'_'_ ___'.....~._ ..............~. _.~__,. u.. - .. - -, _._"."'~-- ... .-...'.- ..~ , ---. ,. _'_'_"W.._. n_ '456 COMMISSION RESOLUTION NO. 2337 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVE- MENT DISTRICT NO. 636(2) FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE CURB AND GUTTER, AND NECESSARY APPURTENANCES THERE- TO: ALSO APPURTENANCES NECESSARY TO STORM DRAINAGE ON PEACH STREET BETWEEN ROUSE AVENUE AND WALLACE AVENUE IN THE CITY OF BOZEMAN, MONTANA. I WHEREAS, at a regular session of the City Commission of the City of Bozeman, Montana, held on the 13th day of May, 1981, the said City Commission duly passed Commission Resolution No. 2327, declaring it to be the intention of the said City Commission to create a special improvement district to be known and designated as Special Improvement District No. 636(2) to the said City, for the purpose of constructing and installing an asphaltic concrete curb and gutter, and necessary appurtenances thereto, together with appurtenances necessary to storm drainage on Peach Street between Rouse Avenue and Wallace Avenue. The said Commission Resolution No. 2327 is hereby referred to and made a part hereof for further particulars in respect to the boundaries of said Special Improvement District No. 636(2), and the estimated cost of said im- provements and methods of assessing the same against the property of said district; and IdHEREAS, notice of the passage of said Commission Resolution No. 2327 was duly published as required by law, in the Bozeman Daily Chronicle, a daily newspaper of general circulation printed and published in the City of Bozeman, ~1ontana, and by sending a copy of such notice by U. S. Mail to each person, firm or corporation having property within the proposed district at his or its last known address, upon the same date that such notice was first published as afore- said, and due proof having been made of the publication and service of said notices; and I WHEREAS, within the time provided by law and said published and served notice, there was not sufficient protests against the creation of said proposed Special Improvement District No. 636(2), and the City Commission was in regular session on the 1st day of July, 1981, at 1:15 p.m. of said day, at the Commission Chamber in the City Hall Building in the said City of Bozeman, Montana, and the same being the time and place designated in said notice for passing upon all protests, if any, against the proposed work or against the creation or extension of said District, or both or either and finally heard on the 8th day of July, 1981; and it further appearing that all of the proceedings for the creation of said ~istrict have been lawful and regular; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA: Section 1 That the said Special Improvement District No. 636(2) of the City of Bozeman, be, and the same is hereby created, for the purpose of making improvements as in said Commission Resolution No. 2327 and hereinafter described. Section 2 That said special improvements be, and the same are, hereby ordered to be made in Special Improvement District No. 636(2) as follows: I A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, CREATING A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 636(2) FOR THE PURPOSE OF CONSTRUCTING AND INSTALLING AN ASPHALTIC CONCRETE CURB AND GUTTER, AND NECESSARY APPURTENANCES THERETO: ALSO APPURTENANCES NEC- ESSARY TO STORM DRAINAGE ON PEACH STREET BETWEEN ROUSE AVENUE AND WALLACE AVENUE IN THE CITY OF BOZEMAN, MONTANA. COMMISSION RESOLUTION NO. 2337 --~---- -. ~. 4'5'1 Section 3 That the entire cost and expense of maintaining the improvements herein referred to in Special Improvement District No. 636(2) shall be assessed against the entire district. Each lot, block, tract or parcel of land within the district will be assessed for that portion of the whole I cost which its area bears to the area of the entire district exclusive of streets, avenues, and public places. The total number of feet of assessable footage within the district is 1,406, which is the frontage on which all assessments will be calculated. Section 4 That any and all construction districts within the same boundaries and serving the same area are hereby declared abandoned and terminated.
