A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE-
MENT DISTRICT NO. 622 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION
OF TRUNK WATER SUPPLY MAINS AND APPURTENANCES TO THE VALLEY UNIT SUB-
DIVISION AND OTHER SERVICE AREAS IN THE CITY OF BOZEMAN AND MORE SPECI-
FICALLY DESCRIBED AS FOLLOWS: A 12-INCH WATER MAIN EXTENSION
AND APPER-

TO FOWLER LANE A 10-INCH WATER MAIN ESTENSION ALONG WEST MAIN TO FOWLER

THE CONSTRUCTION AND INSTALLATION OF THE TRUNK WATER MAINS IS TO INCLUDE
ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, DUCTILE IRON WATER
MAINS, VALVES AND FITTINGS, HIGHWAY JACK AND BORE, AND OTHER NECESSARY
APPURTENANCES THERETO.
WHEREAS,at a regular session of the City Commission of the City of Bozeman, held on the
5th day of November,
1980, the said City Commission duly passed Commission Resolution No. 2268,
declaring it to
be the intention of the said City Commission to create a special improvement
district to be
known and designated as Special Improvement District No. 622 to the said City,
for the purpose
of construction and installation of trunk water supply mains and appurtenances
to the Valley
Unit Subdivision and other service areas in the City of Bozeman, including all
trench excavation
and backfill, bedding material, ductile iron water mains, valves and fittings,
highway jack and
bore, and other necessary appurtenances thereto, and the said Commission
Resolution No.
2268 is hereby referred to and made a part hereof for further particulars in
I respect to the
boundaries of said Special Improvement District No. 622, and the estimated cost
of said improvements and method of assessing the same against the property of said district;
and,
WHEREAS, notice of the passage of said Commission Resolution No. 2268 was duly published,
as required by
law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation
printed and published
in the City of Bozeman, Montana, and by sending a copy of such notice
by U. S. Mail
to each person, firm or corporation having property within the proposed district
at his or its
last known address, upon the same date that such notice was first published as
aforesaid, and
due proof having been made of the publication and service of said notices; and,
WHEREAS, within the time provided by law and said published and served notice, there was
not sufficient
protests against the creation of said proposed Special Improvement District
No. 622, and the
City Commission was in regular session on the 26th day of November, 1980,
at 1:15 o'clock
p.m., of said day, at the Commission Chamber in the City Hall Building in the
said City of Bozeman,
Montana, the same being the time and place designated in said notice
for passing upon
all protests, if any, against the proposed work or against the creation or
I extent of said
district, or both or either; and it further appearing that all of the proceedings
for the creation of said district have been lawful and regular.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA
Section 1
That the said Special Improvement District No. 622 of the City of Bozeman be, and the same
is hereby created
for the purpose of making improvements as in said Commission Resolution
No. 2268 and hereinafter
described.

Section 2
That said special
improvements be, and the same are, hereby ordered to be made in said
Special Improvement District No. 622 as follows:

OF TRUNK WATER
SUPPLY MAINS AND APPURTENANCES TO THE VALLEY UNIT SUBDIVIS-
ION AND OTHER
SERVICE AREAS IN THE CITY OF BOZEMAN AND MORE SPECIFICALLY
DESCRIBED AS FOLLOWS:
A 12-INCH WATER MAIN EXTENSION AND APPURTENANCES
FROM WEST COLLEGE
ALONG THE SOUTH RIGHT-OF-WAY OF U. S. 191 TO FOWLER
LANE A 10-INCH
WATER MAIN EXTENSION ALONG WEST MAIN TO FOWLER AVENUE.
A SANITARY SEWER
LINE TO BE KNOWN AS THE "FAR WEST TRUNK" WITH PIPE
SIZES OF 18 AND
21 INCHES AND APPURTENANCES TO TRANSPORT WASTEWATER FROM
THE VALLEY UNIT
SUBDIVISION AND OTHER SERVICE AREAS IN THE CITY OF
BOZEMAN TO THE
WEST END INTERCEPTOR. THE CONSTRUCTION AND INSTALLATION
OF THE SEWER TRUNK
TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BED-
DING MATERIAL,
SEWER PIPE, MANHOLES, STUB OUTS AND OTHER NECESSARY APPUR-
TENANCES.
Section 3
That the entire
cost and expense of maintaining the improvements herein referred to in
said Special Improvement District No. 622, shall be assessed against the entire district.
Each
lot, block, tract or parcel of land wi~hin the district will be assessed for that portion of
the whole cost which its area bears to the area of the entire district exclusive of streets,
avenues, and public places.
The total number of feet of assessable footage within the
district is 7,270,877.84 S.F. and is the area on which all assessments will be calculated.
Section 4
That any and all
construction districts within the same boundaries and serving the same I
boundaries and serving the same area are hereby declared abandoned and terminated.
PASSED AND ADOPTED
by the City Commission of the City of Bozeman, at a regular session
held thereof on the 10th day of December, 1980.
