HomeMy WebLinkAboutResolution 2158 Intent to create SID 620 for paving-storm drainage in Blackmore Place: 1-16-80 .. ~~-" -. ---~-- '-~----'-". -.,....,... .-.--------~ ~. -'-h'" -~___~___,._,~,-_.__-.__.____~~,._'__- ---....,---,-..--~.-.-..- ,-...-----.-. 4,58 COMMISSION RESOLUTION NO. 2158 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOlEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 620 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF AN ASPHALTIC-CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, STORM DRAIN INLETS, AND NECESSARY APPUR- I TENANCES THERETO ON BLACKMORE PLACE, IN THE CITY OF BOZEMAN, MONTANA. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman a petition in due form of certain owners of properties situated in the City of Bozeman asking that a Special Improvement District be created for the purpose of construction and installation of an asphaltic-concrete pavement project to include integral curbs and gutters, storm drain inlets, and other work incidental thereto, and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman, held on the 31st day of October, 1979, the aforesaid petition was respectively considered and granted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention It is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 620 for the purpose of construction and installation of pavement on Blackmore Place, in the City of Bozeman, Montana. I Section 2 ~ The boundaries on said Special Improvement District No. 620 are described as fo 11 ows : A tract of land located in the Southwest 1/4, Section I, Township 2 South, Range 5 East, Principal Meridian Montana, Gallatin County, Montana, said tract being Lots 2 and 3 of Tract 15 of the Homesites Subdivision to Bozeman, and being more particularly described as follows: Beginning at the Northeast corner of the Maple Terrace Subdivision; thence South 890 56'33" West, along the North boundary of the Maple Terrace Subdivision, a distance of 131.45 feet to the true point of beginning; thence North 89057'57" West, along said North boundary, a distance of 159.98 feet, to the centerline of Blackmore Place; thence South 890 59'26" West, along said North bound- ary, a distance of 155.33 feet; thence North 00015'13" West, a dis- tance of 119.55 feet; thence North 89055'50" East along the southerly boundary of Tract 17, a distance of 300.31 feet; thence South 00014'00" West, a distance of 119.97 feet, to the point of true beginning and containing 0.87 acres. Section 3 ~ C~.a!ac.te.r oi)mpt:ovements The character of the improvements to be made is the construction and installation of an asphaltic-concrete type pavement project with integral concrete curbs and gutters, - storm drain inlets~ and necessary appurtenances thereto on Blackmore Place. Section 5 Method of Assessment .... I ... _ The cost of said improvement is to be assessed against the entire district. Each lot or parcel of land within the district will be assessed for that part of the whole cost which its area bears to the areas of the entire district, exclusive of streets, alleys and public places. The total actual assessable area within the entire district is 28,509.45 square feet, and is the area on which all protests will be received, con- sidered and determined. It is also the figure on which all assessments will be calculated. Section 6 P.ayments The payments for the improvements shall be made in twenty (20) annual installments over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. lt is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement I District No. 620 as authorized by law. Such bonds will be in denomination of $100.00 each and fractions or multiples of $100.00 where necessary to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 620 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City singly or in multiples and in the order of their registration, whenever funds are available for the purpose on said Special Improvement District No. 620. Said bonds shall draw a simple interest from the date of their registration until called for payment, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11-2232 and Section 11-2271, Revised Codes of Montana, 1947, and all other applicable provisions of Title II, of the Revised Codes of Montana, 1947, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section 7 Protests and Notices . The regular session of the City Commission of the City of Bozeman to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 6th day I of February, 1980, at the hour of 1:15 o'clock p.m. of said day, is the time and place when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 620 the improvements proposed to be made pursuant thereto, and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. NOTICE IS HEREBY FURTHER GIVEN, that Wednesday, the 6th day of February, 1980, I at 1:15 o'clock p.m. at the Commission Room of the City Hall, Bozeman, Montana is designated as the time and place for hearing objections to the action proposed to create a special improvement district for the purpose of construction and installation of any asphaltic-concrete type pavement, integral concrete curbs and gutters, storm drain inlets, and necessary appurtenances thereto on Blackmore Place, in the City of Bozeman, Montana. Expression of approval or disapproval by resident freeholders of the territories proposed to be embraced must be made in writing and filed with the Clerk of the City Commission of the City of Bozeman, not later than twenty (20) days after the date of the first publication of this notice.
