CO~1MISSION RESOLUTION NO. 2308
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA
EXPRESSING SUPPORT OF AND URGING PASSAGE BY THE MONTANA LEGISLATURE
OF HOUSE BILL NO. 765, "AN ACT TO PROVIDE FOR ~1UNICIPAL REGULATION
OF MUNICIPALLY OWNED UTILITIES: TO ESTABLISH MAXIMUM INCREASES ALLOWED;
TO REQUIRE REPORTING TO THE PUBLIC SERVICE COMrnSSION AND THE MONTANA
CONSUMER COUNSEL: AND N1ENDING SECTION
69-3-101, M.C.A."
I WHEREAS, inflationary pressures, beyond the control of municipalities,
are necessitating
more frequent utility rate increase requests; and
WHEREAS, application to the Public Service Commission for utility
rate increases is a
costly and time consuming process that increases administrative
costs that are ultimately passed
on to the consumer; and
WHEREAS, a utility owned and operated by a City or Town is not the
same as an investor-
owned utility, in that a profit motive is not a primary concern
in the operation of the utility;
and
WHEREAS, House Bill No. 765 provides for (1) limitations on rate
increases that may be
established by cities and towns without Public Service Commission
approval; (2) conduct of municipal
rate hearings and notice requirements thereof; and (3) annual reports
to the Public Service Commission
thereby, providing reasonable protection to municipal utility users;
and
WHEREAS, the City or Town governing body, elected by the people
the utility serves:, is
considered to be the most appropriate forum to determine the municipal
operated utility rates in
their community.
I NOW. THEREFORE. BE IT RESOLVED that the City Commission of
the City of Bozeman supports
and urges passage of House Bill No. 765 by the Montana Legislature to provide for municipal regulation
of municipally owned utilities.
PASSED AND ADOPTED BY THE CITY COMMISSION of the City of Bozeman,
at a regular and stated
session of said City Commission. held on the 11th day of March.
