HomeMy WebLinkAbout12- Triangle Land Use Planning Interlocal Agreement between Gallatin County, Belgrade and Bozeman INTER-LOCAL AGREEMENT GALLATIN COUNTY—CITY OF BELGRADE— CITY OF BOZEMAN This Agreement is made and entered into this 24th day of July, 2012, among Gallatin County, Montana (County); the City of Belgrade, Montana; and the City of Bozeman, Montana. WHEREAS, Gallatin County has experienced very rapid growth in the past two decades. Most of that growth occurred within the "Triangle" area; about half of the growth within the"Triangle"happened in low-density subdivisions in unincorporated areas; and WHEREAS, while growth has stalled in recent years, because this area possesses the fundamental assets that attract growth, such as state university, outstanding natural amenities, numerous recreational opportunities, and the state's busiest airport, it will likely be among the first to resume significant growth in the future; and WHEREAS, all three jurisdictions contain sections in their growth policies that explicitly call for coordination of land use, infrastructure, and public services between them. Gallatin County's Growth Policy states that the County"is committed to developing and maintaining working inter-local agreements with the local communities within the County"; Bozeman's 2020 Plan calls for the utilization of"inter-local agreements and similar mechanisms to establish formal coordination mechanisms so intent, scope, and functions are well defined to advance cooperation; Belgrade's Growth Policy states that it will "continue to work with Gallatin County...and the Bozeman City Commission...on various regional issues common to each respective agency"; and WHEREAS, the County and Cities wish to hire a consultant to perform an analysis of the issues involved in inter-local coordination, and recommend a process for inter-local cooperation; WHEREAS, the County and Cities have the authority to enter into this agreement pursuant to Sections 76-1-601, MCA. NOW, THEREFORE,the County and Cities agree as follows: 1. PURPOSE OF INTERLOCAL AGREEMENT. The purpose of this Agreement is to facilitate cooperation between Gallatin County and the cities of Belgrade and Bozeman regarding infrastructure, land use planning, and public services in the "Triangle"area of the Gallatin Valley—the land between Bozeman, Belgrade, and the unincorporated community of Four Corners. The County, in cooperation with the Cities,will commission an analysis of inter-local issues,which will provide a framework for how the County and Belgrade and Bozeman can work effectively and efficiently together in the future to meet the goals of their growth policies and ensure the public health, safety, and welfare of existing and future generations of the citizens of the Gallatin Valley. This purpose is explained in greater detail in the attached Draft Scope of Work (Exhibit 1). 2. DURATION. The term of this Agreement shall be for a period of 1 year from the date of execution of this Agreement as set forth above. 3. FINANCING. The following shall govern the source of funds for payment to the consultant who will prepare the analysis: a. The Cities of Belgrade and Bozeman were each awarded a Gallatin Area Planning (GAP) grant of$5,000 apiece from the Sonoran Institute in 2009. b. Gallatin County was awarded a GAP grant of$10,000 from the Sonoran Institute in 2009. c. The Cities of Belgrade and Bozeman agreed that their GAP funds should be combined with the County's GAP funds and dispersed to Gallatin County for a total of$20,000. d. The County will accept a GAP grant from the Sonoran Institute for$20,000. 4. ENTIRE AGREEMENT, This Agreement constitutes the entire agreement between the parties. No alterations, modifications, or additions to this Agreement shall be binding unless reduced to writing and signed by the parties. 5. AMENDMENTS. The terms and conditions of this Agreement may not be modified or amended except by an instrument in writing executed by each of the parties hereto. No oral modification shall be enforceable. 6. SEVERABILITY. The provisions of this Agreement shall be deemed independent and severable, and the invalidity, partial invalidity, or unenforceability of any one provision or portion thereof shall not affect the validity or enforceability or any other provision herein. 7. EFFECTIVE DATE. This Inter-local Agreement is effective on the date stated in the first paragraph of this Agreement. 8. RECORDATION. This Agreement shall be filed with the Gallatin County Clerk and Recorder, Belgrade Finance Director, Airport Manager, and Montana Secretary of State, as required by Section 7-11-107, MCA.
