AGREEMENT MADE this Z 4FAay of September, 1987 by and
between the City of Bozeman, a municipal corporation and
political subdivision of the State of Montana, hereinafter
referred to as "the City", and Montana Power Company, a Montana
corporation, hereinafter referred to as "the Utility."
Recitals
A. WHEREAS the City of Bozeman has caused to be installed and
continues to maintain and operate through special improvement
lighting districts, No. 361 and No. 362, a system of street
lights on Main Street between Broadway and Eighth Avenues.
B. WHEREAS the Utility is willing to purchase the city's street
lighting fixtures and assume the cost and responsibilities of
maintaining the street lighting system, and will replace said

existing street lighting system with a new high-pressure sodium
light system which will provide brighter and more cost-efficient
street lights; and
C. WHEREAS the City is desirous of selling the existing street
lighting fixtures to acquire the benefits of brighter and more
cost-efficient lights and of relieving the City of the burden and
costs of maintaining the existing lighting system;
D. WHEREAS the City presently uses and will continue to use the
street light poles for municipal purposes such as, but not limited
to, attaching traffic control signals and signs.
NOW, THEREFORE, IN CONSIDERATION OF THE FOREGOING recitals,
the terms of this agreement, and the purchase price of FIVE
THOUSAND DOLLARS ($5,000.00) to paid by the Utility to the City
for the existing street light fixtures, the Utility and the City
agree as follows:
1. That the Utility shall pay to the City of Bozeman the sum of
FIVE THOUSAND DOLLARS ($5,000.00) and shall receive in exchange
all electric light poles and fixtures located on Main Street
between Wallace Avenue and Eighth Avenue consisting of approxi-
mately fifty--two (52) lights, Said lights being installed and
maintained through Special Improvement Lighting Districts Nos,
363 and 362 of the City of Bozeman.
2. That the Utility shall assume the responsibility and costs of
installing and maintaining said street lighting fixtures, and
further agrees to assume the costs of installing and maintaining
a new street lighting system using brighter and more cost-
efficient high pressure sodium lights,
3. That the City shall have the right to use the street light
poles for municipal purposes such as, but not limited to, traffic
control signals and signs with mutual agreement by the Titility.
