A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
DECLARING
IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A

BETWEEN ROUSE AVENUE AND WALLACE AVENUE IN THE CITY OF BOZEMAN, MONTANA.
WHEREAS, there has been filed with the Clerk of the City Commission
of the City of
Bozeman, Montana, an order of the City Commission to create a Special Improvement District for
the purpose of constructing and installing an asphaltic concrete type pavement, together with
integral concrete curbs and gutters and necessary appurtenances thereto, and necessary storm
drainage facilities appurtenant to such pavement; and
WHEREAS, at a regular meeting of the City Commission of the City of
Bozeman held on
the 13th day of May, 1981, the aforesaid petition was respectively considered and granted;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA:
Section One
Declaration of Intention
It is hereby declared to be the intention of the City of Bozeman to
create a Special
Improvement District to be known and designated as Special Improvement District No. 636(2) for
the purpose of constructing and installing an asphaltic concrete type pavement on Peach Street
between Rouse Avenue and Wallace Avenue, said project to include construction and installation of
integral concrete curbs and gutters and necessary appurtenances thereto,
together with necessary I
storm drainage facilities appurtenant to such paving.
Section Two
Boundaries
The boundaries of said Special Improvement District No. 636(2) are
described as follows:
Description
Paving - Peach - North Rouse to North Wallace:
Beginning at the Southwest corner of Block 119, Northern Pacific Addition
to the City of Bozeman, thence east along the southern boundary of
said
Block 119 and the southern boundary of Block 107 said Northern Pacific
Addi-
tion to theS6utheast corner thereof, thence southerly to the northeast
corner
of Block 6, Babcock and Davis Addition, thence along the south property
line
of Peach Street which is the north boundary of Block 6 and 1 of said
Babcock
and Davis Addition and the Perkins and Stone Tract to the northwest
corner of
said tract, thence northeasterly to the point of beginning and including
1403.0
feet of frontage.
Those lots fronting on the improvement and included in the
S.I.D. are Lots 17-37 inclusive in Block 107, Lots 13-24 inclusive
in Block 119
Northern Pacific Addition, the two northerly most lots of the Perkins
and Stone
Tract, the northern 60-foot portion of Lot 6, Block 1 Babcock and Davis
Addition
and the northern most properties in Block 6 said Babcock and Davis
Addition.
Section Three
C~aracter of Improvements
The character of improvements in Special Improvement District No. 636(2)
is the I
construction of an asphaltic concrete pavement with integral concrete curb and gutter, together
with storm drainage and necessary appurtenances to said construction on Peach Street between
Rouse Avenue and Wallace Avenue, said project to include construction of gravel subbase, an
asphaltic concrete type base and surface course, all necessary
excavation and backfill, and all
other work appurtenant thereto; together with all storm drainage appurtenant to said project.

Section Four
Estimate of Cost
The preliminary
estimate of cost of the improvements in Special Improvement District No.
636(2), including all construction costs, material costs, engineering,
legal administration, and
I contingency is $110,000.00.
Section Five
Method of Assessment
The cost
of said improvement is to be assessed against the entire district; each lot or
parcel of land within such district ab.ut:t:irt9 upon the improvement
will be assessed for that part of
the whole cost which its frontage bears to the frontage of the entire
district, exclusive of streets,
avenues, alleys, and public places.
The total
number of feet of frontage within the entire district is 1,406 feet which is the
frontage on which all protests will be received, considered, and determined
and on which all assess-
ments will be calculated.
Section Six
Payments
The payments
for said improvements shall be made in twenty (20) annual installments extend-
ing over a period of nineteen (19) years, but this shall not be construed
to prevent payment in full
at any regular payment date by any property owner who desires to do
so. It is proposed to pay the
entire cost and expense of the construction and installation of said
improvements with cash to be
I obtained from the sale of bonds of said Special Improvement District
No. 636(2) as authorized by law.
Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where
necessary, to be issued and chargeable against a fund to be known and designated as Special Improve-
emnt District No. 636(2) Fund of the City of Bozeman.
The bonds will be redeemable at the option of
of the City, singly or in multiples, and in the order of their registration,
whenever funds are avail-
able for the purpose of said Special Improvement District No. 636(2).
Said bonds shall draw simple
interest from the date of their registration until called for payment,
which interest shall be charge-
able as part of the cost of construction and installation of said improvement.
The bonds shall be
issued and sold in accordance with the provisions of Section 7-12-4201
and Section 7-12-4223, Montana
Code Annotated, and all other applicable provisions of Title 7, MontanaijCode
Annotated, relating to
special improvement districts in cities and towns, and any amendments
thereof or thereto.
Section Seven
Protests and Notices
The regular
session of the City Commission of the City of Bozeman, to be held at the
Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday,
the 10th day of June, 1981,
I at the hour of 1:15 o'clock p.m. of said day, is the time and place
when and where the City Commis-
sion will hear and pass upon all protests duly and regularly made and filed against the creation of
said proposed Special Improvement District No. 636(2) the improvements proposed to be made pursuant
thereto, and the extent and character thereof, or either thereof; and
the Clerk of the City Commis-
sion be, and she is hereby authorized to give notice in the manner
and for the time as by law required,
of the adoption of this Resolution of Intention.

at 1:15 o'clock I
p.m. at the Commission Room of the City Hall, Bozeman. Montana, is designated as the time and
place for hearing objections to the action proposed to construct and install an asphaltic concrete
curb and gutter. and necessary appurtenances thereto. including those appurtenances necessary to
storm drainage on Peach Street between Rouse Avenue and Wallace Avenue within the corporate limits
of the City of Bozeman, Montana. Expressions
of approval or disapproval by resident freeholders
of the territories proposed to be constructed and installed upon must be made in writing and filed
with the Clerk of the City Commission of the City of Bozeman not later than fifteen (15) days after
the date of the first publication of this notice.
A description of the boundaries of the territories proposed to be constructed
and installed
upon by said Commission Resolution No. 2327 is as follows:
