SUBJECT: Request to Reclaim Jurisdiction of a Certificate of Appropriateness
application, including one deviation request, to allow demolition of an
existing single-family residence and construction of a new single-family
residence with a detached garage and accessory dwelling unit above at 616
North Bozeman Avenue, zoned R-2 (Residential, Medium Density District).

RECOMMENDATION: Staff recommends the City Commission reclaim jurisdiction based on
the inability of the BOA to assemble a quorum to hear the deviation request at their March meeting.
RECOMMENDED MOTION: I move to reclaim jurisdiction of the Kirwan Residence/ADU
Certificate of Appropriateness with a Deviation application #Z-12011.
BACKGROUND: Property owners K & Sun, LLC and representatives, Intrinsik Architecture and
C&H Engineering, submitted a Certificate of Appropriateness application for demolition of an
existing single-family residence and construction of a new single-family residence with a detached
garage and accessory dwelling unit above at 616 North Bozeman Avenue. One deviation is
requested with the application, to allow an accessory dwelling unit on a lot less than the required 60
feet.
Staff learned at the January 10th BOA meeting that the BOA is unable to form a quorum to hear this
application in March. The earliest a BOA quorum forum can be formed is in April. Staff therefore
requests the Commission reclaim jurisdiction of the application in order to provide the property
owner with timely review of the application.
UNRESOLVED ISSUES: None at this time.
ALTERNATIVES: The City Commission may choose to not reclaim jurisdiction of the
application, and therefore, the BOA would be the final decision making body and the project would
be scheduled to their April 10, 2012 meeting.
FISCAL EFFECTS: None at this time.
