A RESOLUTION OF THE CITY COt1MISSION OF THE CITY OF BOZH1AN VACATING AN
ALLEY THROUGH REAL PROPERTY OWNED BY THE t10NTANA RANK OF BOZmAN, N. A. ,
A NATIONAL BANKING ASSOCIATION.
HHEREAS, a petition has been received, sirmed by all of the oroperty owners of real
property
abutting an alley located in Block C,Tracy's Addition to the City of Bozeman request-
I
ing a vacation
of the alley to allow the construction of a banking facility owned by the
t10ntana
Bank of Bozeman, N. A., and
HHEREAS, the City Commission of the City of Bozeman has caused to be published a
notice
stating when said petition for vacation will be acted upon, and
\'/HEREAS, the City Commission has found said vacation will not be detrimental to the
public
interest.
BE IT RESOLVED BY THE CITY COmlISSION OF THE CITY OF BOZmAN:
1. The City of Bozeman hereby transfers all of its riClht, title and interest in
and to
the foll owing described real property:
An alley running east and west through Block C, Tracy's Addition to the r.ity
of Bozeman being 20 feet in width and 280 feet in length between Third Avenue
on the I-lest and Grand Avenue on the East, all of which is located in Gallatin
County, t1ontana.
SUBJECT TO the right of the City of Bozeman, its employees, heirs and assirms
to enter upon said tract to repair, remove, Maintain, install, substitute or
increase the water, sewer and other utility lines and equinment owned by the
City or any other public utility pursuant to 7-14-4115, t1.C.A.
DATED this 10th day of June, 1981.
