RESOLUTION NO. 2180
A RESOLUTION OF THE CITY
COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AUTHORIZING
THE PURCHASE FROM BURLINGTON NORTHERN
RAILROAD A PERMANENT
EASEMENT AND RIGHT OF WAY LOCATED SOUTH
OF GRIFFIN DRIVE TO PROVIDE
ACCESS TO KACK INDUSTRIAL PROPERTIES.
WHEREAS, The City of
Bozeman, Montana, is in need of an access and right

of way south of Griffin Drive entering Kack Industrial Properties, and
WHEREAS, the Burlington
Northern Railroad has agreed to sell to the
City of Bozeman a sixty (60) foot road right of way for access to said property, and
WHEREAS, funds have been
made available to the City of Bozeman for the
purchase of this permanent easement.
NOW, THEREFORE, BE IT
RESOLVED, by the City Commission of the City of
Bozeman, Montana, to-wit:

That the City of Bozeman
purchase from Burlington Northern Railroad a sixty
(60) foot easement and right of way south of Griffin Drive for access to Kack Industrial

That prior to the purchase,
the City of Bozeman be provided an appropriat~~.~~/-': '. "

title insurance policy insuring the Burlington Northern Railroad is the owner of said
right of way and that after recording said permanent easement, the City is the owner
of a valid first priority and unencumbered permanent easement.
