HomeMy WebLinkAboutResolution 2195 Creating SID 605, paving and storm drain in Graf's First: 5-28-80 50 , - " COMMISSION RESOLUTION NO. 2195 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 605 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF AN ASPHALTIC-CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, STORM DRAINS AND NECESSARY APPURTENANCES THERETO, ON KENYON, BAXTER, CHAMBERS AND O'CONNELL DRIVES, ALL IN GRAF'S FIRST ADDITION TO THE CITY OF BOZEMAN. I WHEREAS, at a regular session of the City Commission of the City of Bozeman, held on the 28th day of May, 1980, the said City Commission duly passed Commission Resolution No. 2186, declaring it to be the intention of the said City Commission to create a special improve- ment district to be known and designated as Special Improvement District No. 605 to the said City, for the purpose of construction and installation of an asphaltic-concrete type pavement, integral concrete curbs and gutters, storm drain inlets and necessary appurtenances thereto on Kenyon, Baxter, Chambers and O'Connell Drives, all in Grafls First Addition, in the City of Bozeman, Montana, and said Commission Resolution No. 2186 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement District No. 605, that the estimated cost of said improvements and method of assessing the same against the property of said district; and, WHEREAS, notice of the passage of said Commission Resolution No. 2186 was'du'ly published ~ - as required by law, in the Bozeman Daily Chronicle, a daily newspaper of ~~nera1::::-Ci~ulation - ,~-- -=-=- - printed and published in the City of Bozeman, Montana, and by sending a C6Qi:~~r~~u.c!r~not;ce, by U.S. Mail to each person, firm or corporation having property within the'propOsed district at her or its last known address, upon the same date that such notice was first published I as aforesaid, and due proof having been made of the publication and service of said notices; and, WHEREAS, within the time provided by law and said published and served notice, there was not sufficient protests against the creation of said proposed Special Improvement District No. 605, and the City Commission was in regular session on the 28th day of ~1ay, 1980, at 1:15 o'clock p.m., of said day, at the Commission Chamber in the City Hall Building in the said City of Bozeman, Montana, the same being the time and place designated in said notice for passing upon all protests, if any, against the proposed work or against the creation or extent of said district, or both or either; and it further appearing that all of the proceedings for the creation of said district have been lawful and regular. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 That the said Special Improvement District No. 605 of the City of Bozeman, be and the same is hereby created for the purpose of making improvements as in said Commission Resolution No. 2186 and hereinafter described. I Section 2 That said special improvements be, and the same are, hereby ordered to be made in said Special Improvement District No. 605 as follows: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 605 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF AN ASPHALTIC-CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND GUTTERS, STORM DRAINS AND NECESSARY APPURTENANCES THERETO ON KENYON, BAXTER, CHAMBERS AND O'CONNELL DRIVES, ALL IN GRAF'S FIRST ADDITION TO THE CITY OF BOZEMAN. COMMISSION RESOLUTION NO. 2195 ..__ ."'. . _... ........_ .n. ,._ ,.___.,. 51 Section 3 That the entire cost and expense of maintaining the improvements herein referred to in said Special Improvement District No. 605, shall be assessed against the entire district each lot, block, tract or parcel of land within the district will be assessed for that por- tion of the whole cost which its area bears to the area of the entire district exclusive of I streets, avenues, and public places. The total number of feet of assessable footage within the district is 582,645.64 square feet and is the area on which all assessments will be calculated. Section 4 That any and all construction districts within the same boundaries and serving the same area are hereby declared abandoned and terminated.
