TO PROFESSIONAL SERVICES AGREEMENT
FOR GREAT WEST ENGINEERING

THIS AGREEMENT is made as of this day of 201X between
THE CITY OF BOZEMAN, Municipal Corporation, Bozeman, Montana, hereq here' referred to as
OWNER and GREAT WEST ENGINEERING, INC, an Engineering Consulting Firm of Helena,
Montana, herein referred to as ENGINEER.
WHEREAS, the parties have entered into a Professional Services Agreement dated April 21,
2008, herein referred to as Original Agreement for professional engineering services; and
WHEREAS, the parties desire to further amend the provisions of this Agreement.
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS
CONTAINED HEREIN, the parties agree as follows:
Revise Paragraph 1.1 as follows:
1.1 The detailed description of the specific project components is described as
follows: The project consists of approximately 9,600 lineal feet of CIPP pipe
replacement in the R2 project area and the alley between Bogert Place and
Story from Church to the end (E0515-EO516). In 2008, the R2 project area
was completely surveyed and approximately 3,600 lineal feet of CIPP was
designed but not constructed. This previously designed work will be
transferred to the latest edition of software and submitted to DEQ for
approval. The project will also include installation of top hats for services
with roots problems in the New Hylite View Subdivision on CIPP Lines
previously installed. Service connections in R2 project area will also be
considered for service top hats or replacement.
Paragraph 4.1.6 is not applicable.
Revise Paragraph 4.1.7.4 as follows:
4.1.7.4 Pre-design Analysis. The Engineer will evaluate the viability of in-situ
service line repair technologies such as Top Hat and T-Line products.
Existing sewer services will be analyzed and reviewed with City personnel
prior to preliminary design. Services analyzed will be the New Hylite View
Subdivision lines and the remaining R2 service lines. Considerations include
constructability, cost, future repair and service installation and other
performance related issues.
Remove Paragraph 4.1.7.5 in its entirety.
Revise the last sentence in 4.1 as follows:
The Pre-design Investigation Phase will be completed and submitted within 60 calendar
days following written authorization from OWNER to ENGINEER to proceed with that
phase of services.
Paragraph 4.2.3.3 is not applicable.
Revise Paragraph 4.2.4 as follows:
4.2.4 Design and Construction Survey: The ENGINEER has already conducted a
survey of all proposed lines. The ENGINEER may need to pick up some
additional survey points for design. It is assumed that any survey effort will
not exceed S hours. Existing above ground conditions will be documented
with video and/or pictures prior to any construction.
Paragraph 4.2.6 is not applicable.
Revise last sentence in 4.2 as follows:
The Preliminary Design Phase will be completed and submitted within 60 calendar days
following written authorization from OWNER to ENGINEER to proceed with that phase of
services.
Revise last sentence in 4.3 as follows:
The Final Design Phase will be completed and submitted within 30 calendar days following
written authorization from OWNER to ENGINEER to proceed with that phase of services.
Revise Paragraph 6.1.1 as follows:
6.1.1 Payment. The OWNER shall pay for design phase services performed as
Basic Engineering Services under sections 4.1 through 4.3 of this agreement a total
lump sum in the amount of$40,900 for such services.
Revise Paragraph 6.1.2 as follows:
6.1.2 Payment Schedule. Total cumulative payments for the design phase
engineering services (sections 4.1 through 4.3) shall not exceed the following
ceilings:
$4,090 (10% of design fee) until the Pre-design Investigation and Preliminary
Design Report have been submitted to the OWNER.
$20,450 (50% of design fee) until the Preliminary Plans and Specifications have
been submitted to the OWNER and review authorities.
$36,810 (90% of design fee)until the Final Plans and Specifications have been
submitted to the OWNER
Revise Paragraph 7.3 as follows:
Principals $47.00
Project Manager $37.75
Senior Engineer $30.00
Staff Engineer $23.50
Senior Technicians $25.00
CADD Drafter $26.25
Two Person Survey Crew $46.00
Clerical $15.00
Revise the following Engineering Fee Estimate Worksheets, attached to this Amendment, to
EXHIBIT C:
4.1 Pre-Design Investigation
4.2 Preliminary Design
4.3 Final Design
Except as specifically amended herein, the original agreement shall remain in full force and effect
and the Parties shall be bound by all terms and conditions therein.
IN WITNESS WHEREOF,the parties hereto do make and execute this Agreement on the day and
year first above written.
