SUBJECT: Request to Reclaim Jurisdiction of a Preliminary Site Plan Conditional Use
Permit with Certificate of Appropriateness with Deviations application, to
allow the construction of an accessory structure in the rear yard of the
residence 619 South Willson Avenue for use as a home based business, zoned
R-1 (Residential, Single Household Low Density). The property is located
within the Bon Ton Historic District, on the National Register of Historic
Places, and within the Neighborhood Conservation Overlay District.

RECOMMENDATION: Staff recommends the City Commission reclaim jurisdiction based on
the inability of the BOA to assemble a quorum to hear the deviation request at their April meeting.
RECOMMENDED MOTION: I move to reclaim jurisdiction of the Strong Preliminary Site
Plan Conditional Use Permit Certificate of Appropriateness with deviation application #Z-
12031.
BACKGROUND: Property owners Carl and Loretta Strong, 619 South Willson Avenue, Bozeman,
MT, and representative Elaine Hawk, 807 Worden Avenue. Suite 2, Missoula, MT 59802, submitted
a Preliminary Site Plan Conditional Use Permit with Certificate of Appropriateness and Deviation to
enable the construction of an accessory structure in the rear yard of the property at 619 South Willson
Avenue. The accessory structure will provide space for a home based business, which requires a CUP
within the R-1 Zoning designation. The deviation requested will enable construction of the accessory
structure inside of the minimum rear yard setback. The property is located within the Bon Ton
Historic District and Bozeman’s Neighborhood Conservation Overlay District.
Staff learned that BOA currently lacks a quorum and the applicant requested Commission review of
the application. Staff therefore requests the Commission reclaim jurisdiction of the application to be
heard at their regularly scheduled April 16, 2012 hearing in order to provide the property owner with
timely review of the application.
