HomeMy WebLinkAboutResolution No. 4392, hazardous Mitigation Plan Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Brian Heaston, Project Engineer Debbie Arkell, Director of Public Services SUBJECT: Approve Commission Resolution No. 4392 adopting Hazard Mitigation Plan dated July 2012 MEETING DATE: August 13, 2012 AGENDA ITEM TYPE: Consent RECOMMENDATION: Approve Commission Resolution No. 4392 adopting Hazard Mitigation Plan dated July 2012. BACKGROUND: Gallatin County, and all incorporated cities, are required to have a Federal Emergency Management Agency (FEMA) approved local mitigation plan in order to apply for and/or receive grant funds under various federal grant programs (44 CFR §201.6). Local mitigation plans must be revised and updated every five years and re-approved by FEMA. Gallatin County’s Hazard Mitigation Plan, adopted by the City through Commission Resolution 3919.5 on May 15, 2006, expired on December 16, 2011. The plan has been updated per FEMA requirements. Gallatin County Emergency Management received notification from FEMA on July 11, 2012 that the updated plan has been granted “Approvable Pending Adoption” status. The updated Hazard Mitigation Plan is provided as ‘Exhibit A’ to Commission Resolution No. 4392 attached to this memorandum. UNRESOLVED ISSUES: The Hazard Mitigation Plan will be considered finally approved by FEMA once all participating jurisdictions formally adopt the plan by resolution. The participating jurisdictions are: Gallatin County, City of Bozeman, City of Belgrade, City of Three Forks, and Town of Manhattan. ALTERNATIVES: As suggested by the City Commission. FISCAL EFFECTS: By adopting this resolution, and under the presumption that other participating jurisdictions do as well and the plan is formally approved by FEMA, the City of Bozeman may apply for and/or receive grant funds under federal grant programs to offset the costs of disasters should they occur within city limits. WHEREAS, all citizens and property within the City of Bozeman are at risk from a wide range of hazards such as, but not limited to, aviation accidents, bioterrorism, civil unrest, communicable disease, drought, earthquake, extended cold, flooding, ground transportation accidents, hazardous materials release, railroad accidents, severe thunderstorms, terrorism, tornadoes, utility outage, violence, volcano, wildfire, wind, and winter storms; and WHEREAS, the City of Bozeman, pursuant to Section 322, Mitigation Planning, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, enacted by Section 104 of the Disaster Mitigation Act of 2000 (P.L. 106-390) and the Interim Final Rule published in the Federal Registry on February 26, 2002 at 44 CFR Part 201, is required to have an approved Hazard Mitigation Plan in order to receive future federal disaster mitigation funds; and WHEREAS, a Hazard Mitigation Plan dated July 2012 and attached hereto as Exhibit A and which is incorporated by this reference as though fully set forth herein, will guide the City of Bozeman in making decisions for pre-disaster and post-disaster mitigation projects. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana as follows: That the City Commission hereby adopts the Hazard Mitigation Plan dated July 2012, pending approval from the Federal Emergency Management Agency, and attached hereto as Exhibit A. PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular session held on the 13th day of August, 2012. ____________________________________ SEAN A.
