SUBJECT: Request to Reclaim Jurisdiction of a Conditional Use Permit, Certificate of
Appropriateness application #Z-12043, to allow an addition and expansion of
an auto repair and sales business at 1401 East Main Street, zoned B-2
(Community Business District).
MEETING DATE: April 9, 2012

RECOMMENDATION: Staff recommends the City Commission reclaim jurisdiction based on
the inability of the BOA to assemble a quorum to hear the application at their next available
meeting.
RECOMMENDED MOTION: I move to reclaim jurisdiction of the Auto Stop Conditional Use
Permit, Certificate of Appropriateness application #Z-12043.
BACKGROUND: Property owners Randy Wild, Auto Stop, 1401 East Main St., Bozeman, MT
59715 and representatives, Kirk Michels Architects, 409 East Callendar Street, Livingston, MT
59407 submitted a Conditional Use Permit, Certificate of Appropriateness application, to allow an
addition and expansion of an auto repair and sales business at 1401 East Main Street.
Staff understands that a quorum of the Board of Adjustment is not anticipated in the near future.
Staff therefore requests the Commission reclaim jurisdiction of the application to be heard at their
regularly scheduled May 14, 2012 meeting in order to provide the property owner with timely review
of the application.
UNRESOLVED ISSUES: None at this time.
ALTERNATIVES: The City Commission is the applicable review body if there is not a quorum
of Board of Adjustment membership. The City has statutory obligations to process zoning
applications in timely manner.
FISCAL EFFECTS: None at this time.
