HomeMy WebLinkAbout12- Wastewater Treatment Plant Phase I, Amendment 2 to Professional Services Agreement with HDR Engineering AMENDMENT NO. 2 TO PROFESSIONAL SERVICES AGREEMENT FOR BOZEMAN WASTEWATER TREATMENT PLANT PHASE I IMPROVEMENTS THIS IS AN AGREEMENT made as of llu 110 - 2012 between THE CITY OF BOZEMAN, a Municipal Corporation, P.O. Bo 230, Bozeman, Montana, 59771-1230 (OWNER) and HDR Engineering Inc, 8404 Indian Hills Drive, Omaha, NE 68114-4098, (ENGINEER). WHEREAS the parties previously entered into a Professional Services Agreement dated April 9_2007 and amended on December 1 2008, herein referred to as the Original Agreement, for professional engineering services for the Bozeman Wastewater Treatment Plant Improvements; and WHEREAS, the scope of the Original Agreement included preliminary design and design engineering services and Amendment No. 1 added bidding, construction, startup and software programming services; and WHEREAS, the parties desire to amend provisions of the Agreement to add TMDL Technical Assistance the project. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the parties agree as follows: The conditions and provisions set forth in the attached EXHIBIT A (AMENDMENT NO. 2) — CITY OF BOZEMAN, MONTANA TMDL TECHNICAL ASSISTANCE SUPPORTED BY PRELIMINARY WATER QUALITY MODELING SCOPE OF SERVICES, is hereby incorporated in and made part of this Agreement. ARTICLE 1 —ENGINEERING SERVICES Section 1.1 is amended to include the following: Assist the City of Bozeman through the application of a water quality model to the East Gallatin River. This model will be limited in scope by the availability of recent data and the vicinity of the City's POTW. The Title of Section 4.5 of the Original Agreement is replaced with the following: "4.5 CONSTRUCTION PHASE" 1 Section 4.5.5 is added to the Original Agreement as follows: "4.5.5 TMDL Technical Services. In addition to the services provided under Article 10 and Section 4.5 of the Original Agreement, the ENGINEER shall provide the additional services as described in the attached Exhibit A." Article 6 - Compensation For Engineering Service Article 6.2.5 is added as follows: 4'6.2 DIRECT LABOR COST PAYMENT FOR BASIC SERVICES AND EXPENSES OF ENGINEER. 6.2.5 The OWNER shall pay an amount for TMDL Technical Services rendered by the ENGINEER on the basis of the ENGINEER'S Direct Labor Costs times a factor of 3.15 in an amount not to exceed $20,000." Except as specifically amended herein, the Original Agreement and Amendment No. 1 shall remain in full force and effect and the parties shall be bound by all terms and conditions therein. Water Section Manager) DATE: —7 DATE: i S-z—_ i� Tyr ATTEST: f . , 7y. 1I f� ) • 2 EXHIBIT A SCOPE OF SERVICES CITY OF BOZEMAN, MONTANA TMDL TECHNICAL ASSISTANCE SUPPORTED BY PRELIMINARY WATER QUALITY MODELING BACKGROUND The Lower Gallatin total maximum daily load (TMDL) planning area encompasses approximately 996 square miles (637,570 acres) in southwestern Montana. The City of Bozeman is located near the center of the planning area. The East Gallatin River is 303(d)-listed as impaired by pH, total nitrogen, and total phosphorus. The Montana Department of Environmental Quality in their Lower Gallatin TMDL Project Plan has determined that some level of water quality modeling is needed for the TMDL. "A medium level of source assessment work includes use of a complex model with limited or no calibration or a simpler model with a relatively significant effort to "calibrate" or verify model input parameters and results". The City of Bozeman has concluded that some preliminary water quality modeling should be completed to understand potential implications of the TMDL on their National Pollutant Discharge Elimination System (NPDES) permit for their publically owned treatment works (POTW) that discharges to the East Gallatin River. SCOPE OF SERVICES This scope of services is for the Consultant to assist the Owner through the application of a water quality model to the East Gallatin River. This model will be limited in scope by the availability of recent data and the vicinity of the Owner's POTW. The proposed scope of Consultant services are identified in the following tasks. Consultant will commence with services upon written notice to proceed. TASK 100 - PRELIMINARY WATER QUALITY MODELING Objective Select and apply a water quality model to the East Gallatin River that may be used to examine alternative effluent nutrient scenarios. Approach The approach involves the following. • Compile physical characteristics (i.e., channel shape), flow (river, tributaries, groundwater, and point sources), water temperature data and water quality data for model construction from the USGS, DEQ, City, and local water quality district. • Compiled data will be from 2000 to present. • Updated data will be provided for summer 2012 after sampling by the Gallatin Local Water Quality District. • Select period for modeling. • The selected period is anticipated to be a single late summer date representative of low flow conditions based on data from the 2000's. • Select model extents. Page 1 of 3 June 2012 1 1_ q • The model extents will be the headwater of East Gallatin River to confluence with the Gallatin River or similar. • Review model selection. • The recommended model is QUALM as used for Bitterroot, Clark Fork, and Yellowstone Rivers. • Develop preliminary 1-D steady state water quality model of the East Fork Gallatin River including water quality parameters. • Include point source effluent inputs. • Develop alternative point source effluent inputs and model scenarios. • Alternative inputs will include an analysis of the five representative total nitrogen and total phosphorus treatment levels. Assumptions • Raw data will be readily accessible via the internet or provided by the Owner. • A modeling report will not be created. • The modeling will not include calibration and validation. Owner Input • Owner will provide Consultant with available data regarding the East Gallatin River physical and water quality data and POTW effluent data. • Owner will provide reviews of input and output data, provided electronically, based on local knowledge to assist with developing a model that appropriately represents the East Gallatin River. Deliverables • Water quality model files. • Brief written summary with minimal (data sources and a few paragraphs about the modeling) documentation of the model application and simulation results. Page 2 of 3 June 2012 FM STAFF Key Consultant staff and roles for this NPDES permit strategy and technical assistance includes: • Amanda McInnis, Project Principal, will continue existing strategic coordination role with the City of Bozeman. • Coralynn Revis, Project Manager, will provide local contact with the City of Bozeman and assist with data compilation. • Michael Kasch, Water Quality Manager, will apply and conduct the water quality modeling. • David Clark, Technical Resource, will provide QC reviews of water quality modeling results and interpretation of potential implications to the POTW. BACKGROUND: Attached is a copy of the partially executed Amendment No. 2 with HDR Engineering, Inc. for the 2007 WRF Upgrade—Phase I Expansion Project. The Montana DEQ is preparing to issue the findings of its TMDL (Total Maximum Daily Loading) Study of the East Gallatin River for nitrogen and phosphorus. This draft document contains nutrient loading targets for the stream segment immediately downstream from Bozeman's Water Reclamation Facility outfall which are exceptionally low and which could ultimately impact whether the City of Bozeman is permitted to discharge its treated effluent into this receiving stream in the future. Staff is concerned that the entire stream sampling data set on which this TMDL study was based came from river samples which were collected before Bozeman's new Biological Nutrient Removal facility came on line. Furthermore,the wasteload allocations for the East Gallatin River were created in the absence of a stream model. In addition to the much higher quality effluent now being discharged from Bozeman's Water Reclamation Facility, the physical location of the outfall has also been moved upstream since sampling occurred. Therefore the existing database is unrepresentative and may not accurately reflect Bozeman's actual impact on the East Gallatin River. The intent of this professional services agreement is to conduct additional stream sampling to enlarge the existing data base, analyze this new data, and more accurately assess the impact our plant discharge has on the water quality of the East Gallatin River by inputting this data into a computer-based stream modeling software package called QUAL2K. UNRESOLVED ISSUES: None ALTERNATIVES: As suggested by the City Commission FISCAL EFFECTS: If approved, this amendment will decrease the contingency on the phase I portion of the project from $1,444,071.99 to $1,424,071.99.
