Wordal, Staff Attorney Kvla Murray, StaffAttorne-v Ryan McCarty, Staff Attorney Bozeman City Attorney Codification Order 2012 -02 Anna Saverud, StaffAttornev August 28, 2012 Pursuant to the authority of the Bozeman City Attorney under Sec. 1.01 .180 of the Bozeman Municipal Code (BMC)1, I hereby order a correction to a clerical error in Section 1 of Ordinance 1818 (effective date of January 17, 2012). The following correction as shown below shall be made to See. 38.01.070, BMC, and shall be incorporated into the Bozeman Municipal Code at the time Ordinance 1818 becomes effective on January 17, 2012: "See. 38.01.070. - Conditions of approval. However, should the owner seek material modifications (e.g., changes to the intent, nature, or scope of a subdivision or development, or necessary improvements) to a previously approved subdivision, development or condition of approval, the entire application shall be considered to be again opened for review and additional conditions maybe applied. Modifications of conditions of approval shall be reviewed through the same process as the original application. Final action includes the resolution of any appeals. The provisions of section 38.03.040.A4.5.hg may also apply to revisions of conditions for preliminary plats." The remainder of 38.01.070, BMC, as adopted by Ordinance 1818 shall not be altered by this order. This order shall be placed on the Municipal Code Corporation's website serving the Bozeman Municipal Code under new legislation until the next supplement incorporating Ordinance 1818. In addition, the City Clerk shall keep this order in the numerically ordered file named "City Attorney Codification Orders" and shall also attach a copy of this order to the signed original of Ordinance 1818.
