Box 1230 Bozeman, MT 59771 AGREEMENT This AGREEMENT, made the first day noted below, the day of , ¢ AU CV,4j- 2011, between the City of Bozeman (City), a municipal corporation and politics subdivision of the State of Montana in Gallatin County and the Property Owners (Owners) of the Skyridge d Estates Subdivision, aka COS 1103 and its subsequent amendments, has three purposes: 1) The Owners acknowledge and approve the City's plan to utilize a portion of Tract 6 of COS 1103 for expansion of the City's Sourdough Water Treatment Facility in accordance with the plans, details and descriptions attached as Exhibits "A, B and C". 2) The Owners agree that the proposed Water Treatment Facility, as represented in Exhibits 'A, B and C", is consistent with the intent and purposes of the Amended aE Skyridge Covenants as recorded with the Gallatin County Clerk and Recorder, on Film 109, Page 727. 3) Within two and one half years of the agreement date, the City agrees to construct the ¢r' water treatment facilities, landscaping, screening, fencing, earthen berms and irrigation �E systems as shown on Exhibit "A, B and U. TUB Furthermore, the City of Bozeman agrees to file this Agreement with the Gallatin County Clerk r and Recorder. Exhibit A is a description of building and landscaping modifications agreed to by N-9= the City in response to public comments. Exhibit B is the Overall Landscaping Plan, sheet CN OOOC28, from the Water Treatment Plant Replacement Project. Exhibit C is a site plan showing f) the general land uses on Tract 6 of COS 1103 and Tract 1 of COS 633C. These items are currently reflected in the building and landscaping plans. Building modification items: (These are added to the original building design that called for removal of the current water treatment building, construction of an approximately 45,120 square foot, single story building, gable roof design, all roofs to be pitched, sheet metal siding with doors and windows to break up the wall line mass, roof dormers and skylights to break up the mass of the roof, and the use of earth-tone siding and roof colors.) - Reduce all roof pitches from 4112 to 3112 - Rotate the roof ridge line from east-west to north-south on the east module - Add horizontal banding to the walls - Use downward directed exterior lighting and generally minimize the use of exterior lighting to protect dark skies of the neighborhood Landscaping modifications: (These are added to the original landscaping concept that called for a landscaped earthen berm buffer along the north and east sides, a six-foot high fence around the lagoon and drying beds north of the building, mixed tree species on the berms, and low maintenance, native species grass mix.) Add earthen berms to the northeast and east building walls - Reshaped the berms north and east of the lagoon and drying beds to a more natural configuration - Add trees to north side of the building - Add trees to the south and southeast of the parking lot - Include the landscaping and irrigation items in the overall project bid End of list r I ♦ ``\`\ I'I LAGOON rff \!
