2264
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A
SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DIS-
TRICT NO. 628 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF A
WATERMAIN, SANITARY SEWER AND STORM DRAIN AND APPURTENANCES, AND PAVING
TO SERVE THE ADJOINING PROPERTIES AND MORE SPECIFICALLY DESCRIBED AS
I FOLLOWS:
A SIX (6) INCH WATERMAIN AND APPURTENANCES ON FRYSLIE STREET
IN THE FIGGINS ADDITION: AN EIGHT (8) INCH SANITARY SEWER IN THE SAME
AREA, MANHOLES AND SERVICE STUBS TO THE PROPERTY LINES AND STORM DRAIN
PIPING, AND PAVING WITH AN ASPHALT CONCRETE TYPE PAVEMENT, INTEGRAL
CONCRETE CURBS AND GUTTERS AND NECESSARY APPURTENANCES, ALL IN THE
CITY OF BOZEMAN, MONTANA.
THE CONSTRUCTION AND INSTALLATION OF THE WATERMAIN, SANITARY SEWER
AND STORM DRAIN AND PAVING TO INCLUDE ALL TRENCH EXCAVATION AND BACK-
FILL, BEDDING MATERIAL, CAST IRON WATERMAIN, VALVES, FITTINGS,
HYDRANTS, SANITARY SEWER LINES, MANHOLES, STORM DRAINAGE PIPE, SERVICE
LINE STUBS, PAVING WITH INTEGRAL CONCRETE CURBS AND GUTTERS, AND
OTHER NECESSARY APPURTENANCES.
WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman,
Montana, a
petition in due form of certain owners of properties situated within the boundaries
of Special
Improvement District No. 628 as hereinafter more specifically described, asking that
a special
improvement district be created for the purpose of constructing and installing water
mains, sanitary
sewer and storm drains to provide service to lots within the district.
WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the
27th day of
August, 1980, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
I
Declaration of Intention
That it is hereby declared to be the intention of the City of Bozeman to create a special
improvement district to be known and designated as Special Improvement District No. 628
of the
City of Bozeman
for the purpose of constructing and installing watermains, sanitary sewers and
storm drainage,
and paving with integral concrete curbs and gutters, said project to include
all appurtenant
work for the construction and installation of watermains, sanitary sewer and
storm drains
and paving with integral concrete curbs and gutters to provide service to all lots
within the
district.
Section 2
Boundaries
The boundaries of said Special Improvement District No. 628 are described as follows:
Description
A tract of land located in the East 1/2, Northeast 1/4, Section 24,
Township 2 South, Range 5 East, M.P.M., which is Block 9 as filed in
the Figgins Addition, First Phase, to the City of Bozeman, and being
more particularly described as follows:
Beginning at the Northeast corner, said Section 24; thence South 89014'00"
I West,
along the East-West section line, a distance of 264.00 feet to the
true point of beginnisg; thence South 00013100" West, a distance of 164.97
feet; thence North 89 04100", a distance 97.80 feet, thence South 00042'00"
West a distance of 78.92 feet, thence South S901S'00" West a distance of
110.25 feet to the Southwest corner of Lot 30, Block 9, Figgins Addition;
thence Northwesterly across Fryslie Street to the Southeast corner of Lot
21 said Block 9; thence South 8901S'OO" West a distance of 405.16 feet;
thence North 00042'00" West a distance of 10.00 feet; thence South 89018'00"
West a distance of 95.16 feet; thence North 31031151" East a distance of
144 feet to the North line of Lot 25; thence South 83050143" East a distance
of 45.00 feet to the culdesac on Fryslie Street; thence along said cu1desac
of radius 50 feet a distance of approximately 63 feet; thence North 390~3146"
East a distance of 89.07 feet to the North line of said Figgins Addition;
thence North 89004'00" East a distance of 2S9.34 feet to the true point of
beginning and containing 90.765.57 square feet of assessable area which does
not include dedicated public rights of way.

The above includes the usable portions of Lots 25 and 26, all of lots
21-24, 26-30 in Block 9, First Phase as amended, Figgins Addition to
the City of Bozeman.
Section 3
Character of Improvements
The character
of the improvements to be made is the installation and construction of a
I
six (6) inch
watermain, eight (8) inch sanitary sewer and twelve (12) inch RCP storm drain
culvert, and
a 37 foot wide pavement with integral concrete curb and gutter, including trench
excavation
and backfill, bedding material, cast iron watermains, valves, hydrants and fittings,
cop~er service
lines and fittings, manholes and sewer stubs, and other necessary appurten-
ances thereto.
Section 4
Estimate of Costs
The total
esti.mated cost of It he improvements within the district including engineering, legal
and contingency
is $110,000.00.
Section 5
Method of Assessment
The cost of
such improvement is to be assessed against the entire district. Each
lot,
block, tract
or parcel of land within the district will be assessed for that portion of the
whole cost
which its area bears to the areas of the entire district, exclusive of streets,
avenues, alleys
and public places.
The total
actual assessable area within the entire district is 90,765.57 square feet and
I
is the area
on which all protests will be received, considered, and determined.
It is also the
area on which
all assessments will be figured.
Section 6
Payments
The payments
for said improvements shall be made in twenty (20)annual installments
extending
over a period of nineteen (19) years, but this shall not be construed to prevent
payment in
full at any regular payment date by any property owner who desires to do so.
It is
proposed to
pay the entire cost and expense of the construction and installation of said improve-
ments with
cash to be obtained from the sale of bonds of said Special Improvement District
No. 628 as
authorized by law. Such bonds will be in denominations of $100.00 each, and fractions
or multiples
of $100.00 where necessary, to be issued and chargeable against a fund to be known
and designated
as Special Improvement District No. 628 Fund of the City of Bozeman.
The bonds
will be redeemable
at the option of the City, singly or in multiples, and in the order of their
registration,
whatever funds are available for the purpose in said Special Improvement District
No. 628.
Said bonds shall draw a simple interest from the date of their registration until

called for
payment, which interest shall be chargeable as part of the cost of construction and
installation
of said improvements. The bonds will be issued and sold in accordance with the
provisions
of Section 7-12-4201 and Section 7-12-4223, Montana Code Annotated, and all other
applicable
provisions of Title 7, Montana Code Annotated, relating to special improvement
district in
cities and towns, and any amendments thereof or thereto.

Section 7
Protests and Notices
That the regular
session of the City Commission of the City of Bozeman, to be held at
the Commission
Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 19th day of
I November,
1980, at the hour of 1:15 p.m. of said day, is the time and place, when and where
the City Commission will hear and pass upon all protests duly and regularly made and filed
against the creation of said Special Improvement District No. 628, the improvements proposed
to be made
pursuant thereto and the extent and character thereof, or either thereof; and the
Clerk of the
City Commission be, and she is hereby directed to give notice in the manner and
for the time
as by law required, of the adoption of this Resolution of Intention.

Expressions of approval or disapproval by resident freeholders of the

proposed to be constructed and installed upon must be made in writing and filed with
the Clerk
of the City Commission of the City of Bozeman not later than fifteen (15) days after

the first publication of this notice.

($110,000.00).
This notice is given pursuant to the provisions of Sections 7-12-4201 and 7-12-4223, Montana
Code Annotated, and all other applicable provisions of Title 7, Montana Code Annotated, relating
to special improvement districts in cities and towns, and any amendments thereof or thereto.
