MONTANA. SANITARY SEWER SYSTEM; PROVIDING FOR M1ENDt1ENTS AND REVISIONS OF EXISTING SANITARY SEWER SYSTEM RULES AND REGULATIONS; PROVIDING FOR ENACTI1ENT OF NEW SANITARY SEWER SYSTEM RULES AND REGULATIONS; TO BECOME EFFECTIVE UPON THE APPROVAL OF SUCH RATES. CHARGE~ RULES AND REGULATIONS BY THE CITY COW1ISSION OF .. I THE CITY OF BOZEMAN. MONTANA. AND DIRECTING PUBLICATION OF NOTICE OF PUBLIC HEAR- ING. THAT A PUBLIC HEARING BE CONDUCTED. AND THAT AN ORDER ISSUE IN ACCORDANCE WITH APPLICABLE STATE STATUTES. WHEREAS. the City of Bozeman. Montana. Sewer Department. is a Public Utility as defined under M.C.A. 69-3-101 (1979); and, WHEREAS. the City of Bozeman. Montana. is compelled by the requirements of the Environmental Protection Agency of the United States Government to construct and operate certain facilities for the storage. rapid infiltration and direct discharge of sewage under the requirements of the 1972 Federal Water Pollution Control Act, as amended by the 1977 Clean Water Act; and, inasmuch as the construction schedule for such facilities have been imposed upon the City of Bozeman. Montana,by Federal Court Decrees; and. WHEREAS, a recently completed engineering study in regard to the waste water treatment facility and a sewer rate evaluation for the City of Bozeman. Montana.both project a need for increased sewage rates for construction. operation and maintenance as well as to discharge the future indebtedness affiliated with the sanitary sewer system of the City of Bozeman. Montana; and. WHEREAS. the rates and charges in effect at the present time are not adequate to provide sufficient revenues with which to accomplish the construction, operation and maintenance. and I discharge of indebtedness of said facilities, together with defraying the increased costs of opera- tion of such facilities and to comply with the rules and regulations of the Environmental Protection Agency for user charges; and WHEREAS. the construction. operation and maintenance of said improvements is essential to the immediate preservation of the public's health and which construction cannot be undertaken until the City of Bozeman has in effect rates. charges and regulations adequate to insure the funding there- of and to make compliance with the Environmental Protection Agency Rules and Regulations for federally assisted projects. and to meet the mandate of the Federal Court Decree, that such rates. charges, and regulations must. before taking effect. be approved by the municipal government of the City of Bozeman. Montana, in accordance with applicable statutes; and, WHEREAS, the proposed construction changes. operation and maintenance costs, and generation of funds sufficient to discharge present and future indebtedness require that such new rates. charges. and regulations applicable thereto. become effective prior to November 1, 1981. NOW THEREFORE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA: 1. That. in accordance with applicable State statutes and in compliance with the restrict- I ions contained therein the Mayor. City Manager, employees, and other representatives of the City of Bozeman, Montana, are hereby directed to prepare and publish such notice of public hearing as is required to be published by State statute; to conduct such public hearing as is required by State statute to be held and to do all things necessary and proper to implement a new, revised schedule of rates and charges and to publish rules and regulations applicable thereto, sufficient to generate increased annual revenues of two hundred forty-eight thousand, three hundred seventy-seven dollars COMMISSION RESOLUTION NO. 2335 - ... . - ....... -- .. .. - . . 454 ($248,377.00) which shall be adopted as the rates and charges governing the operation of the City of Bozeman, Montana Sewer Department, effective November 1, 1981 unless sooner changed, modified, cancelled or continued.
