HomeMy WebLinkAboutResolution 2159 Intent to annex Town Pump (Ordinance No. 1053): 1-16-80 .._--.... ..,.,..._ n.-..____. ____ r~... -- ~ .-,. - ---"- .........---~'-..._. _._,...._,..'-......_~--'--_.._--..~ .....,..------ ......-'--. - -,. ~'--- -..' -- 462 COMMISSION RESOLUTION NO. 2159 A RESOLUTION OF THE CITY OF BOZEMAN, MONTANA DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF, AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN, AND HEREIN MORE PARTICULARLY DESCRIBED AND TO BE KNOWN AS THE TOWN PUMP ANNEXATION TO EXTEND THE BOUNDARIES OF THE SAIQ CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTIGUOUS TRACTS W{THIN THE CORPORATE LIMITS THEREOF. I - WHEREAS. there has been presented to the City Commission of the City of Bozeman a written agreement cons~nting to the said City Commission extending the boundaries of the City of Bozeman so as to include certain contiguous tracts of land within the boundaries of the City of Bozeman and having presented to the City of Bozeman certifi- cates of survey of said land; and WHEREAS. the proper legal description of said contiguous tracts located in the County of Gallatin, State of Montana, is as follows: Description of the Town P~mp Annexati~n A tract of land beginning at a point on the West line of the Southwest Quarter of the Southeast Quarter (SW 1/4 SE 1/4) of Section Eleven (11), Township Two (2) South. Range Five (5) East, M.P.M.. which bears North 0015' East a distance of 989.31 feet from the Southwest corner of the Southeast Quarter (SE 1/4) of~id Section, Township and Range, which point being on the Northwesterly right of way of U.S. Highway #191, and 50 feet -left when measured at right angles to the centerline station 338 + 71.1, thence North 0015' East a distance of 331.74 feet to the Northwest corner of the Southwest Quarter of the Southeast Quarter (SW~. SE~)ofsaid Section, Township and Range, thence North 89025' East along the North line of the Southwest Quarter of the Southeast Quarter (SW~, SE~) of said Section, Township I and Range, a distance of 304.04 feet to a point of 50 feet left when measured at right angles to the centerline station 343 + 30.5 of said U.S. Highway #191, thence South 42021'30" West a distance of 459.37 feet to the point of beginning. Area of the parcel is 1.16 acres. WHEREAS, it will be for the best interests of the City of Bozeman and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described to extend the boundaries of the said City of Bozeman so as to include the said contiguous tracts hereinbefore described within the corporate limits of the said City of Bozeman. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF BOZEMAN: Section 1 That it is hereby declared to be to the best interest of the City of B~emm and the inhabitants thereof and of the inhabitants of the contiguous tracts hereinbefore described that the boundaries of the said City of Bozeman be extended so as to include the contiguous tracts hereinbefore described within the boundaries and corporate limits of the City of Bozeman, Montana. Section 2 Pursuant to Section 11-403, R.C.M., 1947, the Clerk of the City Commission shall cause notice to be published in the Bozeman Daily Chronicle, a newspaper nearest the parcels of land to be embraced within the corporate limits and boundaries of the City of Bozeman. at least once a week for two successive weeks which notice shall be to the effect that such resolution has been duly and legally passed and that for a period of 20 days after the first publication of such notice the Clerk of the City Commission will receive expressions of approval and disapproval in writing as to the proposed COMMISSION RESOLUTION NO. 2159 -" .....,,'~_~~.._~,,'......_.,...___.~._ - ...1.--" __,__ '._".._~.....,_~ .---...........-...-. _.... - .....,"-.-.,--. NOTICE IS HEREBY GIVEN that on the 16th day of January, 1980, at a regular meeting of the City Commission of the City o~ Bozeman, Montana, said Commission duly and regularly .', passed and adopted Commission Resol.ution No. 2159 entitled: A RESOLUTION OF THE CITY OF BOZEMAN, MONTANA DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN AND THE INHABITANTS THEREOF, AND OF THE INHABITANTS OF A TRACT OF LAND CONTIGUOUS TO THE SAID CITY OF BOZEMAN, AND HEREIN MORE PARTICULARLY DESCRIBED AND TO BE I KNOWN AS THE TOWN PUMP ANNEXATION TO EXTEND THE BOUNDARIES OF THE SAID CITY OF BOZEMAN SO AS TO INCLUDE THE SAID CONTINGUOUS TRACTS WITHIN THE CORPORATE LIMITS THEREOF. NOTICE IS HEREBY FURTHER GIVEN, that Wednesday, the 20th day of February, 1980, at 1:15 o'clock p.m. at the Commission Room of the City Hall. Bozeman, Montana, is designated as the time and place for hearing objections to the action proposed to extend the boundaries of the said City of Bozeman so as to include the said contiguous tracts within the corporate limits thereof. Expression of approval or disapproval by resident freeholders of the territories to be embraced must be made in writing and filed with the Clerk of the City Commission of the City of Bozeman not later than twenty (20) days after the date of the first publication of this notice.
