WHEREAS, there has been filed with the Clerk of the Commission of the City of Bozeman, Montana, a petition in due form of certain owners in the western section of Bozeman from Yellowstone to Flathead and Babcock north to Durston, also Ferguson from 191 to Babcock, Fallon from Ferguson to Yellowstone, and Yellowstone from Fallon to Babcock, asking that a Special Improvement Lighting District be created for the purpose of operating and maintaining a lighting system to light a portion of Valley Unit No.1 of Bozeman from Yellowstone to Flathead and Babcock north to Durston, also Ferguson from 191 to Babcock, Fallon from Ferguson to Yellow- stone, and Yellowstone from Fallon to Babcock, Gallatin County, Montana, and; WHEREAS, at a regular meeting of the City Commission of the City of Bozeman held on the 10th day of June, 1981, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section One It is hereby declared to be the intention of the City of Bozeman to create a Special Improvement District to be known and designated as Special Improvement Lighting District No. 637 I of the City of Bozeman for the purpose of operating and maintaining a lighting system to light the western section of Bozeman from Yellowstone to Flathead and Babcock north to Durston, also Ferguson from 191 to Babcock, Fallon from Ferguson to Yellowstone, and Yellowstone from Fallon to Babcock. Section Two The boundaries of said Special Improvement Lighting District No. 637 are described as foll ows: Beginning at the Northeast corner of Section 10, Township 1 South, Range 5 East along the North section line, west a distance of 1169.90 feet to the point of beginning; thence South 00028'12" West, a distance of 2445.00 feet; thence East, a distance of 150.00 feet; thence South 00028'12" West, a distance of 269.41 feet; thence South 89052"31" East a distgnce of 5 feet; thence South 00028112" West 130 feet; thence North 89052131" West, a distance of"120.00 feet; thence South 00028112'~ West, a distance of 1625.00 feet; thence North 8905Z131" West, a distance of 1~.00 feet; thence South 00028112" West, a distance of 310.00 feet; thence North 89 52131" West, a distance of 1235.03 feet; thence South 00028112" West, a distance of 412.81 feet; thence South 89047138" vJest, a distance of 285.02 feet; thence North 00028112" East, a distance of 2824.42 feet; thence East, a distance of 680.00 feet; thence North 00028112" East, a distance of 2445.00 feet; thence East a distance of 1080.00 feet along the North section line to the point of beginning. The special improvement lighting district shall exclude the following tract of land; beginning at the northeast corner of Section 10, Township 1 South, Range 5 East along the north section line, West a distance of 1454.90 feet; thence South 00028112" West I a distance of 2843.46 feet to the point of beginning; thence South 00028112" West, a distance of 1625.00 feet; thence North 89052131" West, a distance of 930.00 feet; thence North 00028112" East, a distance of 1625.00 feet; thence South 89052131" East, a distance of 930.00 feet to the point of beginning. A. 17 - 200 watt, High Pressure Sodium Luminaries mounted on 35 foot steel poles and 69 - 100 Watt, High Pressure Sodium Luminaries mounted on steel poles, all units I served by underground conductors (temporary overhead feeders will be installed with future removal to take place when underground distribution permits). B. COST PER UNIT PER MONTH: 200 Watt Units - $18.40; 100 Watt Units - $17.45. C. TOTAL COST PER MONTH: $1, 516. 85. D. The above costs reflect no city administrative charge. E. Charges are based upon current applicable rate SL-80P, which is subject to revision by the Montana Public Service Commission. Section Four Estimated Cost of Maintenance and Electrical Current The cost of maintaining such improvement is to be assessed against the entire district; each lot or parcel of land within such district will be assessed for that part of the whole cost which its area bears to the total area within the district. The total area within the district is 2,922,588 square feet and is the area on which all protests will be received, considered, and determined, and on which all assessments will be calculated. Section Five I Protests and Notices The regular session of the City Commission of the City of Bozeman to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday the 8th day of July, 1981, at the hour of 1:15 o'clock p.m. of said day, is the time and place where and when the City Commission will hear and pass upon all protests duly and regularly made and filed against the COMMISSION RESOLUTION NO. 2332 -~,- ..-- .._..--~ ...--,.- . -'~ ---~.- ._-_.,~~.~ - --'.. ~ .'. Expressions of approval or disapproval by resident freeholders of the territories proposed to be operated and maintained upon must be made in writing and filed with the Clerk of the City Commission of the City of Bozeman not later than fif- teen (15) days after the date of the first publication of this notice. The total area within the district is 2,922,588 square feet and is the footage on which all protests will be received, considered, and determined, and on which all assessments will be calculated. Section 4 This notice is given pursuant to the provisions of Section 7-12-4301 to 7-12-4326, Montana Code Annotated,*relating to special improvement districts for cities and towns, and any amendments thereof or thereto.
