HomeMy WebLinkAboutResolution No. 4380, Stormwater Rates Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Chuck Winn, Assistant City Manager SUBJECT: Resolution No. 4380 – Stormwater Rates MEETING DATE: June 11, 2012 AGENDA ITEM TYPE: Action RECOMMENDATION: Adopt Resolution No. 4380 which establishes stormwater rates effective on the September 2012 and September 2013 water bills. BACKGROUND: The City Commission is considering adopting Ordinance 1831 which would create a stormwater utility. Attached is Resolution 4380 that adopts stormwater rates for the next two years. FISCAL EFFECTS: These rates are estimated to generate $225,000 in FY13, and $236,000 in FY14 to fund the operations of the new stormwater utility. Stormwater charges are based on the meter size of the water customer. The typical water customer will see a monthly stormwater charge of $1.67 in FY13 and $1.75 in FY14, based on a 5/8” water meter. Report compiled on May 30, 2012 Attachments: Resolution No. 4380 444 1 of 3 COMMISSION RESOLUTION NO. 4380 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, ESTABLISHING RATES FOR STORMWATER SERVICE FOR THE CITY OF BOZEMAN. WHEREAS, the City Commission of the City of Bozeman, has created a Stormwater Utility by the adoption of Ordinance No. 1831, and WHEREAS, following notice and public hearing, the amounts outlined below are to be charged to all metered City water customers, and deposited to the City of Bozeman’s Storm water Fund. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that the rates for stormwater services, billed on a monthly basis shall become effective August 1, 2012 as follows, to wit: Section 1 – Metered Customers Water Meter Size Stormwater Service Charge, Bills Due September 2012 Stormwater Service Charge, Bills Due September 2013 5/8" $ 1.67 $ 1.75 1" $ 2.21 $ 2.32 1 1/2" $ 3.48 $ 3.65 2" $ 5.06 $ 5.31 3" $ 8.74 $ 9.18 4" $ 14.02 $ 14.72 6" $ 26.12 $ 27.43 8" $ 41.30 $ 43.37 Section 2 – Unmetered Customers Customers and properties without water meters will not be charged for stormwater services. 445 Resolution No. 4380, Establishing Rates for Storm Water Service 2 of 3 Section 4 – Low Income Rate Assistance Customers who apply for and qualify under the State’s Low Income Property Tax Assistance Program, as set forth in Section 15-6-134 MCA, will receive a credit equal to their monthly stormwater service charge listed above. Section 5 – Billing Procedures Charges for stormwater services under this schedule shall be made a part of the current monthly water bill, to be shown by separate item on such bill. Separate payment of either the charge for the water, wastewater, or stormwater service will not be accepted without prior approval of the Director of Finance. Charges for stormwater service become due and payable upon receipt of the bill. If any bill is not paid on or before the fifteenth day of that month, it will then become delinquent; and if not paid in full by the fifteenth day of the following month, water service to the premises involved may be discontinued (shut-off), after a ten-day written notice. A charge of twenty five dollars ($25.00) shall be made for any account requiring written shut-off notice. An additional charge of twenty-five dollars ($25.00) during regular business hours or seventy-five dollars ($75.00) during non-business hours shall be made for reinstating a water service which has been discontinued for non-payment of water, wastewater and/or stormwater service charges. Section 7 – Late Fee For those accounts that become delinquent, a 1.5 percent (1.5%) late fee will be assessed on the next bill. The minimum late fee shall be $1.00. Section 8 – Protests In cases where stormwater service charges under this schedule are claimed to be unfair, unreasonable, or not in proportion to charges made to other stormwater customers, the person or persons against whom such charges are made may apply to the City Manager for an adjustment, stating the circumstances. The City Manager, or his designated representative, may make such adjustment of the stormwater charges as is deemed necessary, fair and equitable. 446 Resolution No. 4380, Establishing Rates for Storm Water Service 3 of 3 PASSED AND APPROVED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 11th day of June, 2012; and effective beginning with the September 2012 utility billing. _____________________________ SEAN A.
