Preliminary Plat Application #P-12009

RECOMMENDATION: That the City Commission approves Minor Subdivision Preliminary Plat
Application #P-12009 with the conditions of approval and code provisions as recommended by the
Planning Director in the staff report.
RECOMMENDED MOTION FOR PRELIMINARY PLAT APPLICATION: “Having reviewed the application materials, considered public comment, and the staff analysis, I hereby adopt the findings presented in the staff report for #P-12009 and move to approve the preliminary plat application for the Lot 7A, Block 10, Meadow Creek Subdivision, Phase 1 Minor Subdivision as
requested in Planning Application #P-12009 authorizing to subdivide 1.004 acres and create four
residential lots, subject to the conditions listed in the staff report.”
BACKGROUND: The property owner/applicant, Bozeman 1, LLC, represented by Morrison Maierle,
Inc., has submitted a Minor Subdivision Preliminary Plat application to subdivide 1.004 acres and create
four residential lots for R-3 (Medium Density District) development. The site is currently located within
the corporate limits of the City of Bozeman and is partially developed as a part of Meadow Creek Subdivision, Phase 1.
The applicant is requesting to subdivide Lot 7A in an effort to arrange the residential lots as originally
subdivided with the final plat in December of 2006. In February 2008 the applicant submitted an
amended plat to aggregate Lot 7, 8, 9 and 10 of Block 10 for the purposes of developing the site as a
multi-family parcel. Finding that the current economic environment for multi-family lots is limited, the applicant wishes to subdivide a second time the 1.004 acre lot as originally intended for single family
residential use.
Pursuant to Section 38.03.040.A.4, BMC the Planning Director shall review all minor subdivisions,
provide findings in a staff report and make a written recommendation for consideration by the City
Commission. No variances to the Uniform Development Code (UDC) have been requested with this
Commission Memorandum

preliminary plat application and no specific variances have been identified during the review of the
preliminary plat application.
The DRC provided a recommendation of conditional approval on August 29, 2012. The Planning Director reviewed the minor subdivision application, together with the supplementary plans and information, and recommended to the City Commission on September 13, 2012 conditional approval
with the conditions listed in the staff report. Staff’s full analysis of the review criteria for this minor
subdivision is included in the attached staff report.
UNRESOLVED ISSUES: None determined at this time.
ALTERNATIVES:
1) Approval of the Preliminary Plat Application as submitted with no conditions. 2) Approval of the Preliminary Plat Application with conditions of approval as recommended by the Planning Director.
3) Denial of the application.
4) As determined by the Commission.
FISCAL EFFECTS: The standard application fee was received for the Minor Subdivision Preliminary Plat application and was added to the Department of Planning’s application fee revenue.
