SUBJECT: Request to Reclaim Jurisdiction of a Certificate of Appropriateness
application, including a deviation request, to allow construction of a studio
space above an existing garage which would encroach into the required side
yard at 401 South 8th Avenue, zoned R-2 (Residential, Medium Density)
District.
MEETING DATE: February 13, 2012

RECOMMENDATION: Staff recommends the City Commission reclaim jurisdiction based on
the inability of the BOA to assemble a quorum to hear the deviation request until their April
meeting.
RECOMMENDED MOTION: I move to reclaim jurisdiction of the Kleindl/ Duchin
Certificate of Appropriateness with Deviation application #Z-12006.
BACKGROUND: Property owners Bill Kleindl and Courtney Duchin submitted a Certificate of
Appropriateness application to construct a studio space for personal use above the garage attached to
their residence at 401 South 8th Avenue. The existing garage encroaches into the required side yard
setback, and thus new construction above the existing non-conformity requires approval of a
Deviation from the standard dimensional requirement.
Staff learned at the January 10th BOA meeting that the BOA is unable to form a quorum to hear this
application until April. Staff therefore requests the Commission reclaim jurisdiction of the
application in order to provide the property owner with timely review of the application.
UNRESOLVED ISSUES: None at this time.
ALTERNATIVES: The City Commission may choose to not reclaim jurisdiction of the
application, and therefore, the BOA would be the final decision making body and the project would
be scheduled to the April 10, 2012 meeting.
FISCAL EFFECTS: None at this time.
