COMMISSION RESOLUTION NO. 2166
A RESOLUTION SPECIFYING WATER RATE AND WATER REGULATION MODIFICA-
TIONS TO BECOME EFFECTIVE AT A SPECIFIC DATE UPON DEPARTMENT OF
PUBLIC SERVICE REGULATION OF THE STATE OF MONTANA~ PUBLIC SERVICE
COMMISSION, APPROVAL; AND DIRECTING APPLICATION TO THE PUBLIC
SERVICE COMMISSION FOR APPROVAL THEREOF.
WHEREAS, a water rate study prepared for and accepted by the City of Bozeman,

Montana, projects a need for extension, repair and improvement of facilities for the
provi s ion of water to users of the util ity water supply of the City of Bozeman.
Montana; and
WHEREAS, the rates and charges in effect at the present time are not adequate
to provide revenues with which to finance existing Bond obligations. or. to accomplish
the extension. expansion, repair and improvement of utility facilities. and to defray
increased costs of operation of said facilities; and
WHEREAS, certain statutory requirements, including federal statutes, require
construction of additional water utility facilities and the continued maintenance thereof,
thereby increasing costs of operations of said facilities; and
WHEREAS, it has become necessary to update and revise existing water utility
regulation in order to comply with present day water utility operation and to establish
rules and regulations for the protection of the water utility customers and the utility;
and,
WHEREAS. the necessity of meeting present day bond obligations and the provisions
of said extension. expansion, repair and improvement of said facilities is essential

to the immediate preservation of the utility water system and the public health; and
provisions therefore together with revising and amending existing utility Rules and
Regulations cannot be undertaken until the City has in effect rates. charges and regula-
tions adequate to assure the funding thereof; that such rates, charges and regulations,
must before taking effect, be approved by the Department of Public Service Regulation
of the State of Montana. Public Service Commission, under the provisions of MCA 69-3-302,
as amended; that budgetary requirements respecting commencement of the extension. expansion,
repair and improvement of said facilities contemplate such rates, charges and regulations
becoming effective by May 1, 1980. to enable the City to proceed as expeditiously as possible
to accomplish the objectives hereinabove recited.
NOW. THEREFORE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN.
MONTANA:
1. That. subject to the provision of Paragraph 3 of this resolution. the
schedule of rates, charges and regulations proposed to be filed with the Department
of Public Service Regulation of the State of Montana, Public Service Commission and

sufficient to generate increased revenues annually of Seven Hundred Ninety-Four Thousand.
Four Hundred and Fifty-Three ~794.453.) Dollars, shall be adopted and published as
the rates, charges and regulations governing operations of the City of Bozeman. Montana,
water utility, effective May 1. 1980, unless sooner changed. modified. cancelled. or continued.
2. That the Mayor of the City of Bozeman, Montana. and the Clerk of the City
Commission are authorized and directed to submit the petition of the City of Bozeman. Montana.
to the Department of Public Service Regulation of the State of Montana. Public Service

Commission, for approval of the rates, charges and regulations set forth in Paragraph 1 of
this resolution. The City Manager and all other officials, employees and representatives
of the City of Bozeman, Montana, are authorized and directed to do all things necessary
or convenient to accomplish the objectives of this resolution.
I 3. That the rates, charges and regulation set forth in Paragraph 1 hereof shall
not become effective in any event until the Department of Public Service Regulation
of the State of Montana, Public Service Commission has approved the same as provided by
law.
PASSED AND ADOPTED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, this
27th day of February, 1980, as a resolution eff 'tlve upon passage hereof.
