and the International Association of Firefighters Local 613
The following Memorandum of Agreement is made this_K day of V1 , 2012, between the City of
Bozeman (the"Employer")and the International Association of Firefighters Local 613 (the"Union").
In the spirit of mutual cooperation and the fulfillment of common interests, the City and Union desire to enter into
this MOA to provide the terms and conditions for the City's appointment of a Union member to the position of
Acting Deputy Chief of Operations for the Bozeman Fire Department.
The parties hereby agree as follows:
1. This MOA will supplement and amend the existing Collective Bargaining Agreement between the City of
Bozeman and the IAFF Local 613 Bozeman Firefighters' (2009 — 2012) and shall be included
automatically without any further action needing to be taken into any subsequently approved collective
bargaining agreement between the City and the Union.
2. The appointment of a Union member to the position of Acting Deputy Chief of Operations shall be
subject to the terms and conditions as listed in the Notice of Temporary Appointment as Acting Deputy
Chief of Operations signed by the appointed employee.
3. The Union recognizes and agrees the City is exercising its management rights in the appointment of a
Union member to the position of Acting Deputy Chief of Operations and consents to such appointment.
4. The Union waives its right to file an unfair labor practice, unit clarification, or any other claim on its own
or on behalf of any Union member, including the Union member appointed,under the existing or a future
collective bargaining agreement, either prior to, during, or after the appointment, as any such claim is
related to a procedure or decision of the City in the process of appointment, supervision, discipline, or
removal from appointment ,of the Union member appointed to the position of Acting Deputy Chief of
Operations.

Notice of Temporary Appointment as Acting Deputy Chief of Operations
Effective 12:00 PM (noon) Friday, June 15, 2012, you are hereby appointed as Acting Deputy
Chief of Operations for the Bozeman Fire Department. By signing below you agree to the
appointment and to the following terms and conditions of your appointment:
1. The term of your appointment shall commence on the date and time stated above and
shall end no later than 12:00 PM (noon) on December 15, 2012. Your appointment may
end earlier at the sole discretion of the City upon written notice from the Bozeman City
Manager, Acting Fire Chief Greg Megaard, or Chief Jason Shrauger.
2. The term of your appointment may be continued beyond 12/15/12 by the City requesting
and you signing a subsequent Notice of Appointment.
3. Your duties as Acting Deputy Chief of Operations are included in the attached position
description. Your direct supervisor will be Acting Chief Greg Megaard and subject to the
supervision of the City Manager.
4. During the term of your appointment you will withdraw in writing from membership in
the International Association of Fire Fighters Local 613. You must provide the City
documentation evidencing your withdrawal. As a result, your employment with the City
during the term of your appointment will be as an unrepresented employee and will not
be subject to any collective bargaining agreement.
5. Upon the expiration of your appointment you may return to membership in the IAFF
Local 613.
6. During the appointment you will be paid your current base monthly salary of$5,482.04
plus Iongevity of$252.00/month with a 5% increase compensating you for the additional
duties performed during the appointment. As such, your monthly salary will be $6020.74
during the appointment.

7. If a Medical Expense Reimbursement Plan (MERP) is adopted by the City of Bozeman
you will have two options related to the City's contributions to the MERP during your
appointment. As you must withdraw from the Union you will not be eligible for City
contributions to the MERP during the time of your appointment. You may either accept
the additional $50/month as part of your base salary for a monthly salary of$5,806.14 or
you may elect that upon the expiration of your appointment, or the expiration of an
extended term, you will receive a contribution into the MERP at the rate agreed upon by
the City and IAFF Local 613 for the time of your appointment. You must indicate which
option you choose by providing a written statement to the Director of Human Resources
within 10 days of this appointment.
S. You position is exempt from overtime under the Fair Labor Standards Act. Your general
work schedule will be 8 AM Monday through Friday at 5 PM and other or additional
hours as needed to fulfill the duties of Deputy Chief of Operations. This may require
work beyond 40 hours a week and eight hours a day and will most certainly include work
on weekends and evenings as required for the position of Acting Deputy Chief of
Operations.
9. Outside employment may be continued or obtained only upon prior written authorization
of the Acting Chief per the City of Bozeman Employee Handbook,
10. You will not be eligible for call back.
11. During the term of your appointment your employment shall be subject to the terms and
conditions of the City of Bozeman Employee Handbook for accruals, leave, grievances,
etc.
12. In the City's discretion, in addition to removal from appointment for performance or
behavior in violation of the Employee Handbook, you may be disciplined up to and
including termination from employment with the City of Bozeman.
13. You agree you have discussed this appointment with representatives from IAFF Local
613 and they have consented to your appointment and all terms and conditions stated
herein.

General Statement of Duties
Plans, organizes, and directs the activities and operations of an assigned division of the Fire
Department; Supervises assigned personnel; performs directly related work as required.
Distinguishing Features of the Class
The principal function of an employee in this class is to plan, organize and direct the operations
and activities of an assigned division of the Fire Department. The work is performed under
administrative direction of the Fire Chief, but extensive leeway is granted for the exercise of
independent judgment and initiative. This class is distinguished from the class of Deputy Chief 1
by additional supervisory responsibilities. The nature of the work performed requires that an
employee in this class establish and maintain effective working relationships with the Fire Chief,
other Deputy Chiefs and fire personnel, City Manager, City Commission, other City personnel,
elected and appointed officials, representatives of a variety of State, Federal, and local agencies,
media representatives and the general public. The principal duties of this class are performed in
a general office environment; however, there is some exposure to a variety of emergency
situations involving exposure to personal danger.

■ Plans, organizes, and directs the activities and operations of an assigned division of the

• Confers with the Fire Chief to plan, develop, and direct the implementation of goals,
objectives, policies, procedures, and work standards for all related division functions;
• Oversees the personnel functions for the division, including analyzing divisional
personnel needs and making recommendations accordingly, selecting, hiring, training,
motivating,and evaluating assigned personnel and taking or recommending disciplinary
actions in accordance with established City policies and procedures;
• Establishes organizational units within each division, and designates personnel to operate
and supervise each unit accordingly;
• Evaluates the operational needs for the assigned division, and makes recommendations
accordingly, including recommendations for department budget allocation, employee
training and development, and new vehicles, equipment and supplies for future
procurement;
• Prepares and administers the annual operating budget for each area of responsibility,
including monitoring expenditures, maintaining related reports and records, compiling
budget data, and reviewing purchase orders and expenditures for approval;
• Oversees the implementation of work programs designed to meet the annual and long
term objectives of the Department as directed by the Chief,
• Confers with the Chief, City officials, the general public, the media and others in regards
to any Department matters as necessary;
• Works closely with the Chief to ensure all Department activities are conducted in
compliance with applicable codes, laws, rules, policies and regulations;
• Works closely with other Department management personnel to promote positive work
attitudes within the department and maximize teamwork and cooperation by all
departmental employees;
• Assesses and monitors the effectiveness and efficiency of service delivery methods and
procedures, including assessing work load, administrative and support systems, and
internal relationships and makes recommendations for improvements to the Chief;
• Establishes or adjusts work procedures to meet daily job requirements according to
available resources, such as available workforce and related equipment;
• Coordinates work assignments with City departments/division and other agencies as
necessary;
• Provides needed information and demonstrations concerning how to perform certain
work tasks to new employees in the same or similar class of positions;
• Oversees the acquisition, maintenance, and use of vehicles, equipment and facilities;
• Assists in grant development;
• deeps immediate supervisor and designated others fully and accurately informed
concerning work progress, including present and potential work problems and
suggestions for new or improved ways of addressing such problems;

Required Knowledge, Skills and Abilities

regulations, as it relates to assigned area of responsibility;

safety program development and administration;
• Substantial knowledge of budgetary principles in the public sector;

agencies as applicable to assigned area of responsibility;

Acceptable Experience and Training
• Possession of an Associate's Degree in Fire Science or a closely related field; AND
• Considerable (7 years) experience in a related field, with at least 2 years experience at a
responsible supervisory or administrative level;
• OR Any equivalent combination of experience and training which provides the
knowledge, skills, and abilities to perform the essential duties of the position.
Required Special Qualifications
• Valid.Driver's License (CIass D) and must obtain a Montana Driver's License (Class D)
within 60 days of employment;
• Certifications specific to the functional areas may be required;
• Offers for employment are conditional upon satisfactory response to appropriate post
conditional offer process;
• Upon entry into employment, must complete a City of Bozeman Financial Disclosure
form;
• Pre-employment drug testing may be required.

Essential Physical Abilities
• Sufficient clarity of speech and hearing or other communication capabilities, with or
without reasonable accommodation, to permit the employee to communicate effectively;

suppression, and related operations, and review a wide variety of materials in electronic

and use firefighting equipment in emergency situations;
