HomeMy WebLinkAboutResolution 2344 Intent to create SID 640 for water main: 11-25-81 _._._m.. ._.._...._ _..u_.. _ .~.._~ ~__. . . ~... ~___~_.____. .._'_--.-_ . _ _.. _ ~ _ .. 473 COMMISSION RESOLUTION NO. 2344 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, DECLARING IT TO BE THE INTENTION OF THE CITY OF BOZEMAN TO CREATE A SPECIAL IMPROVEMENT DISTRICT TO BE KNOWN AS SPECIAL IMPROVEMENT DISTRICT NO. 640 FOR THE PURPOSE OF CONSTRUCTION AND INSTALLATION OF A WATER ~.1AIN AND APPURTENANCES TO SERVE THE ADJOINING PROPERTIES AND MORE SPECIFICALLY DESCRIBED AS FOLLOWS: A SIX I (6) INCH WATER MAIN AND APPURTENANCES IN BRIDGER CENTER SUBDIVISION IN THE CITY OF BOZEMAN, MONTANA. THE CONSTRUCTION AND INSTALLATION OF THE WATER MAIN TO INCLUDE ALL TRENCH EXCAVATION AND BACKFILL, BEDDING MATERIAL, DUCTILE WATER MAIN, VALVES, FITTINGS, HYDRANTS, SERVICE LINE STUBS, AND OTHER NECESSARY APPURTENANCES. WHEREAS, there has been filed with the Clerk of the City Commission of the City of Bozeman, Montana, a petition in due form of certain owners in properties situated within the boundaries of Special Improvement District No. 640 as hereinafter more specifically described, aSking that a special improvement district be created for the purpose of constructing and installing water mains to provide water service to lots within the district; and WHEREAS, that at a regular meeting of the City Commission of the City of Bozeman held on the 25th day of November, 1981, the aforesaid petition was respectively considered and granted; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN: Section 1 Declaration of Intention That it is hereby declared to be the intention of the City of Bozeman to create a special improvement district to be known and designated as Special Improvement District No. 640 of the I City of Bozeman for the purpose of constructing and installing water mains, said project to include all appurtenant work for the construction and installation of water mains to provide water service to all lots within the district. Section 2 Boundaries The boundaries of said Special Improvement District No. 640 are described as follows: Descri pti on A tract of land being Certificate of Survey No. 27; and Block 2; Lots lA, 1B, 2, 3, 4 and 5, Block 3, Bridger Center Subdivision; and Lots 1, 2, 3, 4 and 5, Block 1 of the Rearrangement of Block 1, Bridger Center Subdivision, located in the Southeast One-quarter, Section Thirty-One, Township One South, Range Six East, Montana Principal Meridian, City of Bozeman, Gallatin County, Montana; being further described as follows: Commencing at the East One-sixteenth cornsr of the Southeast One-quarter of said Section Thirty-one. Thence South 88 35'1211 West, on the basis of bearing of Bridger Center Subdivision along the East/West centerline of said Southeast One-quarter, a distance of 1786.80 feet to the True Point of Beginning. Thence South 00045' East along the East line of Bridger Center Subdivision, a distance of 668.27 feet to the Southeasterly corner of said Block 2, said point being on the Northwest right-of-way line of Bridger Drive. Thence South 50050' West along the Northwest right-of-way line of Bridger Drive, a distance of I 376.49 feet to the Southwesterly corner of Lot 5 of said Block 3. Thence North 61 47' West along the Southwesterly line of Bridger Center Subdivision, a distance of 255.20 feet. Thence South 42044'5211 West along the Southerly line of Certificate of Survey No. 27 and on the basis of bearing of Certificate of Survey No. 27, a distance of 212.23 feet to the East bank of the East Gallatin River and following the said East bank of the East Gallatin River through the following courses: Thence North 07010'2911 West a distance of 63.36 feet to witness corner. Thence continuing on a distance of 50.04 feet. Thence North 43015'5411 East a distance of 202.95 feet. Thence North 010 53'5411 West, a distance of 188.86 feet. Thence North 34046'2111 West, a distance of 96.17 feet. Thene:e North 78022'0611 West, a distance of 171.86 feet. Thence North 48041'48" West, a distance of 97.72 feet to a witness corner. Thence North 87026150" East, a distance of 160.31 feet to a found steel rod, being the Northeast corner of said Certificate of Survey No. 27. Thence North 88035112" on the basis of bearings of Bridger Center Subdivision and along the East/West centerline of said Southeast One-quarter, a dista~ce of 680.30 feet to the True Point of Beginning, according to the recorded plat and Certificate of Survey. Said tract being 12.913 acres. I Section 3 Character of Improvements The Character of the improvements to be made is the installation and construction of a six (6) inch main, including trench excavation and backfill, bedding material, ductile iron water mains, valves, hydrants and fittings, copper service lines and fittings, and other necessary appurtenances thereto. Section 4 Estimate of Cost The total estimated cost of the improvements within the district including engineering, legal and contingency is $94,000.00. Section 5 Method of Assessment The cost of such improvement is to be assessed against the entire district. Each lot, block, tract or parcel of Jand within the district will be assessed for that portion of the whole cost which its area bears to the area of the entire distrcrct exclusive of streets, avenues, alleys and public places. I The total actual assessable area within the entire district is 562,490.28 square feet and is the area on which all protests will be recieved, considered, and determined. It is also the area on which all assessments will be figure. Section 6 Payments The payments for said improvements shall be made in twenty (20) annual installments extending over a period of nineteen (19) years, but this shall not be construed to prevent payment in full at any regular date by any property owner who desires to do so. It is proposed to pay the entire cost and expense of the construction and installation of said improvements with cash to be obtained from the sale of bonds of said Special Improvement District No. 640 as authorized by law. Such bonds will be in denominations of $100.00 each, and fractions or multiples of $100.00 where necessary, to be issued and chargeable against a fund to be known and designated as Special Improvement District No. 640 Fund of the City of Bozeman. The bonds will be redeemable at the option of the City, singly or in multiples, and in the order of their registration, whenever funds are available for the purpose of said Special Improvement District No. 640. Such bonds shall draw a simple interest from the date I of their registration until called for payment, which interest shall be chargeable as part of the cost of construction and installation of said improvements. The bonds will be issued and sold in accordance with the provisions of Section 11=2232 and Section 11-2271, Revised Codes of Montana, 1947, relating to Special Improvement Districts in cities and towns, and any amendments thereof or thereto. ._,._,. .-,.- . CQ!tfl1J?S ION_R~~9LUTION_NO.. 234!L~_" .... .. ~ ._.~--_.- 4'75 Section 7 Protests and Notices That the regular session of the City Commission of the City of Bozeman, to be held at the Commission Chamber, City Hall Building, Bozeman, Montana, on Wednesday, the 6th day of January, I 1982, at the hour of 1:15 o'clock p.m. of said day is the time and place, when and where the City Commission will hear and pass upon all protests duly and regularly made and filed against the creation of said proposed Special Improvement District No. 640 the improvements proposed to be made pursuant thereto and the extent and character thereof, or either thereof; and the Clerk of the City Commission be, and she is hereby directed to give notice in the manner and for the time as by law required, of the adoption of this Resolution of Intention.
