesday. the 12th day of December. 1979. at 1:15 o'clock p.m. of said day, at a regular session of the COmmission of the City of Bozeman at the COmmission Chauber, City Hall Building of said City, has been designated as the time and place when and where the said COmmission will hear and pass upon any and all objections that may be made to the final passage and adoption of said Gbar mission Resolution No. 2149 and the levying of said assessment. and that said Resolution will be finally passed and adopted at said regular session.
