A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZE~1AN, MONTANA, CREATING
A SPECIAL IMPROVEMENT LIGHTING DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT
LIGHTING DISTRICT NO. 637 FOR TI:JE PURPOSE OF OPERATING. AND MAINTAINING A
LIGHTING DISTRICT TO LIGHT APORTION"OF VALLEY UNIT NO. 1 SUBDIVISION TO THE
CITY OF BOZEMAN FROM YELLOWSTONE TO F[ATHEAD AND BABCOCK NORTH TO DURSTON,
ALSO FERGUSONIFROM 191 TO BABCOCK, FALLON FROM FERGUSON TO YELLOWSTONE, AND

OF AND IN CONFORMANCE
WITH SECTION 7-12-4301 TO 7-12-4326 INCLUSIVE OF THE f1GNTANA CODE ANNOTATED.. .
WHEREAS, at a regular session of the City Commission of the City of Bozeman, Montana,
held on the 10th day of June, 1981, the said City Commission duly passed
Commission Resolution
No. 2332, declaring it to be the intention of the said City Commission
to create a special improve-

ment/ istr ct to be known as Special Improvement Lighting District
No. 637 to the said City, for
the purpose of operating and maintaining a lighting system to light
a portion of Valley Unit No.1
of Bozeman from Yellowstone to Flathead and Babcock north to Durston,
also Ferguson from 191 to
Babcock, Fallon from Ferguson to Yellowstone, and Yellowstone from
Fallon to Babcock, Gallatin
County, Montana.
The said Commission Resolution No. 2332 is hereby referred to and made a part
hereof for further particulars in respect to the boundaries of said
Special Improvement Lighting
District No. 637, and the estimated cost of said improvements and methods
of assessing the same
against the property of said district; and
WHEREAS, notice of the passage of said Commission Resolution No. 2332 was duly published,
as required by law, in the Bozeman Daily Chronicle, a daily newspaper
of general circulation printed
and published in the City of Bozeman, Montana, and by sending a copy
of such notice by U. S. Mail I
to each person, firm or corporation having property within the proposed
district at his or its
last known address, upon the same date that such notice was first published
as aforesaid, and due
proof having been made of the publication and service of said notices;
and
WHEREAS, within the time provided by law and said published and served notice, there was
not sufficient protests against the creation of said proposed Special
Improvement Lighting District
No. 637, and the City Commission was in regular session on the 8th
day of July, 1981, at 1:15 o.clock
p.m. of said day, at the Commission Chamber in the City Hall Building
in the said City of Bozeman,
Montana, and the same being the time and place designated in said notice
for passing upon all protests,
if any, against the proposed work or against the creation or extension
of said district, or both or
either; and it further appearing that all of the proceedings for the
creation of said district have
been lawful and regular;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA:
Section
1
That the said Special Improvement Lighting District No. 637 for the City of Bozeman, be,
and the same is hereby created, for the purpose of making improvements
as in said Commission Resolution
No. 2332 and hereinafter described.

2
That said special improvements be, and the same are, hereby ordered to be made in Special
Improvement Lighting District No. 637 as follows:

POWER COMPANY
UNDER AUTHORITY OF AND IN CONFORMANCE WITH SECTION 7~12-4301 TO

Section 3
That the entire cost and expense of maintaining the improvements
herein referred to in
said Special Improvement Lighting District No. 637, shall be assessed
against the entire district.
Each lot, block, tract or parcel of land within the district will be
assessed for that portion of
the whole cost which its area bears to the area of the entire district
exclusive of streets,
avenues, and public places.
The total number of feet of assessable footage within the district is
2,922,588 square feet, which is the area on which all assessments will
be calculated.
Section 4
That any and
all construction districts within the same boundaries and serving the same
area are hereby declared abandoned and terminated.
PASSED AND
ADOPTED by the City Commission of the City of Bozeman, at a regular session
held thereof on the 22nd day of July, 1981.
