MEETING DATE: March 5, 2012 AGENDA ITEM TYPE: Consent RECOMMENDATION: Staff recommends the City Commission reclaim jurisdiction based on the inability of the Board of Adjustment (BOA) to assemble a quorum to hear the variance request at their March meeting. RECOMMENDED MOTION: I move to reclaim jurisdiction of the Bridger Industrial Park Signage Zoning Variance application #C-12001. BACKGROUND: Property owners Bridger Industrial Park, 1276 N. 15th Ave., Ste. 103, Bozeman, MT 59715 submitted a Zoning Variance application for the additional of signage above the maximum allowed per lot within the M-1 Zoning District at a multi-tenant complex located at 2304 N. 7th Avenue. Staff learned at the January 10th BOA meeting that the BOA is unable to form a quorum to hear this application in March. The earliest a BOA quorum forum can be formed is in April. Staff therefore requests the Commission reclaim jurisdiction of the application to be heard at their regularly scheduled March 26, 2012 hearing in order to provide the property owner with timely review of the application. UNRESOLVED ISSUES: None at this time. ALTERNATIVES: The City Commission may choose to not reclaim jurisdiction of the application, and therefore, the BOA would be the final decision making body and the project would be scheduled to their April 10, 2012 meeting.
