THIS AGREEMENT is made as of this 6`h day of February,2012,between THE CITY OF BOZEMAN, a Municipal Corporation, PO Box 1230, Bozeman, MT 59715 (OWNER)and Water Rights Solutions Inc.,with offices at 303 Clark Street, Helena, MT 59601 (CONSULTANT). WHEREAS,the Parties have entered into a Professional Services Agreement dated July 2�_ 4, 2006 herein referred to as Original Agreement for professional consulting services;and WHEREAS,the Parties desire to further amend the provisions of the Original Agreement, NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, the Parties agree as follows: 1. TASK ORDER A is added to Section 4.1 —Scope of Work detailing specific scope and project related expenses necessary to provide water rights evaluation in conjunction with Task 3 of the City of Bozeman Integrated Water Resources Plan. 2. Section 8.4—Nondiscrimination is amended as follows: The CONSULTANT will have a policy to provide equal employment opportunity in accordance with all applicable state and federal anti-discrimination laws,regulations,and contracts. The CONSULTANT will not refuse employment to a person, bar a person from employment, or discriminate against a person in compensation or in a term, condition, or privilege of employment because of race, color, religion, creed, political ideas, sex, age, marital status, national origin, actual or perceived sexual orientation, gender identity,physical or mental disability,except when the reasonable demands of the position require an age, physical or mental disability,marital status or sex distinction. The CONSULTANT shall be subject to and comply with Title VI of the Civil Rights Act of 1964; Section 140, Title 2, United States Code,and all regulations promulgated thereunder. The CONSULTANT shall require these nondiscrimination terms of its sub-consultants providing services under this agreement. Except as specifically amended herein, the Original Agreement shall remain in full force and effect, and the Parties shall be bound by all terms and conditions therein. TASK ORDER A Scope of Services The following scope of work describes project related services to be provided by Water Rights Solutions Inc in conjunction with Task 3 of the City of Bozeman Integrated Water Resource Plan, a project under separate contract between the City of Bozeman and AE2S, an Engineering Firm with offices in Great Falls, MT. Water Rights Solutions Inc agrees to complete these project related services in a responsive manner and understands that AE2S will coordinate with Water Rights Solutions Inc in an effort to keep the Integrated Water Resources Plan on schedule. 1) Provide an analysis of surface water rights in the form of a spreadsheet shorted source by priority date and identify possible targets for acquisition. These streams that include but are not limited to Bear Creek, Big Bear Creek, Little Bear Creek, Bozeman (Sourdough Creek), Bridger Creek, South Cottonwood Creek. Map water rights points of diversion in target areas Hyalite Creek, Middle Creek, and Limestone Creek. 2) Evaluation of water rights currently held by the City of Bozeman to ensure water right ownership records are up to date,report current status and or issues. Create a spreadsheet to track. 3) Prepare for and attend meetings. Travel to and from meetings, as necessary. Meetings are as scheduled by AE2S and the City of Bozeman. Compensation Water Rights Solutions Inc will perform Task Order A at a rate of $100/hr not to exceed a total lump sum of $20,000. A further allowance of$620 is provided to cover reimbursable expenses related to travel.
