MONTANA. DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE AN EXTENDED SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 622 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLA- TION OF TRUNK WATER SUPPLY MAINS AND APPURTENANCES TO THE VALLEY UNIT SUBDIVISION AND OTHER SERVICE AREAS IN THE CITY OF BOZEMAN AND MORE I SPECIFICALLY DESCRIBED AS FOLLOWS: A 12-INCH WATER MAIN EXTENSION AND APPURTENANCES FROM WEST COLLEGE ALONG THE SOUTH RIGHT-OF-WAY OF U.S. 191 TO FOWLER LANE A 10-INCH WATER MAIN EXTENSION ALONG WEST MAIN TO FOWLER AVENUE. THE CONSTRUCTION AND INSTALLATION OF THE TRUNK WATER MAINS IS TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL. BEDDING MATERIAL. DUCTILE IRON WATER MAINS. VALVES AND FITTINGS. HIGHWAY JACK AND BORE. AND OTHER NECESSARY APPURTENANCES THERETO. WHEREAS. a condition of preliminary plat approval Phases I, 2, 3 and 4 of Valley Unit Subdivision, dated January 17, 1980, item 11. requires that utilities be extended and assessed against said property in district boundaries. WHEREAS. there has been filed with the Clerk of the City Commission of the City of Bozeman. Montana, a petition in due form of a certain owner of properties situated within the boundaries of Special Improvement District No. 622 as hereinafter more specifically described. the Valley Unit developer is asking that a special improvement district be created for the purpose of constructing and installing said trunk water mains to provide water service to Valley Unit Subdivision and other future connections within the trunk service area; WHEREAS. that at a regular meeting of the City Commission of the City of Bozeman held on the 14th day of May, 1980. the aforesaid petition was respectively considered and granted. I NOW THEREFORE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create an extended special improvement district to be known and designated as Special Improvement District No. 622 of the City of Bozeman for the purpose of constructing and installing trunk water mains. said project to include all appurtenant work for the construction and installation of trunk water mains to provide service to Valley Unit Subdivision within the district boundaries. Section 2 Boundarles The boundaries of said Special Improvement District No. 622 are described as follows: Description Beginning at the East 1/4 corner of Section 10. Township 6 South. Range 5 East. Section 3 Character of Improvements The character of the improvements to be made is the installation and construction of a 12-inch and 10-inch water main trunks including trench excavation and backfill, bedding material, ductile iron water mains, valves and fitting, highway jack and bore, and other necessary appurtenances thereto. Section 4 Estimate of Cost The total estimated cost of the improvements within the district including engineering, legal and contingency is $315,000.00. Section 5 Method of Assessment The cost of such improvements is to be assessed against Block 1, lots 3 - 6; Block 2, lots 18 - 26; Block 5, lots 1 - 13 and 32 - 42; Block 6; Block 7, lots 1 - 6; Block 8, lots I 11 - 17; Block 9; Block 10; Block 11, lots 1 - 6; Block 13, lots 5 and 6; Block 14, lots 1 - 3 and 8 - 10; Block 19, lots 8 - 14; Block 20; Block 21; Block 22, lots 1 - 7; Block 28, lots 17 - 32; Block 29; Block 30; Block 31, lots 1 - 8, Block 37; Block 38; and Block 39, lots 1 - 8; plus the unplatted master planned area approved by the City of Bozeman on January 17, 1980 and containing Block 1, lots 1 and 12; Block 2, lots 1 - 17 and 27 - 47; Block 3; Block 4; Block 5, lots 14 - 31, Block 7, lots 7 - 12; Block 8, lots 1 - 10 and a 5.2550 acre school site; Block 11, lots 7 - 12; Block 12; Block 13, lots 1 - 4 and 7 - 10; Block 14, lots 4 - 7, all in the Valley Unit Subdivision to the City of Bozeman. Each lot and parcel of land within those Blocks will be assessed for that part of the entire district, exclusive of that part of the entire district, exclusive of streets, alleys and pUblic places (not includ- ing school sites). The total actual assessable area within the entire district is 7,270,877.84 S.F. and is the area on which all protests will be received, considered and determined. It is also the area on which all assessments will be figured. There are raw developable areas (including parks, streets, and open space) of about 119.2 acres east of Fowler Lane and south of Babcock Street, about 122.4 acres east of Fowler Lane I and north of Babcock Street and about 73.5 acres of the Valley Unit Subdivision as shown on attached Exhibit A. If annexed to the City and connected to this trunk district, the land- owners shall pay a prorata share of project costs. Said share shall be reimbursed to the S.I.D. 622 fund. COMMISSION RESOLUTION NO. 2199 -,--~~, . .. --. ._,. ...- .. ....- --. ,..-- ..-.. ---."...........- ....."......--- -.-- --..-----. .-...... ...__..___..m _.____ ---...,.-...- ..". - -- -. ..... 59 Section 6 Payments The payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It I is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 622 as authorized by law. Such bonds will be in denominations of Five Thousand Dollars ($5,000.00) each, and fractions or multiples of $5,000.00 where necessary, to be issued and chargeable against a fund to be known and designated as extended Special Improve- ment District No. 622 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose in said Special Improvement District No. 622. Said bonds shall draw a simple interest from the date of their registration until called for payment, which interest shall be chargeable as part of the cost of construction and installa- tion of said improvements. The bonds will be issued and sold in accordance with the appropriate Montana Codes, relating to special improvement districts in cities, and towns, and any amend- ments thereof or thereto. Section 7 Waiver of Protest I That at the regular session of the City Commission of the City of Bozeman on this day, the Commission received from Mr. and Mrs. Virgil Jahnke a waiver of hearing of protests to Special Improvement District No. 622. The Jahnkes are the only owners of real property in the district which will be assessed. That the Commission accepts and approves said Waiver, and waives public hearing to the creation of Special Improvement District No. 622.
