HomeMy WebLinkAbout8th Elementary School Preliminary Site Plan – Exemptions - #Z-12133 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Doug Riley, Associate Planner Tim McHarg, Planning Director SUBJECT: 8th Elementary School Preliminary Site Plan – Exemptions - #Z-12133 MEETING DATE: July 23, 2012 AGENDA ITEM TYPE: Other Public Hearing RECOMMENDATION: The City Commission receive the site plan and conduct a public hearing on the exemptions claimed under M.C.A. Section 76-2-402 per the 8th Elementary School Term of Annexation #5. (Other than conducting a public hearing, no official motion is required by the City Commission). BACKGROUND: On June 4, 2012, the City Commission preliminarily approved the 8th Elementary School Annexation. Term #5 of that annexation approval stated: “Prior to the execution of the Annexation Agreement, a Preliminary Site Plan application shall be submitted and be the subject of a public hearing at a City Commission meeting in which the specific exemptions being requested can be noticed as required by State Statute and the Bozeman Municipal Code”. The School District has now submitted this preliminary site plan in sufficient detail that the exemptions can be presented/determined to satisfy this term of annexation. Montana law (M.C.A. Section 76-2-402) addresses the relationship of municipal zoning regulations to a school district’s use of land. The law requires a public hearing whenever land is to be used contrary to the zoning regulations. The statute expressly provides that a municipality “shall have no power to deny the proposed use but shall act only to allow a public forum for comment on the proposed use.” In this instance the School District’s use of the land will not be contrary to the proposed PLI zoning designation. However, the District has historically sought exemptions from miscellaneous development standards on other site developments. In this regard, the applicant and the Development Review Committee (DRC) have identified and publically noticed claimed exemptions to the following regulations of the Bozeman Unified Development Code: Article 26 – Landscaping; Section 38.25.020.J. for curbing of potions of parking lot and drive access ways; and Section 38.24.090.C regarding drive access requirements. Staff would also like to point out that the applicant has made other changes to the Site Plan to address several other items identified by the DRC during the informal review. These changes include: completing a fencing plan (to review for potential conflicts); installation of fully compliant site lighting; amended several curb radiuses (to better accommodate emergency and 32 solid waste vehicles); and installation of another on-site fire hydrant to the rear of the building (as requested by the Fire Department). UNRESOLVED ISSUES: As identified by the City Commission. FISCAL EFFECTS: None identified as part of the Site Plan/Exemption Public Hearing requirement.
