Black & E. Mendenhall, Bozeman, MT Phase I Environmental Site Assessment Report 1.0 EXECUTIVE SUMMARY Phoenix Engineering was retained by the City of Bozeman to perform a Phase I Environmental Site Assessment (ESA) for the City of Bozeman Carnegie Parcels (subject property), located at the southeast corner of North Black Avenue and East Mendenhall Street, Bozeman, Gallatin County, Montana. The purpose of the Phase I ESA is to attempt to identify present or past environmentally contaminating activities on or near the subject property, and to evaluate the potential for such activities to impact soil, ground water, or surface water. While it is not a specific requirement of the American Society for Testing and Materials (ASTM) Standard Practice for Environmental Site Assessments (ASTM E 1527-05), Phoenix Engineering has also endeavored to identify and discuss additional health, safety and building construction issues that are discovered during the site inspection. Key Phase I ESA Environmental Findings of this assessment include: • Based upon the historical research conducted for this Phase I ESA, there is ample evidence that a public motor vehicle fueling facility existed on Parcel II of the subject property at 106 East Mendenhall from 1942 until 1976 when the property was sold by Arnold and Edith Doig to the City of Bozeman. Unfortunately,none of the historical research was able to document what demolition activities took place on site after the automotive service and gas station business closed down. There are no records documenting if the building, fueling equipment and tanks were present on site when the property was sold to the city. Since the gas station closed down in 1976,which was 10 years prior to the federally mandated underground storage tank registration requirement for tank owners, there are no state or federal records of the tanks that were used on site. At this juncture there are several possible site conditions and related environmental risks that may exist regarding the underground storage of fuels on this subject property. While the environmental risk may range from none to fairly high levels the crux of the problem essentially lies with determining if underground fuel storage tanks still exist in the northern portion of the subject property. At this time,without further input from the former property owners (Doig Family) or from any former City employee who may have been directly involved in the removal of the tanks, the best way to determine whether underground tanks are still present is to undertake an on-site field investigation that consists of ground- penetrating radar (GPR) and metal detection. Since the location of the former service station is fairly well documented with the Sanborn Maps and the Gallatin County Tribune newspaper photograph, the investigative area can be limited to just Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 2 Parcel II. The utilization of these two technologies to conduct the investigation will preserve the condition of the asphalt parking lot and surrounding landscaping. If potential tank locations are found, then a backhoe can be used to confirm the presence of underground tanks. It is expected that the tanks were fabricated of steel and the tops of the tanks would not be buried more than two feet below the ground surface, unless the City brought in additional fill prior to constructing the existing parking lot. If old tanks are discovered then they must be removed in accordance with Montana DEQ regulations. • Based upon our review of the federal and state standard environmental record sources and our site inspection, it was determined that none of the adjacent or upgradient properties currently have impacted or are expected to have a negative impact upon the environmental status of the subject property. Key Additional Non-Scope Services Findings of this assessment include: • The pole-mounted electrical transformers and the wooden utility pole located in the alley near the southwestern corner of the property should be monitored. The pole- mounted transformers appeared to be in good condition with no sign of leaks. However, it is recommended that a regular visual inspection of the transformers be completed so that NorthWestern Energy can be notified in the event an oil leak possibly containing polychlorinated biphenyls (PCBs) is discovered and the leak can be repaired or the transformer replaced. Similarly, the newer wooden utility pole is suspected of being treated with pentachlorophenol or creosote. This wood treatment compound has oozed out from the base of the pole and seeped into the soil surrounding the pole. Handling of treated wood or contaminated soil is not advised- particularly for children These key findings should be used in conjunction with the full text of this ESA Report. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 3 2.0 INTRODUCTION The purpose of the Phase I Environmental Site Assessment is to attempt to identify present or past recognized environmental conditions' on or near the City of Bozeman Carnegie Parcels (subject property), and to evaluate the potential for such activities to impact soil, ground water, or surface water. The Phase I ESA was conducted in accordance with the American Society for Testing and Materials (ASTM) Standard Practice for Environmental Site Assessments (ASTM E 1527-05). While it is outside of the scope of the ASTM Standard, Phoenix Engineering has also endeavored to identify and discuss additional health, safety and building construction issues that are discovered during the site reconnaissance. The scope of work for this project consisted of the following: 1. Performing a site reconnaissance for recognized environmental conditions; 2. To the extent reasonably ascertainable, conducting an extensive search of federal state and local standard environmental records sources in an effort to determine whether any agencies have identified known or suspected environmental impairments at the subject property, or in the vicinity of the subject property; 3. Reviewing standard physical setting sources to determine geologic,hydrogeologic or soil conditions of the subject site; 4. Reviewing standard historical sources, which may include aerial photographs, recorded land title records, and fire insurance maps; 5. Interviewing current and past owners or occupants of the subject site; 6. Evaluating the potential for hazardous substances to migrate onto the subject site from off-site sources; 7. Evaluating the potential for hazardous substances to impact the soil and ground water from on-site activities; 8. Providing a written report detailing our findings and recommendations for possible Phase II sampling and analyses. 1"Recognized Environmental Conditions-The presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release,a past release,or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground,ground water,or surface water of the property. The term is not intended to include de minimis conditions that generally do not present a threat to human health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies." ASTM E1527-05 Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 4 3.0 SITE DESCRIPTION 3.1 Location and Legal Description The subject property consists of three parcels of land located within the City of Bozeman Central Business Zoning District (B-3), the Downtown Business Improvement District (BID) and the Downtown Tax Increment District (TID). The property is also within the City of Bozeman Historic Conservation Overlay District. The properties immediately to the south across the alley are in the Main Street Historic Preservation District. The latitude and longitude coordinates of the center of the property are approximately 45 040'48.5"N 111 002'07"W. The subject property is located within the SE1/4 NW1/4 Section 7, Township 2 South, Range 6 East, Principal Meridian, Montana. The detailed legal description of the subject property as documented in the Commitment for Title Insurance as prepared by Security Title Company (Order G111173) is as follows: Parcel I: The South 71 feet 11 inches of Lots 18, 19, 20, 21 and 22 in Block"E" of the Original Townsite of Bozeman, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder of Gallatin County, Montana. Parcel II: The North 78 feet 1 inch of Lots Eighteen (18), Nineteen (19), Twenty (20), Twenty-one (21) and Twenty-two (22) in Block"E" of the Original Townsite of Bozeman, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder of Gallatin County, Montana. Parcel III: Lot 17-A of the Amended Subdivision Plat of Lots 15, 16 and 17 in Block E of the Original Plat of Bozeman, City of Bozeman, Gallatin County, Montana, according to the official plat thereof on file and of record in the office of the County Clerk and Recorder of Gallatin County, Montana. Note: Historical records document that Parcel I consisting of the south 71 feet 11 inches of Lots 18, 19, 20, 21 and 22 was considered to be two parcels. For clarity within this Phase I ESA Report the following nomenclature will be used to help designate which portion of Parcel I is being discussed. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 5 Parcel IA: South 71 feet 11 inches of Lots 20, 21 and 22. This Parcel contained a two story building referred to as 16 N Grand Ave. and later as 28 N Grand Ave. The history of this parcel and building was traced back to 1906. The Montana Department of Revenue has assigned this parcel a Geocode of 06-0799-07-2-12-39- 0000. Parcel IB: South 71 feet 11 inches of Lots 18, 19. This Parcel contained a two story building referred to as 16 1/2 N Grand Ave. The Montana Department of Revenue has assigned this parcel a Geocode of 06-0799-07-2-12-42-0000. 3.2 Site and Vicinity Characteristics The subject property is situated at the southeast corner of the intersection of N. Black Ave. and E. Mendenhall St. (see Appendix A, Figures 1 -3). The subject property is located within a half block of Main Street, in the heart of Bozeman's downtown retail and commercial district. Businesses are diverse and include banks, restaurants, art galleries,hardware,hunting, and sporting retail stores, gift shops and other miscellaneous retail stores. 3.3 Present Uses of Subject Property The entire subject property has been utilized as a parking lot since 1979,when the City awarded the contract to grade, landscape and pave the property in its current configuration. 3.4 USGS Topographic Map A current United States Geological Survey (USGS) 7.5 minute topographic quadrangle map (Bozeman, Montana, photorevised 1987) was reviewed. The elevation of the subject property is approximately 4,815 feet above sea level. Surface contours in this portion of the Gallatin Valley run primarily east-west. The topography of the subject property and the surrounding neighborhoods is essentially flat, sloping gently to the north. Bozeman Creek is the nearest surface water feature to the subject property and is located approximately 1/10 of a mile to the east. Bozeman Creek originates in the mountains south of Bozeman and flows in a northerly direction. As the creek flows Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 6 directly under a portion of Main St. and some of the downtown buildings in the 300 block of East Main St., it is contained by riprap and culverts. Bozeman Creek flows north along N. Rouse Ave. and at approximately 1-1/2 miles north of the subject property, Bozeman Creek joins with Rocky Creek to form the East Gallatin River. While commercial and light industrial businesses are concentrated along the primary arterial entrance corridors the majority of the properties outside of the four to six block downtown business zone are residential. The Montana State University campus is located approximately one mile to the southwest. 3.5 Local Ground Water and Soil Information Based upon our review of topographic contours, surface water flow, the Montana Bureau of Mines and Geology (MBMG) online ground water database and ground water investigative work conducted by Phoenix Engineering on other nearby properties, it is believed that the local ground water table is between fifteen and twenty five feet below ground surface (bgs) and ground water flows in a predominantly northerly direction beneath the subject property. Soil Types Information regarding the soil types and textures classified by the Natural Resources Conservation Service (NRCS) was obtained from an electronic database provided by the Gallatin County NRCS office. The NRCS classifies the soils on the subject property as Urban Land due to the extensive development; therefore no detailed native soil descriptions are available. 4.0 INFORMATION FROM SITE RECONNAISSANCE 4.1 Site Reconnaissance A site reconnaissance was performed on September 25, 2011 by Tim Marcinko of Phoenix Engineering. The site visit entailed inspecting and photographing significant features upon the subject property and surrounding properties (see Appendix B, Photographs). During the site reconnaissance, the weather conditions were sunny with temperatures in the low eighties and the ground surfaces were dry. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 7 4.2 City of Bozeman Carnegie Parcels The top level of the Bridger Park Garage located across N. Black Ave. was accessed to take a collection of photographs of the subject property and the surrounding properties. Since it was a Sunday afternoon, there were very few vehicles in the parking lot,which allowed for a thorough inspection of the land surface. The land surface is primarily covered with asphalt pavement. The pavement is in good condition and the normal expansion cracks appeared to have been sealed earlier in the year. As is common with parking lots, there were numerous stained locations were parked vehicles over a long period of time had leaked de minimis amounts of used engine oil and in some cases radiator fluid. There were no signs that a large release of petroleum fluids had occurred on the property surface. The northern and western perimeters around the parking lot contain a small amount of landscaping of grass with deciduous trees on the north and mature coniferous trees on the west in a slightly elevated area containing a public bench. The eastern edge of the property abuts to the landscaped yard of the law firm,which was formerly the Carnegie Library. The southern edge of the property is not clearly defined and melds with the alley. In the southwest corner of the property adjacent to the alley, a garbage dumpster and a bin for the collection of cardboard were stored. There was no evidence of a release of hazardous materials near these containers. Along the alley are two wooden utility poles. It appears that the older pole was decommissioned and all of the aboveground utility equipment was transferred to the newer wooden pole. As is common practice with the utility companies, it appeared that the lower several feet of the new pole had been treated with a wood preservative. Over time, excess preservative had slightly oozed out and run down the pole and has stained the soil immediately surrounding the pole. Two electrical transformers are mounted on the newer utility pole. The transformers appeared to be in good condition with no signs of leaks. An abandoned electrical meter base box was noted extending from the ground just west of the utility poles. 4.3 Neighboring Properties and Features The subject property is located within the Downtown Business District and is surrounded by properties containing commercial retail buildings and associated parking areas. There was no evidence of any business activity or operation on the neighboring properties that would have a negative impact on the environmental conditions on the subject property. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 8 5.0 INTERVIEWS Present and past uses of the subject property were determined through telephone interviews with the City Parking operations manager and the local sanitarian. 5.1 City Parking Manager Interview Two interviews were conducted with Paul Burns, City of Bozeman Parking Manager. During the first discussion, Mr. Burns had been asked to determine who at the City might be the best point person who could answer questions related to the historical and environmental conditions of the Carnegie Parcels. It was determined that based upon his work experience with the city that Mr. Burns was one of the more qualified city employees able to answer questions regarding this property. The following information was provided by Mr. Burns during the second interview: Mr. Burns did not have any knowledge of the condition of the properties when Parcels I and II were transferred to the city in 1976. He had no knowledge on when previous buildings may have been torn down. He had no knowledge regarding the removal of any fuel storage tanks that were associated with the Warwood and Doig Chevron Service Station. The city has always used this site as a parking lot with a total of 71 available spaces. He was not aware if the lot has ever been repaved,but it is crack sealed every 3 years and the lines are painted every year. He has not ever encountered any unknown liquids or suspicious waste material spilled on the property. He had no knowledge of fill dirt ever being brought onto the property that originated from a contaminated site or that was of an unknown origin. The only herbicide or pesticide used on the small areas of lawn is Roundup,which is used in a hand application sprayer for weed control. He is not aware of any burned or buried drums of liquid material, petroleum products or hazardous substances on the subject property. He is not aware of any vent pipes, fill pipes, or access ways indicating a fill pipe protruding from the ground on the property or adjacent to any structure located on an adjacent property. There is no well on the property. He is not aware of any of the adjoining properties having been used for commercial or industrial use that would have utilized chemicals in their on-site operations Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 9 5.2 County Sanitarian Interview A telephone interview was conducted with Tom Moore,Gallatin County Sanitarian and he provided the following information: The County Sanitarian's office has a limited data base for tracking health and environmentally related complaints and/or conditions discovered at facilities within incorporated city limits. Within the Gallatin County the Department tracks the drilling of water wells and permits septic systems. A computerized data base exists for complaints received since 1996. Mr. Moore did not have any records of health and environmentally related complaints associated with this property. 5.3 Former Property Owner Search A Google search was conducted via the internet to attempt to locate members of the Doig family. The purpose of this was to attempt to answer questions regarding the condition of the Warwood and Doig Chevron Service Station and Parcel II at the time of sale to the City of Bozeman. See Section 7.2 for details on the Parcel II data gaps encountered in the Phase I ESA research. Initial Google search results indicate that Arnold Doig (age 90), Edith Doig (age 89) and oldest son Donald Doig (age 62) may live in Manhattan, MT,but no phone numbers were readily available for the family members. 6.0 HISTORICAL USE INFORMATION The objective of this portion of the investigation is to identify prior uses of the property. Historical sources that provided information regarding past use of the property were title and deed records, United States Geological Survey (USGS) topographic maps, certificates of survey, aerial photographs and Sanborn Fire Insurance Maps. Records indicate that the subject property was part of the original townsite of Bozeman as surveyed in 1870. While Parcels I and III had buildings used for lodgings and offices, Parcel II located in the northwest corner of the property started as a feed store and corrals in the 1880s and developed into an automotive service and gas station in 1942. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 10 The entire subject property was cleared of buildings and turned into a parking lot in the latter part of 1979. 6.1 Record of Titles and Deeds See Appendix C for a complete listing of title and deed records. The information obtained from the record of titles and deeds suggest that the subject property represents the melding of what historically had been four separate properties. All information obtained from the record of titles and deeds suggest that the subject property has historically been used for small town businesses. The inclusion of the lease between the Warwoods / Doigs and Chevron Oil Company suggested that Parcel II may be the only one of the parcels that appeared to potentially utilize any chemicals in their business operations. 6.2 Sanborn Fire Insurance Rate Maps Sanborn Fire Insurance Rate Maps were originally prepared for use by fire insurance companies in the late 1800s and were periodically updated, often through the 1960s. The maps may show specific construction materials and building footprints for individual properties in an urban setting. Additionally, the maps often show the location of fuel storage tanks at service stations or railroad facilities. Digital Sanborn maps were viewed on the ProQuest Information and Learning's Digital Sanborn Maps, 1867-1970 website. The following Sanborn maps were reviewed for the subject property or surrounding area in that downtown portion of Bozeman. November 1884: Sheet 2 Parcel I: The southern half of the property contained a large 1-story Lodging House with a 2-story grain storage and small corral in the southeast corner. Parcel II: A large 2-story structure and corral occupies the northern half of the property. A variety of commercial stores and assorted warehouse are present all along the Main Street properties. January 1889,July 1890 &November 1891: Sheet 3 The building and sheds on the property are the same as shown in the 1884 map. Parcel IA: The large building on the southern half of the property is now referenced as boarding tenements. D. Ferguson's Feed Barn. The commercial stores and assorted warehouses present all along the Main Street properties are similar to those shown previously. The 2-story Grand Central Hotel is now located east of the subject property on the west side of Bozeman Ave. January 1904: Sheet 15 A slight modification is present to the buildings and sheds on the property as shown in the previous maps. Parcel IA: The eastern half of the large building on the southern half of the property has been removed. The remaining structure appears to have been assigned an address of 16 N. Black. Parcel IB: A 2-story rectangular building is now located along the alley and is listed as tenements; this building has been assigned an address of 16 1/2 N Black. Parcel II: The large 2-story structure on the northern half of the property is still listed as E. D. Ferguson's Feed &Sale and appears to have been assigned an address of 30 N Black Ave. Parcel III: The sheds along the eastern boundary of the subject property are now listed as tenements. The commercial stores and assorted warehouses present all along the Main Street properties are similar to those shown previously. The 2-story Grand Central Hotel has been removed and the Carnegie Library has been constructed on the property to the east. The property to the west across N. Black Ave. is vacant and a Chinese laundry and Chinese shacks are shown across E. Mendenhall to the north. September 1912: Sheet 13 A slight modification is present to the buildings and sheds on the subject property as shown in the previous maps. Parcel IA: The large building on the southern half of the property appears to have been rebuilt in the same location and is now listed as a full 2-story structure. Parcel II: The E. D. Ferguson's Feed &Sale building appears to have been expanded. The surrounding properties are similar to previously recorded. September 1927: Sheet 15 Parcel II: The primary change to the subject property is the removal of all structures related to Ferguson's Feed &Sale operation on the north half of the subject property. Mendenhall. Both of the two auto service operations are shown to have gas and oil on the property. Parcel III: The other change on the subject property is the removal of the tenement sheds along the east boundary. Parcel IA: The 28 N. Black building is listed as a clinic. Parcel I& The property at 16 1/2 N. Black is listed as Lodgings. 6.3 Polk City Directories The collection of Polk City Directories for Bozeman, Montana was observed at the Bozeman Public Library. This collection dates to the late 1800's. The purpose of the investigation was to determine the nature of the usage over time for the subject property addresses of 16 N Black Ave., 161/2 N Black Ave., 28 N Black Ave., and 106 E. Mendenhall St. The locations of the addresses were correlated with the buildings depicted upon the Sanborn Fire Maps dated 1927 and 1943. The results of the research are as follows: Parcel IA: 16 N Black Ave. and 28 N Black Ave. According to the Sanborn Fire Map these two addresses correspond to the same building. As documented in the records below, the 16 N Black address was used from 1906 through 1919 and the 28 N Black address was used from 1922 through 1978. The building is positioned along the north edge of the alley and the only description noted on the building is"Lodgings". Mendenhall St. The August 1943 Sanborn Fire Map depicted an auto service building directly across the street from the subject property at 105 E. Mendenhall. The Polk Directory had the following information for the business at 101 E Mendenhall. Years of Business Operations Business Name on Record 1940 Under construction 1942- 1947 Harry's Husky Service Station 1950- 1983 Long's Big O Tires -Sales and Service 1984 - 2010 Variety of commercial business stores and offices Upgradient Property Addresses in the 100 Block of East Main St. The Polk Directory was researched for information on businesses within the 100 Block of East Main St. This research was conducted to determine if any of these businesses, which are located immediately upgradient of the subject property,had conducted operations that may negatively impact soil or ground water resources. All of the businesses within this block were involved with typical retail operations and posed no level of environmental concern. Polk City Directory Research Note: The collection of Polk City Directories for Bozeman, Montana at the Bozeman Public Library is fairly complete. From 1892 through the mid 1950s the directories were commonly published every other year. There are a few annual directories that are missing from the collection. Not every annual directory is reviewed as part of the Phase I ESA research. Typically directories are scanned at five year intervals to verify that a business or similar business is reported as occupying the commercial building. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 14 6.4 Aerial Photographs Three aerial photographs were observed in the offices of the Natural Resources Conservation Service (NRCS) in Bozeman, Montana. The oldest photograph available for the subject area was flown on September 1, 1937 and reproduced at a scale of 4" = 1 mile. The subject property and the surrounding area represent the downtown business district. The poor photographic quality makes it difficult to discern between the ground and building roofs as smaller structures are not very distinguishable. The two structures present on the property are located on Parcels IA at 16 N Black and IB at 161/2 N Black. There are no structures present on Parcel II and the tenement structures on the east boundary of Parcel III appear to be there. The Carnegie Library is present on the adjacent property to the east. The second aerial photograph was taken on September 9, 1954 and reproduced at a scale of 8"= one mile. The photograph is of excellent quality and the city features are quite clear. This photo is similar to the 1937 photo such that the subject property and the surrounding area represent the downtown business district and there is slight modification to the overall layout in the city structures. In addition to the two buildings noted in the 1937 photo, the automotive service station building on Parcel II is now present. The property across N Black Ave. is used as a parking lot and a large multi- story building is west of the empty lot. The building to the north across E Mendenhall appears similar to the present day building. The third aerial photograph taken of the area on September 1, 1979 was reproduced at a scale of 4" = 1 mile. The only building that is still standing on the subject property is the 2-story Life of Montana building on Parcel IA. According to City of Bozeman engineering records, the blueprints and plans for the construction of the parking lot had already been out to bid and this building at 28 N Black was scheduled to be removed from the property. There are not many notable changes to the surrounding properties. One aerial photograph from 1942 was discovered in the Bozeman Pioneer Museum. The unique aspect of this photograph of the Bozeman downtown area was that it was taken at an angle from a low flying airplane so that the buildings have a three dimensional appearance. The three main buildings are present on the subject property, and it appears that the tenement sheds along the east boundary are still standing. This photograph corroborates the initial start up of the automotive service and gas station at 106 E Mendenhall. The Polk Directory had indicated that the first year of business for McEntire's Service Station was in 1942. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 15 Additional aerial photographs from the City of Bozeman collection for 1960 and 1970 were reviewed,but they did not provide additional details relative to the subject property and the surrounding properties. A 1995 photograph of the subject property and surrounding area was available online from Google Earth. This shows the subject property and surrounding area much the same as it exists today. The main exception is the block to the west where the building previously located at 26 and 30 East Mendenhall has been torn down and the entire northern portion of the block is now used as a parking lot. According to Polk Directory research, this building was last used in the late 1980s. The most recent aerial photograph publically available with the high definition resolution was taken in 2007 and is presented in Figures 1 and 3 in Appendix A. This photo shows the subject property and surrounding area much the same as they exist today. Two main exceptions are the Bridger Park Garage,which was constructed immediately to the west of the subject property and the damage and rebuilding work that was completed in the 200 Block of East Main St.,which was devastated by a natural gas explosion on March 5, 2009. The most recent aerial photograph as presented in Figure 2 in Appendix A was taken in 2009. This photo shows the new Bridger Park Garage that was finished in 2008. The City owned parking garage has five levels with a total of 435 parking spaces. The 2009 aerial photo also shows the area in the 200 block of East Main St. where the most severely damaged buildings were razed. This photo does not show the reconstruction work of those buildings,which has occurred since this photo was taken. When comparing this photograph to the one taken in 2007 (Figure 1), it is evident of the loss of sufficient picture resolution in the 2009 photograph. 6.5 Pioneer Museum Records Numerous historical files and documents were reviewed in the Bozeman Pioneer Museum,which is operated by the Gallatin Historical Society. The following information was discovered: Aerial photographs of the Bozeman downtown district. The information provided by a 1942 aerial photograph was documented above in Section 6.4. Undated photograph looking north from the intersection of E. Mendenhall St. The article contained a clear photograph of the service station front on Mendenhall. The orientation of the two service bays and the island containing the three fuel dispensers is clear. The north side of the two-story building at 28 N. Black Ave. is also seen in the background. See Photo 6, Appendix B for a copy of this photograph. Arnold Doig (current owner and operator at the time) was interviewed for the article and provided the following business details "Warwood who served with U.S. Army Infantry special services branch and Mrs. Doig, the former Edith Miller, also of the Gallatin Valley, opened the doors of the service station for business Dec. 1, 1945. The following month Doig received his discharge from the U.S. Army Air Force and joined in the active operation of the partnership business." 6.6 Maps on Record with the Clerk and Recorder The following map of interest was discovered and reviewed in the Gallatin County Clerk and Recorders Office in Bozeman. - April 1870: Survey by W. W. DeLacy of the Original Townsite of Bozeman, Montana including Blocks A through M. 6.7 City of Bozeman Building Department Records A verbal inquiry was submitted to the City of Bozeman Planning and Engineering Departments for building and demolition permits on record for the three buildings associated with the subject property: 16/28 N. Black Ave., 16 1/2N. Black Ave., and 106 E. Mendenhall St. The following information was provided by the members of the two departments. Sept &Nov 1979 Blueprint for the Construction of City Parking Lots at Black and Mendenhall Note: the blueprint references the location of the 28 N Black building and calls out the removal of a small existing concrete pad in the northwest corner of the property,but no reference is made regarding any other demolition or potential tank removal in the vicinity of the former Warwood &Doig Chevron Station. 6.8 Bozeman City Commission Meeting Minutes (1976) A key gap in the record research has been determining what the conditions of the Warwood and Doig Chevron Service Station building and underground fuel storage tanks were at the time that the property was sold by Arnold E. Doig and Edith E. Doig to the City of Bozeman on November 22, 1976. In an effort to resolve this question, the minutes from the Bozeman City Commission meetings from January 5, 1976 through November 29, 1976 were reviewed via the City of Bozeman's web page: BOZEMAN\City Commission\Minutes and Audio- City Commission and Advisory Boards/Task Forces\1970-1979\1976. There was no reference found in the minutes regarding the purchase of the three parcels (I, II and III) let alone the condition of the properties prior to or at the time of the sale. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 18 7.0 RECORDS REVIEW 7.1 Standard Environmental Record Sources, Federal and State State and Federal lists were reviewed to determine past and present potential environmental hazards. Following ASTM guidelines for minimum search distances, the following lists were searched for concerns near the subject property: • Underground Storage Tank (UST) List; • Leaking Underground Storage Tank (LUST) List; • National Priorities List (NPL) Superfund Sites; • Montana Non-NPL, or SPL Sites (CECRA); • Resource Conservation and Recovery Act (RCRA) Lists,which include Corrective Action Sites (CORRACTS), TSD, and large and small generators of hazardous waste; • Comprehensive Environmental Response, Compensation and Liability Information System (CERCLIS) Sites; • Emergency Response Notification System (ERNS) List; • State Brownsfield Sites List; • State Response Actions List including Voluntary Cleanup Sites; • Solid Waste Landfills, Incinerators, or transfer stations (SWLF). Other than the UST, LUST, CECRA, CERCLIS and NPL lists, there were no facilities located within the designated search distances. 7.1.1 Underground Storage Tank (UST) Sites Registered Underground Storage Tanks are regulated by the Resource Conservation and Recovery Act. The ASTM standard for an UST List review requires a search including the subject property and immediately surrounding properties. No registered underground storage tanks were located within the designated search distance. Underground storage tanks did not have to be registered with the Montana Department of Environmental Quality prior to 1986. Additionally,underground farm tanks 1,100 gallons or less used for storing motor fuel or heating oil are exempt from registration requirements under Montana's regulations. Therefore, abandoned underground storage tanks could exist near the subject property and may not be listed with the Montana UST Program. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 19 Based upon the historical research conducted for this Phase I ESA, there is ample evidence that a public motor vehicle fueling facility existed on Parcel II of the subject property at 106 East Mendenhall. The Polk Directory documents that the first station operating at this address was McEntire's Service Station in 1942. The 1943 Sanborn Fire Map verified the location of the auto service building on the north half of the subject property and further indicated the presence of gas and oil on the property. The 1971 Gallatin County Tribune newspaper article discovered at the Bozeman Pioneer Museum provided details of the Warwood-Doig partnership which started in 1945 and the newspaper photograph detailed the location of the fueling island and the existence of three fuel dispensers. The Gallatin County Clerk and Recorders records contained a February 18, 1966 lease agreement between the Warwoods and the Doigs (lessees) and Chevron Oil Company (lessor) that terminated on February 29, 1976. The Polk Directory further noted that the Warwood and Doig Service Station operated at the facility from 1947 through 1975. (Note: the collection of Polk Directories at the Bozeman Public Library is missing the period years of 1945 and 1946.) On November 22, 1976, Arnold E. Doig and Edith E. Doig sold Parcel II to the City of Bozeman. Unfortunately, none of the historical research was able to document what demolition activities took place on site after the automotive service and gas station business closed down. There are no records documenting if the building, fueling equipment and tanks were present on site when the property was sold to the city. Since the gas station closed down in 1976,which was 10 years prior to the federally mandated UST registration requirement for tank owners, there are no state or federal records of the tanks that were used on site. Another example of a neighboring property that research documented to have gas and oil storage,but was not included on the published Montana DEQ Underground Storage Tank (UST) List is 101 E Mendenhall St. Both the Sanborn Fire Maps and the Polk Directory indicated the presence of on-site petroleum storage from 1942 through 1947. In 1950 the primary business changed from Harry's Husky Service Station to Long's Big-O Tires -Sales and Service. Since this facility was not registered on the UST List, there is no record as to the continued practice of petroleum storage at the site after 1950 and there is no record of the tanks being removed or abandoned in-place. A second UST facility that could be considered adjacent to the subject property is also located across the street at 111 E. Mendenhall St. This facility is on the Montana DEQ UST List and the records document that one 500 gallon tank was buried in 1940 and was later removed from the ground in May 1993. Since there was no evidence of a leak when the tank was removed, the Montana DEQ classifies the facility as closed. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 20 Both of these two facilities are located in a downgradient location, therefore neither of the two properties have previously impacted nor are expected to have a negative impact upon the environmental status of the subject property. 7.1.2 Leaking Underground Storage Tank (LUST) Sites A total of sixteen facilities were shown on the LUST list within an approximate 1/2-mile radius of the subject property. A copy of the LUST map and resultant facilities list are provided in Appendix D. The petroleum releases at twelve of the sixteen facilities were cleaned up in accordance with DEQ closure requirements and the DEQ classified those petroleum investigations as resolved. The remaining four facilities have ongoing petroleum release investigations,but the releases are contained within close proximity of their facility. Additionally, those four facilities are located either cross gradient or downgradient to the subject property. None of the petroleum releases at these sixteen facilities have had a negative impact or are expected to have a negative impact to the environmental status of the subject property. 7.1.3 Montana Non-NPL Sites (CECRA) List The non-NPL online database reviewed for this report was provided by the MDEQ Remediation Division and dated September 26, 2011. The following site and associated site investigative information are listed within a one-mile radius of the subject property: CMC Asbestos The CMC Asbestos Site is approximately 1/3 mile to the east where the current Bozeman Public Library was built at 626 E. Main St. The CMC Asbestos Site is currently being regulated under the Voluntary Cleanup and Redevelopment (VCRA) Program. This site was formerly a railroad depot and recycling facility. From 1892 to 1988 it was used for asbestos ore storage and processing as well as serving as a recycling/salvage yard. Soils at this site were contaminated with asbestos, lead, PCB and TPH. In the fall of 2001, the City of Bozeman purchased 14 acres of the Facility from CMC and remediation work on City-owned property was completed in October 2003. The Voluntary Cleanup Completion Report dated August 2004 and available at the Bozeman Public Library details the remediation of asbestos, lead and organic Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 21 compounds in shallow site soils for the portion of the facility owned by the City of Bozeman. The report indicates that waste characterization, removal of surface debris, excavation and on-site treatment of contaminated soils followed by landfill disposal of these soils and confirmation sampling have been completed in accordance with the Voluntary Cleanup Plan dated October 2002. The current status is that while the city had cleaned up the majority of contamination on its property, a couple areas of concern are unresolved at and adjacent to the former railroad facility. Accessible asbestos-ore contaminated soils on properties adjacent to the 14-acre City property were excavated in the spring of 2009. Where inaccessible ore- contaminated soils remain in place (for example beneath buildings) institutional control measures such as deed restrictions have been placed on the properties to ensure proper removal and disposal of any asbestos contamination in the future. The environmental status of the subject property has not been affected by the CMC Asbestos Site. 7.1.4 U.S. EPA Comprehensive Environmental Response, Compensation and Liability Information System (CERCLIS) List The EPA CERCLIS online database reviewed for this report was accessed January 2012. The Idaho Pole Company site is the only site listed within a one-mile radius of the subject property. See Section 7.1.5 for site information. 7.1.5 Federal NPL (National Priority List) The NPL online database reviewed for this report was provided by the MDEQ Remediation Division and accessed January 2012. The following site and associated site investigative information are listed within a one-mile radius of the subject property: The Idaho Pole Company,located on East Cedar Street, is a facility where poles were treated with creosote and pentachlorophenol (PCP) since the 1940's. Past spills and disposal practices resulted in contamination of soil, ground water and surface water. During an investigation conducted by the State of Montana in 1978, PCP was discovered in a tributary of Rocky Creek. The Environmental Protection Agency (EPA) listed the site on its National Priorities List in 1986. Numerous ground water monitoring wells exist on site, and extensive cleanup has been undertaken, including soil excavation and the pumping/treating of ground water. An interceptor trench and absorbent-pad system was installed to recover contaminants from the ground water before they migrated offsite. This successfully reduced the migration of ground water Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 22 pollution from the facility. Contaminated soils have been removed from contact with the ground water and are presently being biologically treated. All remediation construction activities were completed in March 1998. The facility is located approximately 0.8 mile northeast of the subject property, in a downgradient direction. Due to the distance and direction from the subject property, it is believed that the Idaho Pole site has not negatively affected the subject property. 7.1.6 Remediation Response Site Query System The Montana DEQ in Partnership with the Montana Natural Resource Information System provides an online database that lists remediation response site records found within the desired search area from the Site Response and Federal Superfund Sections and the Montana DEQ Remediation Division. The database was queried for all sites within a one-mile radius of the subject property. Based on the overlapping nature of this database with other queried databases, there is a duplication of facilities listed. A copy of the Remediation Response Site map and resultant facilities list are provided in Appendix D. A total of ten sites were listed within the one-mile radius search zone. The majority of the sites were regulated under the Montana Water Quality Act (WQA). Nine of the ten sites on the list have been resolved and are non-active. The only active site on the list is the CMC Asbestos Site as discussed above. Based on the nature of the releases at each site, and their relative distance and direction from the subject property it has been determined that none of the operations or releases at these facilities have had a negative impact to the environmental status of the subject property. 7.2 Data Gaps The following data gaps were encountered in the preparation of this Phase I Environmental Site Assessment for the City of Bozeman Carnegie Parcels: • A key gap in the record research has been determining the following conditions related to Parcel II at the time that the property was sold by Arnold E. Doig and Edith E. Doig to the City of Bozeman on November 22, 1976: ➢ When did the Warwood and Doig Chevron Service Station shut down its operations at 106 E. Mendenhall? ➢ Was the Service Station and all of the appurtenances demolished before or after the sale date of November 22, 1976? Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 23 ➢ How many underground fuel storage tanks were utilized at the property? What were the size and contents of the fuel storage tanks? ➢ Were all of the underground storage tanks properly drained prior to removal or abandonment? Were the storage tanks removed from the ground or were the tanks properly abandoned in-place? If the tanks were abandoned in- place,what are the locations of the tanks on the property? The lack of this information did not impair Phoenix Engineering's ability to identify present or past recognized environmental conditions on the Carnegie Parcels. 8.0 FINDINGS AND RECOMMENDATIONS A Phase I Environmental Site Assessment has been performed in conformance with the scope and limitations of ASTM Practice E 1527-05 on the City of Bozeman Carnegie Parcels located, in Bozeman, in Gallatin County, Montana. No exceptions to, or deletions from, this practice were encountered in the preparation of this report. Based upon site conditions and the data that was collected, analyzed and interpreted as part of the Phase I ESA services, Phoenix Engineering does not recommend any additional follow-up Phase II or Phase III services to be conducted on the subject property, except for those recommendations as noted below. 8.1 Possible Buried Fuel Storage Tanks in Parcel II This assessment has revealed evidence that a recognized environmental condition could exist in the subsurface soils of the subject property. Based upon the historical research conducted for this Phase I ESA, there is ample evidence that a public motor vehicle fueling facility existed on Parcel II of the subject property at 106 East Mendenhall. The Polk Directory documents that the first station operating at this address was McEntire's Service Station in 1942. The 1943 Sanborn Fire Map verified the location of the auto service building on the north half of the subject property and further indicated the presence of gas and oil on the property. The 1971 Gallatin County Tribune newspaper article discovered at the Bozeman Pioneer Museum provided details of the Warwood- Doig partnership which started in 1945 and the newspaper photograph detailed the location of the fueling island and the existence of three fuel dispensers. (Note: the collection of Polk Directories at the Bozeman Public Library is missing the period years of 1945 and 1946.) On November 22, 1976, Arnold E. Doig and Edith E. Doig sold Parcel II to the City of Bozeman. Unfortunately,none of the historical research was able to document what demolition activities took place on site after the automotive service and gas station business closed down. There are no records documenting if the building, fueling equipment and tanks were present on site when the property was sold to the city. Since the gas station closed down in 1976,which was 10 years prior to the federally mandated UST registration requirement for tank owners, there are no state or federal records of the tanks that were used on site. However, since there were three separate dispensers, then there would have been at least two grades of fuel dispensed and at least two tanks for on-site storage. At this juncture there are several possible site conditions and related environmental risks that may exist regarding the storage of fuels on this subject property. The following discussion is designed to provide a general environmental risk analyses for various potential scenarios that could currently exist in the subsurface soils of the subject property. 1. Assumption: All underground tanks were removed from the ground and no petroleum releases occurred at the facility during the 34 years of automotive fueling. • Resultant risk: None 2. Assumption: All underground tanks were removed from the ground,but petroleum releases occurred at the facility during the 34 years of automotive fueling either from leaking tanks or leaks from loose pipes joints, • Resultant risk: If a moderate amount of petroleum fuel was spilled during the facility operation through leaky supply pipes or tank or vehicle overfills then a low environmental risk exists. The roughly thirty-five years that have passed since this type of fuel spill may have occurred would have allowed for significant natural degradation of the petroleum hydrocarbons to occur down to very low or non-detectable concentrations. The potential for residual petroleum hydrocarbons to exist for a longer period in the subsurface soils can be slightly greater in soils that have a high clay content. 3. Assumption: The underground fuel tanks were left in place and still exist underground today. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 25 • If all of the fuel was removed from the underground tanks prior to dismantling the facilities, then similar environmental risks exist as stated in the two above scenarios (see #1 and 2). • If hundreds of gallons of petroleum fuel were left in the tanks and the tanks were tightly sealed minimizing fuel vaporization loss, then the associated environmental risk corresponds to the time related integrity of the tanks. If the tanks are still intact with no corrosion holes and no current release of fuels to the subsurface soils, then similar environmental risk exists as stated in the two above scenarios (see #1 and 2). However, if a corrosion hole developed within the last five years and the contained fuel was released into the subsurface soils then the environmental risk is in direct proportion to the amount and type of fuel released. A subsurface investigation would need to be conducted to determine the extent and magnitude of the petroleum release in the soils and possibly into ground water. As noted above, the only condition related to the fueling facility that could possibly create a serious environmental risk for the property owner, requires that the previous owners/tenants left hundreds of gallons of fuel stored in underground tanks,which recently leaked from a newly developed hole in the bottom of the tank. It seems unlikely that anyone would have abandoned a valuable product in the ground rather than using it up prior to closing down the facility. Unfortunately, little is currently known as to the status of this fueling operation when the facility and property were sold to the City of Bozeman in 1976. At this time,without further input from the former property owners (Doig Family) or from any former City employee who may have been directly involved in the removal of the tanks, the best way to determine whether underground tanks are still present is to undertake an on-site field investigation that consists of ground-penetrating radar (GPR) and metal detection. Since the location of the former service station is fairly well documented with the Sanborn Maps and the Gallatin County Tribune newspaper photograph, the investigative area can be limited to just Parcel II. The utilization of these two technologies to conduct the investigation will preserve the condition of the asphalt parking lot and surrounding landscaping. If potential tank locations are found, then a backhoe can be used to confirm the presence of underground tanks. It is expected that the tanks were fabricated of steel and the tops of the tanks would not be buried more than two feet below the ground surface, unless the City brought in additional fill prior to constructing the existing parking lot. If old tanks are discovered then they must be removed in accordance with Montana DEQ regulations. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 26 8.2 Pole-Mounted Electrical Transformers Two pole-mounted electrical transformers were observed on a wooden utility pole in the alley near the southwest corner of the subject property. While there was no noticeable exterior labeling on the transformers, the oil in older transformers is suspected of containing polychlorinated biphenyls (PCBs). Due to PCB characteristics of non-flammability, chemical stability,high boiling point, and electrical insulating properties, PCBs were used in hundreds of industrial and commercial applications including electrical,heat transfer, and hydraulic equipment. Although PCBs have not been used extensively since the late 1970s when the EPA phased out their use, the chemical continues to be found in older facilities typically in electrical transformers, equipment, and fluorescent light ballasts. The pole-mounted transformers appeared to be in good condition with no sign of leaks and therefore has not negatively affected the environmental status of the subject property. However, it is recommended that a regular visual inspection of the transformer be completed so that the local power company can be notified in the event an oil leak is discovered and the leak can be repaired or the transformed replaced. 8.3 Treated Utility Pole The newer wooden utility pole in the alley near the southwest corner of the property is suspected of being treated with pentachlorophenol or creosote. This wood treatment compound has oozed out from the base of the pole and seeped into the soil surrounding the pole. Handling of treated wood or contaminated soil is not advised- particularly for children. 8.4 Off-site Conditions Based upon our review of the federal and state standard environmental record sources and our site inspection, it was determined that none of the adjacent or upgradient properties currently have impacted or are expected to have a negative impact upon the environmental status of the subject property. Project Code:11_943 PHOENIX City of Bozeman Carnegie Parcels SE Corner of N.Black&E.Mendenhall,Bozeman,MT Phase I Environmental Site Assessment Report January 12,2012 27 9.0 LIMITATIONS 9.1 Limitations and Exceptions of Assessment The following business environmental risk conditions were not reviewed or completed as they were beyond the scope of work for this project: wetlands, regulatory compliance, cultural and historical resources, industrial hygiene,health and safety, ecological resources, endangered species, indoor air quality,high-voltage power lines, comprehensive/destructive asbestos, lead or mold investigations, sampling for radon, urea formaldehyde insulation, and PCBs. 9.2 Special Terms and Conditions Phoenix Engineering has developed and performed this study in conformance with the standards and practices set forth in"All Appropriate Inquiry" Final Rule (40 C.F.R. Part 312).
