A RESOLUTION
OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA
DECLARING
IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO
CREATE A SPECIAL
IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE-
MENT DISTRICT
NO. 630 FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING
AN ASPHALTIC
CONCRETE TYPE PAVEMENT, INTEGRAL CONCRETE CURBS AND
GUTTERS, AND
NECESSARY APPURTENANCES THERETO: ALSO APPURTENANCES

TO STORM DRAINAGE ON SOUTH 22ND AVENUE BETWEEN SOUTH 20TH
AND KOCH STREET IN THE UNIVERSITY SQUARE SUBDIVISION IN THE CITY OF
BOZEMAN, MONTANA.
WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman,
Montana, a
petition in due form of certain owners of properties situated in the district asking
that a Special
Improvement District be created for the purpose of constructing and installing
an asphaltic
concrete type pavement, together with integral concrete curb and gutter, and
necessary
appurtenances thereto, and necessary storm drainage facilities appurtenant to such
pavement;
and,
WHEREAS, at
a regular meeting of the City Commission of the City of Bozeman held on the
29th day of
October, 1980, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
It is hereby
declared to be the intention of the City of Bozeman to create a Special Improve-
ment District
to be known and designated as Special Improvement District No. 630 for the purpose
of constructing
and installing an asphaltic concrete type pavement on South 22nd Avenue between
I South 20th
and Koch Street, said project to include construction and installation of integral
concrete curb and gutter and necessary appurtenances thereto, together with necessary storm
drainage facilities appurtenant to such paving.
Section 2
Boundaries
The boundaries
of said S~ecial Improvement District No. 630 are described as follows:
Description
Portions of
Block 4A.1, of the Amended Subdivision Plat of Blocks 3-4 of
Kirk's Subdivision
No.4 and Lots 8, 9 and 10, Block 2 of said Kirk's
Subdivision
No. 4 beginning at the southwest corner of said Block 4; thence
North 89054'30"
East a distance of 175.00 feet to the true point of begin-
ning; thence
North 00000'07" East a distance of 470.00 feet; thence North
89054'30"
East a distance of 120.00 feet; thence North 13020'00" West to
the south
right-of-way of West Koch Street; thence along the south right-of-
way of said
Koch street a distance of 409.86 feet to the northeast corner
of lot 3,
Block 1, University Square Subdivision to the City of Bozeman,
thence along
the east side of said lot 3 on a bearing South 00000'0511 West
a distance
of 184.64 feet; thence North 89035157" East a distance of 120.00
feet to the
west boundary of said Block 2, Kirk's Subdivision Ng. 4; thence
South 00000'05"
West a distance of 413.39 feet; thence North 89 58'1411 East
a distance
of 120.01 feet to the West right-of-way of South 20th Avenue;
thsnce along
said west right-of-way a distance of 259.07 feet; thence South
89 54'30"
West a distance of 650.10 feet to the true point of beginning.

includes lots 1 and 3, Block 1 and lots 1-5, Block 2 said Univer-
sity Square Subdivision to the City of Bozeman, Montana and containing
346,732.6 square feet.
Section 3
Character of Improvements
The character
of improvements in Special Improvement District No. 630 is the construction of an
asphaltic
concrete pavement project with integral concrete curb and gutter together with storm
drainage and
necessary appurtenances to said construction on South 22nd Avenue between 20th

Avenue and Koch Street, said project to include construction of gravel subbase, and asphaltic
concrete type base and surface course, all necessary excavation and backfill, and all other
work appurtenant thereto; together with all storm drainage appurtenant to said project.
Section 4
Estimate of Cost
I
The preliminary estimate of cost of the improvements ;n Special Improvement District
No. 630 including all construction costs, material costs, engineering, legal, administration,
and contingency is $120,000.00.
Section 5
Method of Assessment
The cost of said improvement is to be assessed against the entire district; each lot or
parcel of land within such district will be assessed for that part of the whole cost which its
square footage bears to the square footage of the entire district, exclusive of streets,
avenues, alleys, and public places.
The total number of assessable square feet within the entire district is 346,732.6 which
is the area on which all protests will be received, considered, and determined, and on which
all assessments will be calculated.
Section 6
Payments
The payments for said improvements shall be made in twenty (20) annual installments extend-
ing over a period of nineteen (19) years, but this shall not be construed to prevent payment in

full at any regular payment date by any property owner who desires to do so.
It is proposed to
pay the entire cost and expense of the construction and installation of said improvements
with cash to be obtained from the sale of bonds of said Special Improvement District No. 630,
as authorized by law.
Such bonds will be denominations of $100.00 each, and fractions or
multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known
and designated as Special Improvement District No. 630 Fund of the City of Bozeman.
The bonds
will be redeemable at the option of the City, singly or in multiples, and in the order of thei'r
registration, whenever funds are available for the purpose of said Special Improvement District
No. 630. Said
bonds shall draw simple interest from the date of their registration until
called for payment, which interest shall be chargeable as part of the cost of construction and
installation of said improvements.
The bonds will be issued and sold in accordance with the
provisions of Section 7-12-4201 and Section 7-12-4223, Montana Code Annotated, and all other
applicable provisions of Title 7, Montana Code Annotated, relating to special improvement dis-
tricts in cities and towns, and any amendments thereof or thereto.
Section 7

Protests and Notices
The regular session of the City Commission of the City of Bozeman, to be held at the
Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 19th day of November,
1980, at the hour of 1:15 p.m. of said day, is the time and place. when and where the City
Commission will hear and pass upon all protests duly and regularly made and filed against the
creation of said proposed Special Improvement District No. 630, the improvements proposed to

thereto, and the extent and character thereof, or either thereof; and the
Clerk of the
City Commission be, and she is hereby authorized to give notice in the manner and
for the time
as by law required, of the adoption of this resolution of intention.

o'clock p.m.
at the Commission Room of the City Hall, Bozeman, Montana, is designated as the
time and place
for hearing objections to the action proposed to construct and install asphal-
tic concrete
type pavement, integral concrete curbs and gutters, and necessary appurtenances
thereto upon
the following described contiguous territories within the corporate limits of
the City of
Bozeman, Montana. Expressions of approval or disapproval by resident freeholders
of the territories
proposed to be constructed and installed upon must be made in writing and
filed with
the Clerk of the City Commission of the City of Bozeman not later than fifteen
(15) days
after the date of the first publication of this notice.
