COMMISSION RESOLUTION NO. 2531
A RESOLUTION OF THE CITY CO~1ISSION OF
THE CITY OF BOZEMAN, MONTANA, EXTENDING
THE BOUNDARIES OF SAID CITY OF BOZEMAN SO
AS TO INCLUDE A TRACT OF LAND CONTIGUOUS
TO SAID CITY AND REFERRED TO AS THE VOLZ-
WALLIN PARCEL, HEREIN MORE PARTICULARLY
DESCRIBED, WITHIN THE CORPORATE LIMITS
THEREOF.
WHEREAS, Commission Resolution No. 2525 was adopted by
the City Commission on September 10, 1984, declaring it to
be the intent of the City of Bozeman to extend the
boundaries of said City so as to include said contiguous
tract within the corporate limits of the City; and
WHEREAS, said tract contains approximately 8.252 acres
and is bounded by West Main Street on the south and the
ponderosa Mobile Home Subdivision on the west; and
WHEREAS, a public hearing on Commission Resolution No.
2525 was duly noticed and held on October 15, 1984; and
WHEREAS, on October 22, 1984, the Commission voted to
approve the intent to annex the tract as established in
Commission Resolution No. 2525 subject to the following
condition:
A written agreement be negotiated by the City and
the freeholders of the tract that defines the
provision of services including, but not limited
to, rights. of way, easements, water rights or a
fee in lieu, waivers of protest against creation
of SID's and water and sewer hookup fees.
WHEREAS, the provision of services to said contiguous
tract is subject to a written agreement between the City
and Stephanie Volz, Norman E. Wallin, David A. Wallin
and Clarence Bos, record owners of the tract, dated
November
13th , 1984; and
WHEREAS, the City has received Eleven Thousand Four
Hundred Ninety-One and 50/100 Dollars ($11,491.50) from the
record owners of the tract; and
WHEREAS, said contiguous tract is described by
Certificate of Survey 1227, as filed and in the office of
the Clerk and Recorder of Gallatin County, Montana;

NOW, THEREFORE, BE IT RESOLVED by the City Commission
of the City of Bozeman, Montana:
Section 1
That it is hereby declared that pursuant to Title 7,
Chapter 2, Part 43, M.C.A., the following property
contiguous to the municipal boundaries of the City of
Bozeman be annexed to the City of Bozeman and that the
boundaries of said City shall be extended so as to embrace
and include such property, to wit:
A parcel of land located in the Southeast
Quarter of Section 11, Township 2 South, Range 5
East, Principal Meridian of Montana, and more
particularly described as follows:
Beginning at the East Quarter corner of
said Section 11 at a brass capped iron monument
set in the asphalt roadway and using Certificate
of Survey No. 503, as filed with the Gallatin
County Clerk and Recorder, as the basis of
bearing;
Thence (as per Film 20--page 1284 and cas No.
503)* S 89017'07" W on and along the north line of
the Southeast Quarter of Section 11 a distance of
2,229.62 feet to the true point of beginning;
Thence S 00018'58" W a distance of 247.72
feet to the southwest property corner of cas No.
63*;
Thence N 89017'07" E a distance of 85.84 feet
to the southeast property corner of cas No. 63;
Thence on and along the westerly property
boundary of that property described in Book of
Deeds No. 144--page 209*, S 00007'50" W a distance
of 37.10 feet to the southwest property corner of
said Book 144--page 209;
Thence on and along the southerly property
boundaries of those properties described in Book
of Deeds 144--page 209 ahd Film 24--page 425*
N 89012'12" E a distance of 105.01 feet;
Thence N 89012'26" E a distance of 161.01
feet to a point located on the easterly property
boundary of that property described in Book of
Deeds No. 139--page 561*;
Thence on and along said easterly property
boundary S 00004'58" E a distance of 536.68 feet
to the northwesterly right-of-way of U.S. Highway
191 (also known as West Main Street) from which a
brass capped iron witness corner bears N 00004'58"
W a distance of 11.21 feet;
Thence on and along said right-of-way
S 42017'16" W a distance of 399.60 feet;
Thence on and along said right-of-way S
42010'19" W a distance of 244.93 feet to the
southwest property corner of cas No. 503;
Thence on and along the westerly boundary of
cas No. 503 N 00005'40" E a distance of 1020.63
feet to the northwesterly property boundary of cas
No. 503;
Thence N 00005'40" E a distance of 272.25
feet to the north line of the southeast quarter of
Section 11 and the approximate centerline of West
Babcock Street;

Thence on and along the said north line of
the southeast quarter of Section 11 N 89017'07"
E a distance of 80.03 feet to the true point of
beginning;
Said parcel contains 8.249 acres, more
or less.
*As filed and of record in the office of the
Gallatin County Clerk & Recorder.
The above-described property being depicted
as Tract VW-1, Tract VW-2 and Tract VW-3 on
Certificate of Survey No. 1227, on file in the
office of the Gallatin County Clerk and Recorder.
Section 2
The effective date of this annexation is December 13,
1984.
Section 3
The annexation of the Volz-Wallin Parcel is subject
to the terms of an agreement dated November
13th
, 1984,
by and between the City of Bozeman and Stephanie Volz,
Norman E. Wallin, David A. Wallin and Clarence Bos regarding
the provision of services.
PASSED AND ADOPTED by the City Commission of the City
of Bozeman, Montana, at a regular and stated session of said
City Commission, held on the 13th day of
November
1984.
