A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE
SPECIAL IMPROVEMENT LIGHTING DISTRICT NO. 631 FOR THE PURPOSE OF
OPERATING AND MAINTAINING A LIGHTING DISTRICT TO LIGHT THE NORTHEAST
PORTION OF BOZEMAN FROM BLACK EAST AND LAMME NORTH TO TAMARACK.
SAID
LIGHTING SYSTEM TO BE INSTALLED AND PAID FOR BY THE MONTANA POWER COM-
I PANY
UNDER AUTHORITY OF AND IN CONFORMANCE WITH SECTION 7-12-4301 TO
7-12-4326 INCLUSIVE OF THE REVISED CODES OF MONTANA.
WHEREAS, there has been filed with the Clerk of the Commission of the City of Bozeman,
a petition
in due form of
certain property owners in the Northeast section of Bozeman from Black east and Lamme
north to Tamarack,
asking that a Special Improvement Lighting District be created for the purpose
of operating and
maintaining a lighting system to light rhe northeast section of Bozeman from Black
east and Lamme
north to Tamarack, Gallatin County, Montana; and
WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 30th
day of April,
1980, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN:
Section 1
Declaration of Intention
It is hereby declared to be the intention of the City of Bozeman to create a Special Improve-
ment District
No. 631 of the City of Bozeman for the purpose of operating and maintaining a lighting
system to light
the northeast section of Bozeman from Black east and Lamme north to Tamarack.
Section 2

Boundaries
The boundaries of said Special Improvement Lighting District No. 631 are described
as follows:
All lots fronting on Black, Bozeman, Montana, Rouse, Church, and Wallace Avenues
between Lamme and Tamarack Streets; also lots fronting on Ida from Davis to Peach,
Plum from Lamme to Peach, Broadway from Lamme to Front Street.
Also included are
lots not included in the above that front on Lamme from Black Avenue to Broadway
Avenue, Beall from Black Avenue to Rouse Avenue, Davis from Church to Broadway,
Villard from Black to Bozeman, Short from Black to Bozeman, Fridley from Church
to Broadway, Orange from Ida to Plum, Avocado from Plum to Broadway, Peach from
Black to Plum, Cottonwood from Black to Wallace, Aspen from Black to Wallace and
Tamarack from Black to Front.
The area served includes:

Character of Improvements
The character of improvements being considered to be installed and paid for by the Montana
Power Company are as follows:
A. The erection
and installation of one hundred forty-eight (148), 175 watt (7,000 Lumens)
Type III Mercury Vapor Luminaries to be mounted on wood poles in the streets.
B. The erection
and installation of one hundred forty-eight (148), 100 watt (9,500 Lumens)
Type III High Pressure Sodium Luminaries mounted on wood poles in the streets.
All lights are to be served by overhead conductors.
The system shall be equipped with all
necessary appliances for safe and proper operation of the system.

Section 4
Estimated Cost of Maintenance
and Electrical Current
An estimate cost of maintaining of the Mercury Vapor Luminaries is $4.84 per unit per month
or a total of $8,595.84 per year of which 75% will be charged to the property owners on a front
foot basis.
The estimate cost of maintaining the High Pressure Sodium Luminary system is $8.39
per unit per month or the total of $14,900.64 per year of which 75% will be charged to the pro-
perty owners on a front foot basis.
Section 5
Method of Assessment
The cost of maintaining such improvement is to be assessed against the entire district; each
lot or parcel of land within such district will be assessed for that part of the whole cost which
its frontage bears to the total frontage within the district.
The total area within the district
is 4,530.79 feet and is the footage on which all protests will be received, considered, and
determined, and on which all assessments will be calculated.

Section 6
Protests and Notices
The regular session of the City Commission of the City of Bozeman to be held at the
Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 14th day of January,
1981, at the hour of 1:15 o'clock p.m. of said day, is the time and place where and when the City

Commission will
hear and pass upon all protests duly and regularly made and filed against
the creation of
said proposed Special Improvement District No. 631, the improvements proposed to
be made pursuant
thereto, and the extent and character thereof, or either thereof; and the Clerk
of the City Commission
be, and she is hereby directed to give notice in the manner and for the
I time as by law
required, of the adoption of this resolution of intention.

NOTICE IS HEREBY
FURTHER GIVEN, that Wednesday, the 14th day of January, 1981, at 1:15 o'clock
p.m. at the Commission
Room of the City Hall, Bozeman, Montana, is designated as the time and place
for hearing objections
to the action proposed to operate and maintain a lighting district to light
the northeast
portion of Bozeman from Black east and Lamme north to Tamarack, upon the following
described contiguous
territories within the corporate limits of the City of Bozeman, Montana.
Expressions of
approval or disapproval by resident freeholders of the territories proposed to be
operated and maintained
upon must be made in writing and filed with the Clerk of the City Commission
of the City of
Bozeman not later than fifteen (15) days after the date of the first publication of
this notice.
A description
of the boundaries of the territories proposed to be operated and maintained
I upon by said Commission
Resolution No. 2284 is as follows:
All lots fronting on Black, Bozeman, Montana, Rouse, Church, and Wallace Avenues

Section 1
Character of Improvements
The character
of improvements being considered to be installed and paid for by the Montana
Power Company are as follows:
A.
The erection and installation of one hundred forty-eight (148), 175 watt (7,000 Lumens)

Section 2
Estimated Cost of Maintenance
and Electrical Current
An estimate cost
of maintaining of the Mercury Vapor Luminaires is $4.84 per unit per month
or a total of $8,595.84 per year of which 75% will be charged to the property owners on a front
foot basis. The
estimate cost of maintaining the High Pressure Sodium Luminary system is $8.39
per unit per month or the total of $14,900.64 per year of which 75% will be charged to the
property owners
on a front foot basis. Such lighting system shall be installed and
paid for by
the Montana ~pwer Company under authority of and in conformance with Section 7-12-4301 through
7-12-4326 inclusive of the Revised Codes of Montana.

special improvement districts for cities and towns, and any amendments thereof or thereto.
