MINUTES OF THE MEETING OF THE CITY COMMISSION BOZEMAN, MONTANA
July 16, 2012

The Commission met in the City Commission Room, City Hall at 121 North Rouse on Monday,
July 16, 2012. Present were Mayor Sean Becker, Deputy Mayor Jeff Krauss, Commissioner
Chris Mehl, Commissioner Cyndy Andrus, Commissioner Carson Taylor, City Manager Chris
Kukulski, Assistant City Manager Chuck Winn, City Finance Director Anna Rosenberry, City
Attorney Greg Sullivan, and City Clerk Stacy Ulmen.

0:10:18 A. Call to Order – 6 p.m. – Commission Room, City Hall, 121 North Rouse
Mayor Becker called the meeting to order at 6 p.m.

0:11:09 C. Changes to the Agenda
Mayor Becker asked City Manager Chris Kukulski if there were any changes to the agenda. Mr.
Kukulski stated that there were no changes.
0:11:14 D. Minutes – May 7, 2012 Executive Session, May 21, 2012 and June 4, 2012
0:11:17 Motion and Vote to approve the minutes of the May 7 Executive Session, May 21
and June 4, 2012 as submitted.
It was moved by Deputy Mayor Krauss, seconded by Cr. Andrus to approve the minutes of
the May 7 Executive Session, and regular meetings May 21 and June 4, 2012 as submitted.
Those voting Aye being Deputy Mayor Krauss, Crs. Andrus, Mehl, Taylor and Mayor
Becker.
Those voting No being none.
The motion passed 5-0.

The motion passed 5-0.

Mayor Becker opened public comment.
There were 25 public comments in support of adding language to the upcoming election ballot
asking for support of a parks and trails bond.

Cr. Mehl began the presentation for Resolution No. 4386, authorizing the placement of a Park
and Recreation Bond on the November 2012 Election Ballot. Cr. Mehl highlighted discussion
points for the bond.
1:05:04 Commission Questions and Discussion
The Commission discussed management for setting this up, capital improvements and
maintenance, maintenance in regards to expenditures, levying year by year and types of bonds.
1:29:02 Greg Sullivan, City Attorney
Mr. Sullivan spoke regarding the ballot language, the recitals in the resolution and the use of
funds for transaction costs, debt limits, purpose, and funds for planning work.

The Commission and staff spoke regarding the budgeted expenses, maintenance amounts and
long term maintenance plans.

Mayor Becker opened public comment.
6 people spoke regarding the benefits of the bond, support of the bond, fuel costs and
partnerships.
1 spoke regarding concern of tax increases.

2:01:47 Motion to approve Resolution 4386 placing on the November 6, 2012 election as a
special election of the City the question of selling $15,000,000 in general obligation bonds
for purposes identified in the resolution and incorporate the changes to the ballot language
suggested in the July 16th memorandum from the City Attorney.
It was moved by Cr. Mehl, seconded by Cr. Taylor to approve Resolution 4386 placing on
the November 6, 2012 election as a special election of the City the question of selling
$15,000,000 in general obligation bonds for purposes identified in the resolution and
incorporate the changes to the ballot language suggested in the July 16th memorandum
from the City Attorney.
2:02:49 Commission discussion on the motion
The Commission discussed quality of life, responsibility for the next generation, return on
investment, continuation of parks as the city expands, an opportunity to host tournaments,
economic development and efficiency, community support along with wants and needs. Deputy
Mayor Krauss spoke regarding his concern of methodology of the figure of $15 million for the
bond, clarifications on the original ballot language and his concern of maintenance repair
management planning not being clarified enough.

2:35:22 Motion and Vote to confirm the Mayoral appointment of Paul Neubauer to the City
Planning Board.
It was moved by Cr. Taylor, seconded by Cr. Mehl to confirm the Mayoral appointment of
Paul Neubauer to the City Planning Board.
Those voting Aye being Crs. Taylor, Mehl, Deputy Mayor Krauss, Cr. Andrus and Mayor
Becker.
Those voting No being none.
The motion passed 5-0.
2:35:39 3. (Re)Appointments to the Design Review Board (Kissel)
2:35:51 Motion and Vote to reappoint Walter Banziger as an architect representative and
Page Huyette as a landscape architect representative to the Design Review Board.
It was moved by Deputy Mayor Krauss, seconded by Cr. Anrdus to reappoint Walter
Banziger as an architect representative and Page Huyette as a landscape architect
representative to the Design Review Board.
Those voting Aye being Deputy Mayor Krauss, Crs. Andrus, Mehl, Taylor and Mayor
Becker.
Those voting No being none.
The motion passed 5-0.
2:36:13 Motion and Vote to appoint Lori Garden as a non-professional representative to
the Design Review Board.
It was moved by Deputy Mayor Krauss, seconded by Cr. Andrus to appoint Lori Garden
as a non-professional representative to the Design Review Board.

2:36:36 Motion and Vote to appoint Lee Poole as an at-large representative with a term
expiring December 31, 2013 and Liz O'Donnell as a student representative with a term
expiring October 2, 2013.
It was moved by Cr. Taylor, seconded by Cr. Mehl to appoint Lee Poole as an at-large
representative with a term expiring December 31, 2013 and Liz O'Donnell as a student
representative with a term expiring October 2, 2013.
Those voting Aye being Crs. Taylor, Mehl, Deputy Mayor Krauss, Cr. Andrus and Mayor
Becker.
Those voting No being none.
The motion passed 5-0.
2:37:13 5. (Re)Appointments to the Tree Advisory Board (Kissel) Continued from July
9th
2:37:16 Motion and Vote to re-appoint Bill Hoch and appoint Scott Makoutz to the Tree
Advisory Board.
It was moved by Cr. Andrus, seconded by Cr. Mehl to re-appoint Bill Hoch and appoint
Scott Makoutz to the Tree Advisory Board.
Those voting Aye being Crs. Andrus, Mehl, Taylor, Deputy Mayor Krauss and Mayor
Becker.
Those voting No being none.
The motion passed 5-0.

Economic Development Director Brit Fontenot gave an update on the coal train issue from last
week. The Commission discussed the staff involved with this issue.
