THIS AGREEMENT made this Cl)-,A- day of

1987, by and between the City of Bozeman, a municipal
corporation of the State of Montana, with offices at 411
East Main, Bozeman, Montana, hereinafter referred to as the
"City" and Robert W. Brown, Attorney at Law, having an
office at 13 S. Willson, Bozeman, Montana, hereinafter
referred to as the "Public Defender,"

W I T N E S S E T H:
WHEREAS, the City Court, has determined that it will be
in the best interest in the effective administration of
iustice to retain an attorney to represent the indigent
criminal defendants that appear in this Court; and
WHEREAS, after consultation with City administration it
it
has been determined a Public Defender to represent indigent
criminal defendants be retained.
NOW, THEREFORE, IN CONSIDERATION of the mutual agree-
ments herein contained and subject to the terms and con-
ditions hereinafter stated, it is hereby understood and
agreed by the parties hereto as follows:
1. Professional Services to be Performed:
That the Public Defender shall provide counsel where
necessary for the defense of those indigent persons
appointed to him by the Judge of the City Court. Further
the Public Defender shall assist the Court in determining
the financial ability of appointed persons to reimburse the
city for court appointed counsel expense.
2. Time of Performance:
The services of the Public Defender shall commence
as of May 15, 1987, and terminate as of the end of
November 15, 1987. Except, however, that either party may
