RESOLUTION NO. 2209
A RESOLUTION OF THE CITY OF BOZEMAN PROVIDING FOR AN
AMENDMENT TO THE 1972 BOZEMAN AREA MASTER PLAN.
WHEREAS, the Bozeman
Area Master Plan was adopted by the Bozeman City Commission in 1972
as a desirable, logical,
and timely plan for the future development of the City of Bozeman
and its planning environs,
and;

WHEREAS, the Bozeman
Area Master Plan has been developed in accordance with the desires
and needs of the residents
of Bozeman and its related planning areas as expressed through
citizen study groups
and advisory committees, special surveys, and public hearings, and;
WHEREAS, the Bozeman
City-County Planning Board acting as an advisory body to the City
Commission in matters
related to planning and land use, has prepared and recommended for
adoption, the Bozeman
Area Master Plan, and;
WHEREAS, the Bozeman
Area Master Plan is recognized as the official development policy
guide to ensure rational
and orderly development of the City of Bozeman and its planning
environs, and;
WHEREAS, future growth
and development in Bozeman and its related planning environs may
necessitate amendments
to the Master Plan and those amendments should be provided for only
after the City-County
Planning Board has conducted a thorough review and analysis of the pro-
posed amendments, and;
WHEREAS, the City-County
Planning Board has held a public meeting to hear and receive
public comment on this
proposed amendment to the Master Plan prior to making recommendations

to the City Commission
for official adoption, and;
WHEREAS, the City Commission
shall consider at a public meeting, recommendations from
the City-County Planning
Board pertaining to proposed amendments to the Bozeman Area Master
Plan, but shall not be
bound, in any way, to such recommendations. and;
WHEREAS, the City Commission
may adopt. through official resolution, the proposed amend-
ment to the Bozeman Area
Master Plan if it deems necessary after receiving the recommenda-
tions from the Bozeman
City-County Planning Board.
NOW, THEREFORE, BE IT
ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
The 1972 Bozeman Area
Master Plan is hereby amended to reflect the following:
1.
Deletion of the "Agricultural" land use designation, within the SW 1/4 of the NE 1/4
of Section 36, Township
1 South, Range 5 East. M.P.M.
2.
Establishment of a "Light-Industrial" designation, totaling approximately ten (10)
acres, in the SW 1/4
of the NE 1/4 of Section 36, (See Exhibit "A").
3.
All future Commercial Light Manufacturing zoning districts shall contain an attached
"T" (Transitional) district
classification. The "T" classification is intended to insure
that
all development will
foster a high quality of site and building design, maximum neighborhood

compatibility, and an
aesthetically-pleasing entryway into the City of Bozeman.
The area is
highly visible as a major
entryway to Bozeman and therefore, all future development shall be
guided by environmental
and architectural criteria that promote aesthetically-pleasing projects.
4.
The property owner shall supply a formal written waiver of protest of annexation to
the City of Bozeman for
this property as herein described prior to the approval of any zone map

changes by the City of Bozeman.
This waiver of protest to annexation to the City of Bozeman
shall be certified by the City of Bozeman Attorney as being in proper legal format and shall
be formally accepted by the City Commission of the City of Bozeman before any zone map changes
become effective.

This resolution shall
become effective thirty days after its passage and adoption by the
City Commission of the City of Bozeman.
