COMMISSION RESOLUTION
NO. 2205
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN
AS SPECIAL IMPROVEMENT DISTRICT NO. 623 FOR THE PURPOSE OF
CONSTRUCTION AND INSTALLATION OF SANITARY SEWER AND APPURTEN-
ANCES TO SERVE THE ADJOINING PROPERTIES AND MORE SPECIFICALLY
DESCRIBED AS FOLLOWS:

AN EIGHT (8) INCH SANITARY SEWER AND APPURTENANCES ON EAST
GRANITE, PONDERA, WEST GRANITE, GOLDEN VALLEY, TETON AND
FLATHEAD AVENUES AND PORTIONS OF FALLON, RAVALLI, WEST BAB-
COCK, BROADWATER, CASCADE STREETS, TOOLE STREET, AND A POR-
TION OF DURSTON ROAD AND A TWELVE (12) INCH AND FOURTEEN (14)
INCH SANITARY SEWER ON YELLOWSTONE AVENUE ALL IN THE VALLEY
UNIT SUBDIVISION TO THE CITY OF BOZEMAN.
THE CONSTRUCTION AND INSTALLATION OF THE SANITARY SEt~ER TO
INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL,
SANITARY SEWER LINES, MANHOLES, SERVICE LINE STUBS, AriD OTHER
NECESSARY APPURTENANCES.
WHEREAS, at a regular session of the City Commission of the City of Bozeman, held on
the 11th day of June, 1980, the said City Commission dUly passed Commission Resolution No.
2200, declaring it to be the intention of the said City Commission to create a special
improvement district to be known and designated as Special Improvement District No. 623 to
the said City, for the purpose of construction and installation of sanitary sewer and appur-
tenances to serve the Valley Unit Subdivision and other service areas in the City of Bozeman,
and said Commission Resolution No. 2200 is hereby referred to and made a part hereof for fur-
ther particulars in respect to the boundaries of said Special Improvement District No. 623,
and the estimated cost of said improvements and method of assessing the same against the
property of said district; and

WHEREAS, notice of the passage of said Commission Resolution No. 2200 was duly waived
by the receipt of a Waiver of Hearing of Protests to Special Improvement District No. 623,
submitted by Mr. & Mrs. Virgil Jahnke who are the only owners of real property within the
district which will be assessed.
The Commission accepted and approved said Waiver of Hearing
of Protests to Special Improvement District No. 623.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
That the said Special Improvement District No. 623 of the City of Bozeman be, and the
same is hereby created for the purpose of making improvements as in said Commission Resolution
No. 2200 and hereinafter described.
Section 2
That said special improvements be, and the same are, hereby ordered to be made in said
Special Improvement District No. 623 as follows:

THE CONSTRUCTION AND
INSTALLATION OF THE SANITARY SEWER TO

Section
3
That the entire cost and expense of maintaining the improvements herein referred to in

said Special Improvement District No. 623, shall be assessed against the entire district.
Each lot, block, tract or parcel of land within the district
will be assessed for that
portion of the whole cost which its area bears to the area
of the entire district exclusive
of streets, avenues, and public places.
The total number of feet of assessable footage
within the district is 4,815,768.05 square feet and is the area on which all assessments
will be calculated.
Section
4
That any and all construction districts within the same boundaries and serving the
same area are hereby declared abandoned and terminated.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, at a regular session
held thereof on the 18th day of June, 1980.

Daily Chronicle, a newspaper of general circulation printed and published in said City,
in the issue dated the 26th day of June, 1980, and due proof of such publication is on file
in my office.
