This Letter of Understanding and Agreement is made and entered into this P day of� m „-
2011 by and between the City of Bozernan, Montana hereinafter referred to as the "City" and the International
Association of Fire Fighters Local 613 hereinafter referred to as the"Union".
This Letter of Understanding and Agreement addresses Firefighter First Class Jeremy 'Fucker's complaint dated
December 6,2011 in reference to"Management violated employee handbook provision including,but not limited to
Article IV, Recruitment and Selection (General Policy and Recruitment)," This complaint concerns the Bozeman
Fire Department Engineer positron.
FF Tucker requests to have a fair competitive promotional process in detennining the best candidate for the
Engineer position.
FF Tucker submitted the complaint to his immediate supervisor, Captain Keith Johnson,
WHEREAS,Article 17: Grievance&Arbitration Procedures states:
Procedure;
Step 1 —Immediate Supervisor's Notification:
Any dispute involving the interpretation,application,or alleged violation of a specific provision of
this agreement shall be brought to the employee(s) immediate supervisor within fifteen (15)
business days of the day the incident occurred.
Step 2—Immediate Supervisor's Response:
No formal grievance may be filed until the immediate supervisor has been given an opportunity to
attempt resolution. The immediate supervisor has ten (10) business days to respond to a Step l
notification.
Step 3 -Formal Grievance:
In the event the ernployee(s) covered by this agreement chooses to file a formal grievance they
shall notify the Fire Chief and the Union Grievance Committee within five(5)business days from
the end of Step 2. ...
WHEREAS,the parties mutually agree to the following:
I, That this complaint will stop at Step 2—Immediate Supervisor's Response.
1 The City will conduct an internal recruitment for the position of Engineer with the Bozeman Fire
Department.
3. FF Tucker formally withdraws his complaint dated December 6, 2011.
