HomeMy WebLinkAboutApprove applicant’s request of an extension for th_4.pdf Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Doug Riley, Associate Planner Tim McHarg, Planning Director SUBJECT: Christenot Annexation #A-11001 – Extension Request MEETING DATE: May 14, 2012 AGENDA ITEM TYPE: Consent RECOMMENDATION: The City Commission grant the applicant’s request of an extension for the execution of the Christenot Annexation Agreement for an additional 6 months or to coincide with the required execution date of the pending adjacent Leep Annexation. RECOMMENDED MOTION: Approval of the applicant’s request of an extension for the execution of the Christenot Annexation Agreement for an additional 6 months or to coincide with the required execution date of the pending adjacent Leep Annexation. BACKGROUND: The Christenot Annexation was approved by the City Commission on November 28th, 2011. The conditions of approval required “that the applicant executes all contingencies and terms of said Annexation Agreement with the City of Bozeman within six (6) months of the City Commission action to annex the property, or annexation approval shall be null and void.” The six month expiration date is May 28th, 2012. Subsequent to the Christenot Annexation, the same representatives on the Christenot Annexation have worked with the adjacent property owner to the west and have submitted an annexation application for that property that is currently proceeding through the review process and will be on the City Commission’s May 21, 2012 agenda. As part of that application, the applicants will also be asking for a six (6) month duration to complete those terms of annexation. Therefore, attached is the representative’s request for an extension of the Christenot Annexation expiration date in order to coordinate the annexation of the two projects. Staff is fully supportive of this request as the two properties are logically tied together for future potential development. The City annexation policy (Policy #11) that sets the standard expiration time for annexations reads as follows: “Annexation agreements shall be executed and returned to the City within 60 days of distribution of the annexation agreement, unless another time period is specifically identified by the City Commission” (underling added). 14 ALTERNATIVES: Deny the extension request in order that the expiration date to complete the Christenot Annexation agreement remains May 28, 2012.
