Present were Mayor Sean Becker, Deputy Mayor Jeff Krauss, Commissioner Cyndy Andrus, Commissioner Chris Mehl, Commissioner Carson Taylor, City Manager Chris Kukulski,Assistant City Manager Chuck Winn, Finance Director Anna Rosenberry, City Attorney Greg Sullivan, and City Clerk Stacy Ulmen. *These minutes are not word for word and should be considered along with the audio recording. 0:20:20 A. Call to Order—6 p.m. —Commission Room, City Hall, 121 North Rouse Mayor Becker called the meeting to order at 6:04 p.m. 0:20:38 B. Pledge of Allegiance and a Moment of Silence 0:21:18 C. Changes to the Agenda Mayor Becker asked City Manager Chris Kukulski if there were any changes to the Agenda. Mr. Kukulski stated no. 0:21:25 D. Minutes—April 2,2012 Motion and Vote to approve the minutes of April 2, 2012 as submitted. It was moved by Cr. Taylor, seconded by Cr. Andrus to approve the minutes of April 2, 2012 as submitted. Those voting Ave being Crs. Taylor, Andrus,Deputy Mayor Krauss, Cr. Mehl and Mayor Becker. Those votine No being none. The motion passed 5-0. 0:21:42 E. Consent 1. Authorize Payment of Accounts Payable Claims (LaMeres) 2. Authorize City Manager to sign Montana Department of Transportation and City of Bozeman Signal Agreement for a five year period (Arkell) 3. Accept the Building Division Monthly Report for March, 2012 (Risk) 4. Approve Justice Assistance Grant Application to the Bureau of Justice in the amount of $15,498 and authorize City Manager to sign the Memorandum of Agreement with Gallatin County allocating use of those funds (Price) 6. Approve Resolution No.4375, Setting Fees for the Bozeman City Hall Community Gardens (Bristor) 7. Approve Mayoral Proclamation for Loyalty Day on May 1st, 2012 (Kissel) 8. Finally Adopt Ordinance No. 1821, authorizing the City Manager to sign a purchase and sale agreement transferring ownership of the Story Mansion property to Exergy Friends of the Story Mansion, authorizing the granting of a pedestrian easement across Story Park, authorizing placement of restrictive covenants on the Story Park, and authorizing the signing of reciprocal Rights of First Offer(Sullivan) 0:21:47 Public Comment Mayor Becker opened public comment. No person commented. Mayor Becker closed public comment. 0:22:09 Motion and Vote to approve Consent Items 1-8 as submitted. It was moved by Cr. Andrus, seconded by Deputy Mayor Krauss to approve Consent Items 1-8 as submitted. Those voting Aye being Cr. Andrus, Deputy Mayor Krauss, Crs. Mehl, Taylor and Mayor Becker. Those voting No being none. The motion passed 5-0. 0:22:32 F. Public Comment Mayor Becker opened general public comment. 0:22:53 Jody Sanford, Public Comment Ms. Sanford of 818 South 6th spoke regarding her concern of the road closure on 6th Avenue. Her concern is the lack of noticing. 0:26:56 Claire Baker, Public Comment Ms. Baker of 807 South 6th spoke regarding the street closure at South 6th. 0:27:54 M_ artin Johnson, Public Comment Mr. Johnson of 416 South 6th stated that he supports the partial closure at South 6th. He spoke regarding speed zones around Cooper Park. 0:29:40 Heather Musamen,Public Comment Ms. Musamen of 910 South 6t11 asked that the partial closure not be taken down during construction. 0:3 0:14 Ann Willis, Public Comment Ms. Willis of 902 South 6th asked that the partial closure not be taken down. Mayoral Proclamation—Loyalty Day, May 1, 2012 Mayor Becker read a Mayoral Proclamation for Loyalty Day on May 1, 2012. 0:32:59 H. Special Presentation—Mandeville Parcels Land Planning Project (Wayne Freeman, CTA Architects Engineers) Mr. Freeman gave an update on the Mandeville Parcels Land Planning Projects. 0:39:48 I. Action Items 0:39:50 1. Presentation on Fluoridation of Bozeman's Drinking Water(Gallatin City- County Health Officer Matt Kelly) (10 minutes) and Possible Decision to Repeal Resolution 741 (July 1, 1953) to Stop Fluoridation of Bozeman's Water(Arkell) Mayor Becker opened the session by emphasizing the decorum structure for the evening. 0:41:53 Greg Sullivan, City Attorney Mr. Sullivan spoke regarding the recommendation as listed in the staff report. 0:43:58 Rick Moroney, Water Treatment Plan Superintendent Mr. Moroney spoke regarding the mechanics and processes of adding fluoridation into the City's water supply. 1:03:06 Commission Questions for Staff The Commission spoke regarding standards. 1:05:05 Matt Kelly, Gallatin County Health Officer. Mr. Kelly spoke regarding scientific evidence and data, safety and costs, economic impacts and oral health. 1:22:05 Public Comment Mayor Becker opened public comment. 62 people spoke regarding fluoride. The statements for and against were generally split in half. Please refer to the audio portion of these minutes to hear the statements made by the public on this matter. 4:05:35 Public Comment Closed Mayor Becker closed public comment. 4:05:50 Commission Discussion The Commission discussed scientific reasoning,the federal recommendations, carefully monitoring and adjusting to standards, costs savings, reduction of tooth decay, effectiveness, safety, health risks, adjustment of standards, evidence,the passion of the public comment, trying to do what is best for Bozeman, choice, going with the likely things that help public health, clarity, what defines Bozeman as a City and the value of approaching issue humbly. Page 3 of 4 Minutes of the Bozeman City Commission,April 23,2012 4:27:42 Meeting extended to 1.0:30 p.m. Mayor Becker extended the meeting to 10:30 p.m. 4.36:39 Commission discussion continued The Commission continued to discuss their opinions including testing downstream and the need to listen to professionals. 4:43:37 Meeting extended to I I p.m. Mayor Becker extended the meeting to 11 p.m. 4:43:44 Commission discussion continued The Commission continued to discuss benefits outweighing risks, monitoring efforts by the City, weighing public safety, health and welfare and decisions based upon those factors and evidence. 4:53:06 No Action Taken The Commission did not take action on this subject. Therefore Resolution No. 741 remains in place. 4:53:45 Action Item closed Mayor Becker closed the action item. 4:53:47 J. FYI/Discussion 1. The Commission does not meet the fifth Monday of the month. The Commission will not meet next week as it is a fifth Monday of the month. 4:54:59 K.
