MEETING DATE: March 5, 2012 AGENDA ITEM TYPE: Consent RECOMMENDATION: Motion and vote to ratify the City Manager’s signature on the Bozeman Water Reclamation Facility, Administration and Lab Building – Change Order No. 1. BACKGROUND: Attached is a copy of the summary of change order number 1 for the above referenced project. This change order includes fifty items. Eight of the items are credits while the other twenty seven are additions. Pages two through five of the change order entitled “Change Order No. 1 Summary” provide a short description of each of the items involved with this change. The remainder of the document contains the detailed backup cost information for each item. This item is for ratification of the City Manager’s signature since all of the work associated with the change is complete. Many times during the course of construction, change items occur while the work on a particular component is being completed. In order to avoid additional delays and the resulting cost associated with the delay, the contractor needs to be given direction on how to proceed right away. These items are then formalized into a change order after the fact. This is the more typical situation than the alternative where an item has a long lead time and a change order can be executed prior to the work being completed. Rather than execute a separate change for each item, we hold off until we have several to process and include them in one change as we have here. This change is the first and final change on the project and as such constitutes all of the items that occurred on the project. This change includes an extension of contract time of 65 days for substantial completion and 320 days for final completion. The final recommended increase in cost and time extension for this change is reasonable and commensurate with the work involved. UNRESOLVED ISSUES: None ALTERNATIVES: As suggested by the City Commission. 72 FISCAL EFFECTS: Overall this change order increases the contract amount by $58,684.00 from $1,680,000.00 to $1,738,684.00. This will decrease the contingency on the project from $147,521.51 to $88,837.51. The contingency is included in the overall budget for the project but not in the construction contract which is why the change order must be processed. WHEREAS, the City Commission did, on the 29th day of December 2009, authorize award of the bid for the Bozeman Water Reclamation Facility Administration and Lab Building project, to Williams Brother Construction, LLC., Billings, Montana; and WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or modifications of the specifications and/or plans of the contract be made by resolution; and WHEREAS, it has become necessary in the prosecution of the work to make alterations or modifications to the specifications and/or plans of the contract. NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a municipal corporation, and Williams Brother Construction, LLC ., as contained in Change Order No. 1, attached hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to execute the contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such signature. 74 Resolution No. 4369, Change Order 1 for WRF Administration and Lab Building 2 of 2 PASSED AND APPROVED by the City Commission of the City of Bozeman, Montana, at a regular session thereof held on the 5th day of March 2012. __________________________________________ SEAN A.
