COMMISSION RESOLUTION NO. 2339
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA,
ASSURING
THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT THAT
THE CITY
OF BOZEMAN, MONTANA, INITIATES
THE REPROGRAMMING OF FEDERAL FUNDS APPLIED FOR
BY THE CITY FOR A HOUSING REHABILITATION PROGRAM AND NOW REQUIRING
AN AMEND-
MENT TO ALTER THE SCOPE OF THE PROGRAM, TO BE USED FOR AN ALTERNATIVE
LIVING
EXPERIENCE FOR DEVELOPMENTALLY DISABLED ADULTS THROUGH THE AUSPICES
OF REACH, I
INCORPORATED AND A SHELTER FOR VICTIMS OF DOMESTIC VIOLENCE, THROUGH

BOZEMAN BATTERED WOMEN'S NETWORK, VESTING THE CITY MANAGER WITH THE
RESPONSI-
BILITIES OF COORDINATING THE ACTION OF THE U. S. DEPARTMENT OF HOUSING
AND
URBAN DEVELOPMENT AND THE SUBCONTRACTED AGENCIES TO ASSURE THAT SUCH
ACQUISITION
OF PROPERTY MEETS ALL FEDERAL AND STATE REGULATIONS, ENSURING THAT
APPROPRIATE
BUDGETARY MEASURES AND PLANNED PROGRAMMING ARE CONDUCTED TO INITIATE
AND COMPLETE
SAID ACQUISITION; AND ENSURING COMPLIANCE WITH THE VARIOUS ASSURANCES
OF THE
SMALL CITIES PROGRAM AS INDICATED IN THE CITY'S A~1ENDMENT TO THE 1979
SMALL
CITIES PROGRAM TO THE DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT.
WHEREAS, it has been determined by the City Commission of the City
of Bozeman, Montana,
that the program originally designed to benefit low and moderate income
persons within the City
limits has not met with sufficient response to continue in the same
manner offering housing rehab-
ilitation benefits to such individuals; and
WHEREAS, proposals have been invited and subsequently evaluated with
Reach and the
Battered Women's Network, both incorporated, non-profit organizations
selected as the potential
recipients of available monies for the purpose of obtaining structures
suitable to their proposed
needs; and,
WHEREAS, it is intended that this amendment to the Single Purpose,
Small Cities program
will establish an amount of $125,000.00 to be awarded to Reach, Inc.
and $75,000.00 designated for
the Battered Women's Network for purchases as directed by the City
of Bozeman. The properties I
will be purchased by the City of Bozeman in accord with the regulations
of the Uniform Acquisition
Act as directed in the Department of Housing and Urban Development
Handbook. A conditional deed
will protect the intent of the acquisition to assure that Reach, Inc.
uses the dwelling for an
alternative living experience for developmentally disabled adults and
the Battered Women's Network
maintains their structure to provide a residence and to counsel victims
of domestic violence; and
WHEREAS, it is recognized that any residue funds realized from the
deletion of other
activities, etc. will be applied to any rehabilitation or expenses
related to the completion of
said projects; and
WHEREAS, the City of Bozeman, Montana, is in no way obligated or required
to provide
financial or administrative assistance for implementation of said amendment;
and
WHEREAS, the City of Bozeman, Montana, believes that providing the
conditions of this
amendment to be in the best interest of the community in providing
these facilities for the popula-
tions served;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
BOlEMAN, MONTANA,
AS FOLLOWS, to-wit:
Section 1
I
That the City Manager of the City of Bozeman, Montana, is hereby designated
as the authorized
City official to sign all federal applications or amendments for assistance
and other documents
necessary to initiate and complete the amendment process, altering
the original scope of the Small
Cities Program with the United States Department of Housing and Urban
Development.

That the City Commission of the City of Bozeman, Montana, hereby authorizes the City staff
to prepare, complete, submit and monitor the initiation, implementation
and completion of the amend-
ment process of the Department of Housing and Urban Development's Small
Cities, Single Purpose program
I for provisions of shelters for developmentally disabled adults and
victims of domestic violence.
Section 3
That the City Commission of the City of Bozeman, ~10ntana, hereby directs that its staff
prepare all necessary documents, applications and other materials which
may be necessary and required
by the United States Department of Housing and Urban Development, and
further directs its staff to
ensure that all rules, regulations and other mandates of the United
States Department of Housing and
Urban Development shall be met in accordance with the assurances submitted
in the application of the
Single Purpose Housing Rehabilitation Program and this amendment.
Section
4
That the City Commission of the City of Bozeman, Montana, hereby directs the City Manager
of the City of Bozeman, Montana, to direct the full-time program coordinator
to monitor and report to
the City Manager as to all budgetary, cost summary, audit requirements
and to conduct all other
administrative reporting necessary to direct and coordinate the amendment
procedures and subsequent
program as stated herein.

5
That the City Commission of the City of Bozeman, r10ntan~ hereby authorizes the amendment
I process and directs the usage of, residue federal funds in the amount
of approximately $250,000.00
to be utilized in completing the amended program and committing any additional residual funds to
this objective, continuing to serve persons designated as low and moderate
income.
