HomeMy WebLinkAboutResolution 2326 Intent to create SID 636(1) for paving Peach, Rouse to Church: 5-13-81 -... .. . -... ..- _.~ ._n ...._ __ .. .- -' 42'2 COMMISSION RESOLUTION NO. 2326 A RESOLUTION OF THE CITY COHMISSION OF THE CITY OF BOZEMAN, HONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 636(1) FOR THE PURPOSE OF CONSTRUCTING AND INSTALL- ING AN ASPHALTIC CONCRETE CURB AND GUTTER, AND NECESSARY APPURTENANCES THERETO: ALSO APPURTENANCES NECESSARY TO STORM DRAINAGE ON PEACH I STREET BETWEEN ROUSE AVENUE AND CHURCH AVENUE IN THE CITY OF BOZEMAN, ~10NT ANA. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, an order of the City Commission to create a special Improvement District for the purpose of constructing and installing an asphaltic concrete type pavement, together with integral concrete curbs and gutters and necessary appurtenances thereto, and necessary storm drainage facilities appurtenant to such pavement; and WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 13th day of May, 1981, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section One Declaration of Intention It is hereby declared to be the intention of the City of Bozeman to create a special improve- ment district to be known and designated as Special Improvement District No. 636(1) for the purpose of constructing and installing an asphaltic concrete type pavement on Peach Street between Rouse Avenue and Church Avenue, said project to include construction and installation of integral concrete curbs and gutters and necessary appurtenances thereto, together with necessary storm drainage I facilities appurtenant to such paving. Section Two Boundaries The boundaries of said Special Improvement District No. 636(1) are described as follows: Paving Peach - North Rouse to North Church Beginning at the Southwest corner of Block 119 of the Northern Pacific Addition to the City of Bozeman and proceeding east along the south boundary of said Block 119 along Peach Street to the Southwest corner of Block 107, said Northern Pacific Addition, thence southeasterly to the northwest corner of Block 6 of the Babcock and Davis Addition, thence westerly along the south right-of-way of Peach Street and the north boundary of Block I, said Babcock and Davis Addition and the Perkins and Stone Tract to the northwest corner of said tract and thence north- eastward to the point of beginning. The front footage included in this 5.1.0. would be 628 feet. Included in the frontage are Lots 13 through 24, Block 119 Northern Pacific Addition, Lot 6 Babcock and Davis Addition and the northern por- tion of the Perkins and Stone Tract adjacent to Peath Street. Section Three Character of Improvements The character of improvements in Special Improvement District No. 636(1) is the construc- tion of an asphaltic concrete pavement with integral concrete curb and gutter, together with storm drainage and necessary appurtenances to said construction on Peach Street between Rouse Avenue and I Church Avenue, said project to include construction of gravel subbase, an asphaltic concrete type base and surface course, all necessary excavation and backfill, and all other work appurtenant thereto; together with all storm drainage appurtenant to said project. COMMISSION RESOLUTION NO. 2326 ~._- ~~- ~ .~~.. . ...- -. .....~ .. - - ' -. .. ..~. . ~... ~.-............... -. -. - ~".- -.. ..--........--,r.. 423 Section Four Estimate of Cost The preliminary estimate of cost of the improvements in Special Improvement District No. 636(1), including all construction costs, material costs, engineering, legal administration, I and contingency is $55,000.00. Section Five Method of Assessment The cost of said improvement is to be assessed against the entire district; each lot or parcel of land within such district a1i"utting upon the improvement will be assessed for that part of the whole cost which its frontage bears to the frontage of the entire district, exclusive of streets, avenues, alleys and public places. The total number of feet of frontage within the entire district is 628 feet which is the frontage on which all protests will be received, considered, and determined and on which all assess- ments will be calculated. Section Six Payments The payments for said improvements shall be made in twenty (20) annual installments extend- ing over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular payment date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be I obtained from the sale of bonds of said Special Improvement District No. 636(1) as authorized by law. Such bonds will bein.denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improve- ment District No. 636(1) Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose of said Special Improvement District No. 636(1). Said bonds shall draw simple interest from the date of their registration until called for payment, which interest shall be charge- able as part of the cost of construction and installation of said improvement. The bonds will be issued and sold in accordance with the provisions of Section 7-12-4201 and Section 7-12-4223, Montana Code Annotated, and all other applicable provisions of Title 7, Montana Code Annotated, relating to special improvement districts in cities and towns, and any amendments thereof or thereto. Section Seven Protests and Notices The regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 10th day of June, 1981, I at the hour of 1:15 o'clock p.m. of said day, is the time and place, when and where the City Commis- sion will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 636(1), the improvements proposed to be made pursuant thereto, and the extent and character thereof, or either thereof; and the Clerk of the City Commis- sion be, and she is hereby authorized to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention. NOTICE IS HEREBY GIVEN that on the 13th day of May, 1981, at a regular meeting of the City of Bozeman, Montana, said Commission duly and regularly passed and adopted Commission Resolution No. 2326 entitled: A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN, MONTANA, TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 636(1) FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE CURB AND GUTTER AND NECESSARY APPURTENANCES THERETO: ALSO APPURTENANCES NECESSARY TO STORM DRAINAGE ON PEACH STREET BETWEEN ROUSE AVENUE AND CHURCH AVENUE IN THE CITY OF BOZEMAN, MONTANA. NOTICE IS HEREBY FURTHER GIVEN, that Wednesday, the 10th day of June, 1981, at 1:15 p.m. I at the Commission Room of the City Hall, Bozeman, Montana, is designated as the time and place for hearing objections to the action proposed to construct and install an asphaltic concrete curb and gutter, and necessary appurtenances thereto, including those appurtenances necessary to storm drainage on Peach Street between Rouse Avenue and Church Avenue within the corporate limits of the City of Bozeman, Montana. Expressions of approval or disapproval by resident freeholders of the territories proposed to be constructed and installed upon must be made in writing and filed with the Clerk of the City Commission of the City of Bozeman not later than fifteen (15) days after the date of the first publication of this notice. A description of the boundaries of the territories proposed to be constructed and installed upon by said Commission Resolution No. 2326 is as follows: Paving Peach - North Rouse to North Church Beginning at the Southwest corner of Block 119 of the Northern Pacific Addition to the City of Bozeman and proceeding east along the south boundary of said Block 119 along Peach Street to the Southwest corner of Block 107, said Northern Pacific Addition, thence southeasterly to the northwest corner of Block 6 of the Babcock and Davis Addition, thence westerly along the south right-of-way of Peach Street and the north boundary of Block I, said Babcock and Davis Addition and the Perkins and Stone Tract to the northwest corner of said tract and thence north- eastward to the point of beginning. The front footage included in this S.I.D. I would be 628 feet. Included in the frontage are lots 13 through 24, Block 119 Northern Pacific Addition, Lot 6 Babcock and Davis Addition and the northern portion of the Perkins and Stone Tract adjacent to Peach Street. The estimated cost of improvements is $55,000.00. This notice is given pursuant to the provisions of Section 7-12-4201 and Section 7-12-4223, Montana Code Annotated, and all other applicable provisions of Title 7, Montana Code Annotated, relat- ing to special improvement districts in cities and towns, and any amendments thereof or thereto.
